SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated November 21,2023 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTSMESCRIPTION: The subject,conforming,rectangular-shaped,253,280 square feet,5.814- acre parcel located in the Agricultural Conservation (AC) Zoning District measures 243.85 feet along Oregon Road, then runs north 957.84 feet along a right of way known as Castle Hill Road, then continues west, 315.89 feet along Castle Hill Road and returns 1,129.79 feet back to the roadway, along a residentially developed lot to the west. The parcel is improved with a single-family,one-story stucco house with attached garage,covered entry and paver walkway, covered rear terrace, inground pool and firepit, and gravel driveway as shown on the survey prepared by Nathan Taft Corwin, III,Land Surveyor, and last revised October 21, 2022. BASIS OF APPLICATION: The applicant requests a Special Exception pursuant to Article I11, Section280-13B, subsection 14 of the Zoning Code, to operate a Bed and Breakfast within her existing six-bedroom single-family dwelling, accessory and incidental to her principal residential occupancy under the Building Department's Certificate of Occupancy, Z-43716 dated December 22, 2022. The applicant proposes to use five (5) bedrooms for the B&B and retain one for herself. The applicant states that her family does not intend to live there and she will be living there by herself. The proposed five (5) bedrooms are for lodging and serving of breakfast to ten (10) B & B casual, transient roomers in what was stated to be the applicants' primary residence, a one family dwelling. ADDITIONAL INFORMATION: The public hearing for this application was opened concurrently with the public hearing of application #7870, Sharon Nassi/15105 Oregon Road, LLC where the applicant is seeking a variance to allow the `as built' placement of deer fencing in a front yard location of a residence with three (3) front yards. Page 2,January 18,2024 #7865SE, Nassi—Special Exception—Bed & Breakfast SUM No. 1000-73-1-1 Communications between the Zoning Board office staff and the applicant was primarily with Craig Nassi,spouse of the applicant. Mr. Nassi's email communications are from BCNDevelopment.com (By Craig Nassi), a real estate developer, located in New York City,who highlights the subject parcel on his landing page, among several large-scale commercial projects. The applicant stated at the hearing that she is the mother of three (3) young daughters,who are taken care of by their grandparents in New York City and that the children spend time between their grandparents and her husband's address(again, 505 East 791h Street#19e,NYC,NY 10075. The applicant further stated that the children spend summers away at camp. She added that she resides full time at the subject premises and that her husband lives at 505 East 79th Street,#19E,NYC,NY. The applicant indicated that she presently rents the subject house out, per Code, for a minimum of two weeks at a time and has a valid rental permit,#797,dated December 22,2022;due to expire December 22,2024,Applicant stated that consumers prefer short stays, ideally one to two nights, thus, her interest in converting her house to a B&B use. Should a B&B Special Exception permit be issued for the subject premises, the rental permit will be required to be surrendered,as Town Code does not allow both to exist concurrently. The applicant did not share where she lives when the house is rented. The applicant presently has two open building permits at the subject property:#48648,dated December 22,2022, for the construction of an inground swimming pool with an attached raised patio,and#49908,dated October 19, 2023, for the installation of roof mounted solar panels. A Town of Southold Notice of Violation (complaint) was issued June 30, 2023 to the property owner (15105 Oregon Road LLC, 1199 Park Avenue,New York City,NY 10 128)for a deer fence in front yard location with a follow-up inspection date of July 10, 2023. Town of Southold Fire Marshall, Fredric Visser, in response to a request for comments from this Board, replied November 8,2023 stating that he will review the file once the open building permits and violations are resolved. The applicant did not include a required parking plan illustrating parking for a minimum of seven(7) cars, one for each B&B guest room and two for the primary owner/occupant. Furthermore,the applicant did not provide copy of a STAR rebate commonly used to support residency. The house plans illustrated a series of en suite bedrooms complete with full baths and an open plan living room/dining room/kitchen and a den. Multiple letters of opposition were received in advance of the public hearing from adjoining property owners and other members of the community. During the public hearing several people spoke against this application, including a representative of Friends of Oregon Road,representing 40 homeowners on Oregon Road. Included in the verbal and written testimony of the adjoining property owners was the consensus that no one lives at this address full time. Further,applicant is advertising the property as having an `ocean view' where there are in fact no ocean views in the Town of Southold. Additionally, in response to the Board questioning the applicant about her listing the premises as a working agricultural parcel,neighbors stated the rows of grapes were just planted and appear to be for aesthetic landscaping purposes, which the applicant did not refute. There were numerous contradictions between the testimony and information provided by the applicant and the testimony and information provided by the applicant's neighbors.No member of the public or a neighbor spoke in favor of this application. One individual who spoke in opposition to this application indicated that she communicated with the `owner', a gentleman named Craig Nassi,via the Airbnb platform, asking if she could rent the subject premises for 5 days (knowing there is a Town Code 14-day minimum rental period). In her email communication(not provided but offered as verbal testimony)the request was granted, in contravention of the Town of Southold Rental Code. Page 3,January 18, 2024 #7865SE, Nassi—Special Exception—Bed & Breakfast SCTM No. 1000-73-1-1 f FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on January 4,2024 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, and upon review of the code requirements set forth pursuant to Article I11, Section 280-13B (14)to establish an Accessory Bed and Breakfast,the Board finds that there is not enough evidence presented for the Board to conclusively find that the applicant complies with the requirements set forth below. 1. Sharon Nassi, is the applicant and owner of the property, located at 15105 Oregon Road, Cutchogue,NY 11935.The owner/applicant has stated she will continue to occupy same as her principal residence while the Accessory Bed and Breakfast facility is managed and operated. However,the testimony offered and the documents submitted do not corroborate this intent. There was not enough written proof to establish the premises as her primary residence. Conflicting documents show her address in New York City and purported residence in Cutchogue. There was also a substantial discrepancy between the applicant's verbal testimony regarding her family and the occupancy she proposed for the B&B. Applicant stated she will live alone in Cutchogue and her husband and three children will live in New York City. 2. The owner/applicant submitted the following documents,which do not conclusively confirm her principal occupancy of the dwelling: a. Copy of a deed transferring the property from 15105 Oregon Road, LLC to Sharon Nassi, dated February 17,2023.The applications for files,#7870 and 7865SE are both in the name of the LLC with a New York City address. b. Copy of a 2022 U.S. Individual Income Tax Return form 1040, dated September 27, 2023, for a married couple filing jointly,with applicant's name as Sharon J. Richter. The tax return lists the applicant's profession as `Registered Dietitian' and listing three (3) minor dependents. Spouse, Craig Nassi, is listed as a real estate developer. No address was provided. At the hearing the applicant stated that she is a Registered Dietitian with a`virtual' practice consulting clients from her home in Cutchogue. Based on a google.com search, Sharon Nassi (Richter), Registered Dietitian, has an office located at 200 W 57th St. Suite 1400,NYC,NY 10019. which highlights her practice and career based in Manhattan. c. Copy of a PSEG Long Island utility bill,for service to: 15105 Oregon Road,Cutchogue,NY for the period of September 25 to October 10, 2023. d. Copy of a NYS Voter Registration form (application) e. Copy of the applicant's (Sharon Nassi)New York State Driving License illustrating an address other than the subject premises (505 East 79th Street 419e,NYC, NY 10075). Applicant stated she does not live at that address but rather lives alone in Cutchoque. f. Copy of Peoples Premium Finance statement illustrating an address other than the subject premises(505 East 79th Street#19e,NYC,NY 10075). This is the same address as her driver's license. g. Copy of a marketing mailer/postcard from Crate & Barrel (retail store) sent to the subject property. h. Copy of several images taken from www.NorthFork.com illustrating the exterior/interior of the subject residence. i. Copy of architectural plans for the house, including site plan, floor plan, elevations, window & door schedule, and window & door elevation prepared by Scott Specht, Registered Architect dated July 13, 2021. 3. The applicant's plans do not comply with the on-site parking requirements and provide for seven (7) parking spaces,two for the principal single-family use and one(1)for each of the five proposed Accessory Bed and Breakfast bedroom. The survey submitted did not show a parking plan layout to confirm the location of seven designated parking spaces. Page 4,January 18, 2024 #7865SE, Nassi—Special Exception—Bed & Breakfast SUM No. 1000-73-1-1 4. The applicant complies with the requirements of a dwelling unit as defined in Section 280-4 of the Zoning Code 5. The Accessory Bed and Breakfast, as applied for, is reasonable in relation to the District in which it is located,adjacent use districts, and nearby and adjacent residential uses 6. The Special Exception is not accessory to the principal use (as a primary residence) and will prevent the orderly and reasonable use of adjacent properties. The applicant did not provide floor plans illustrating any personal/private spaces (bedroom, bathroom, living room, kitchen, etc. or a home office location where the applicant can conduct her practice as a Registered Dietician away from B&B guests.Nor were there any designated public areas noted where B&B guests are permitted. Additionally, upon personal inspection by the Board members,the premises appeared sterile,all bedrooms were furnished identically, including the owner/applicant's bedroom,and no personal items were observed to indicate that someone was living in the house. Therefore,the Board cannot conclusively find the premises to be the applicant's principal use as a primary residence and the proposed B&B use accessory same. 7. This accessory Bed and Breakfast will not prevent the orderly and reasonable uses proposed or existing in adjacent use districts. 8. Evidence has been submitted to show that the safety, health,welfare,comfort,convenience or the order of the town will be adversely affected. The applicant has open building permits and noted violation(s). Furthermore,the applicant was unaware of the open permits. This was unsettling for the Board to find a homeowner unaware of an open permit for a swimming pool,which could be a danger to anyone 9. The use of this property is not sufficiently established and therefore cannot be in harmony and promote the purpose of the B&B code requirements. 10. The Board is also unable to determine if the use is compatible with the surroundings and community in general, especially with regard to scale and overall appearance because the applicant has not proven this will be her sole residence and the property will be a B&B. 11. Although the structures may be accessible for fire and police, the requirements in Chapter 280 Section 142 cannot all be determined by the Zoning Board. 12. This zoning use is not authorized for use by the applicant, by the Zoning Code through the Zoning Board of Appeals as noted herein, and the issuance of a Certificate of Occupancy from the Building Inspector is required by code before an Accessory use may be occupied. 13. Adverse conditions were found after considering items listed under Section 280-142 and 280-143 of the Southold Town Zoning Code. Thus, the Board cannot accurately find.that the standards required by the Code for a Special Exception are met. 14. Submission of a Certificate of Compliance or similar document will be necessary for issuance by the Building Inspector certifying that the premises conforms.to Chapter 280 of the Zoning Code for an Accessory Bed and Breakfast use. RESOLUTION OF THE BOARD: In considering all of the above factors, motion was offered by Member Planamento, seconded by Member Lehnert, and duly carried to DENY the Special Exception permit for an Accessory Bed and Breakfast. As a full time resident of Cutchogue and a direct neighbor to this property, I have many concerns regarding the proposed conversion and how it will be used today and tomorrow: • My first objection is emotional- it is an "eye sore" and could not be more out of character on Oregon Road or in the town of Cutchogue. • As far back as I can recall, our town's representatives (and politicians) proudly commented and expressed their commitment to preserve one of the last remnants of farming on long island— allowing structures like this to be built will irrevocably destroy Oregon road. • Agreeing to the original Building Permits clearly altered the future of Oregon road and one would have thought that our town representative,who live in the community, would have summarily rejected a design that could not be more out of place on Oregon Road or our Township. • Not that this is a valid argument, but I have been trying purchase the property since I moved here in 2005. My intent was to sell the development rights and upon my death turn the land over to the Town. 2 i • Our elected representative continually boast about the tranquility ana historical significance of Oregon road and how"we the people" preserved one of the last agricultural roads on Long Island, whywould you agree to a structural design that is so far out of character and offensive to the residents of Cutchogue? • Adding what might be insult to injury, the town appears to have bent over backwards to issue a building permit to an out-of-town developer with no roots or vested interest in the community allowing them to construct an ultra-modern and architecturally out of place structure on vacant farmland to make a quick buck. And then, adding more insult to injury, after failing to sell the property for a price in excess of$7,000,000 the owner has the temerity to ask the town to consider (and I understand that the meeting Thursday is the first step in a process), a "hail Mary"to protect the owner's financial interest by converting the property to a bed &breakfast- a commercial enterprise that will likely include destination weddings and the attending noise. • Furthermore, failing to sell the property and then seeking approval to convert it into a bed and breakfast appears to be contrary to the goals and policies outlined in the Town of Southold Local Waterfront Revitalization Program, specifically Section III which emphasizes the preservation, rural character and scenic quality of the town's waterfront areas. • The Southold Town Farm and Farmland Protection Strategy from 2000 strongly advocates for the preservation of farmland and open spaces in our community. The original building permit and the proposed conversion (and expansion) of this- property—especially in an area known for its scenic landscapes—undermines every in- place conservation program by introducing commercial activity and increased traffic, irrevocably disturbing the peaceful and rural nature of Oregon Road. I believe this property is in the "Agricultural Conservation / Residential zone (A-C / R-80)" which created zones specifically designed and intended to provide an open rural environment so highly valued by our residents of which I am one. At the risk of repeating myself, Mr. and Mrs. Nassi are not residents in the Town of Southold and as such, they have no vested interested in preserving the tranquility of the area: they are developers, and they are in it for a financial payday. Sadly, and perhaps thankfully their plan failed but now they want/expect the residents to allow a variance to protect their investment until a buyer surfaces. Consider the following: using simple math and the Nessi's perception of the property's value ($7,000,000 +/-) the math does not work! To wit: if you impute an unrealistic daily rental charge of $2,000, and the house is rented 365 days a year, it will take ten years ($7,000,000/$2,000 = 3,500 rental days) to theoretically break even. For every dollar ' below $2,000 a day., extends the time line significantly especially when you consider that the house will be vacant more often than rented. With the above assumptions as a baseline, amortizing $7,000,000 will take more far more than 10 years and this time line analysis does not take into consideration inflation 3 I � driven operating expenses, Property and Liability Insurance on what might be classified as a vacant house, routine maintenance, rental fees and Property taxes. On almost any logical basis, the financial model is flawed and unrealistic. If you view their website (bcndevelopment.com), the company's strategic focus is to "acquire develop own manage, reposition, and financially engineer real estate assets." This property is showcased and- simply stated - has irrevocably altered the character of Oregon Road through its oversized, jarring aesthetic and ultra-modern design. It stands in stark contrast to the bucolic farms and open spaces that once defined Oregon Road. Allowing the property owners to make the property a place for tourists among our homes, families and local farms would only heighten the relevant issues and it disregards the rights of Oregon Road residents! Compounding the above, there appear to be unfulfilled commitments by the property owners: • They committed to plantings along the property have not been realized, raising concerns about their commitment to preserving the area's natural beauty and integrity. • These vines were intended to reduce the visibility of the property to both neighbors and the community. • Mrs. Nassi states in her application that "no neighbors are within 1/4 mile," implying that this conversion and expansion would not disturb the local community. Clearly, there are many homes closer than % mile and she did not consider the new home nearing completion just west of the Nassi property. This property has disrupted our local community, and approving the owners' proposal will only make it worse. In addition, they erected — without town approval, unauthorized cheap plastic web deer fencing around the property that is an eye sore, but it may encroach on town property and changed entry to our homes on our private country road into little more than a path in an ever-growing rat maze of deer fencing. The grapes were not there before the construction, and I do not understand why we must accept an eye sore because they didn't consider the deer population before planting grapes or installing the fence. Based on the above, my neighbors and I strongly urge the Town to consider both the immediate and long-term impacts of this proposed conversion on our community's character, environment, and quality of life. The preservation of our unique, rural and scenic charm should be a paramount priority and should not be compromised to protect out of town investors looking to make a quick financial killing and when they fail, expecting the town to agree to variances to protect their ill-founded speculation or bail them out! 4 I implore the Board to carefully consider the rights of the G6idents and well-being of the Oregon Road community and to make a decision that upholds the visions set forth in our community's strategic plans and policies and the wishes of the residents and the community. I and other property owners in the Oregon Road neighborhood have some significant concerns regarding the proposed permit to operate a B&B on the subject property. We are primarily concerned regarding the impact that the proposed operation will have on the environment including increased traffic given the transient nature of the operation of a B&B. We respectfully assert that the proposed operation is inconsistent with the current residential and agricultural nature of Oregon Road. Based upon information and belief we understand that the current owner of the subject property has been unsuccessful in attempts to either sell the subject property or to rent it in compliance with the existing rental rules and regulations. I have been in touch with many of our neighbors on Oregon Rd who have expressed opposition to this project. Due to the time of year unfortunately are not able to attend in person. Please let me state the facts as I know them and then additional reasons to not allow this business venture to proceed. The house in question was up for sale for a considerable time with no success. It was then listed for rent by owner " Craig". The owner of this property does not live there. The listing states it's for a two week rental but then states DM for other options meaning they only inserted the°two week language to placate the town. Apparently rental did not work. So now owner is trying to generate income by making this a B&B. The owner needs to be actually present in order to operate a B&B in order to stay compliant. They cannot hire a manager to ru it. This would not be in compliance . Now I'd like to share our thoughts on the quality of life for Oregon Rd. Wayne and I are in our late 60's . Although not native nf's we are small town native long islanders. I grew up in CP which was a farming community as much of Ii was. We've been loving Oregon Rd for years and finally realized our dream of owning property on the road but most importantly to preserve it and protect it from developers. We are just a few weeks shy of completion. I have my dream of sitting on my front porch looking at Lieb's vineyards and Wayne has his dream garage. We thought w 13 plus acres we'd have privacy. Imagine turning the corner on Bridge Lane on Oregon and seeing a. Concrete structure with a massive billboard stating views of the Ocean! Obviously the builder was not from here. The owners live in Manhatten and are well entrenched there according to our research. We feel there was absolutely no regard for the historical and beautiful Oregon Rd. It was simply another builder and now owner trying to profit from our area. It's simply not in the right place and certainly not in compliance. We are urging the town to reject this application. Mr. Nassi's email communications are from BCNDevelopment.com (By Craig Nassi), a real estate developer, located in New York City,who highlights the subject parcel on his landing page,among several large-scale commercial projects. The applicant stated at the hearing that she is the mother of three (3) young daughters,who are taken care of by their grandparents in New York City and that the children spend time between their grandparents and her husband's address(again, 505 East 79th Street#19e,NYC,NY 10075. The applicant further stated that the children spend summers away at camp. She added that she resides full time at the subject premises and that her husband lives at 505 East 79th Street,#19E,NYC,NY. The applicant indicated that she presently rents the subject house out, per Code, for a minimum of two weeks at a time and has a valid rental permit,#797,dated December 22,2022,due to expire December 22,2024,Applicant stated that consumers prefer short stays, ideally one to two nights,thus, her interest in converting her house to a B&B use. Should a B&B Special Exception permit be issued for the subject premises, the rental permit will be required to be surrendered, as Town Code does not allow both to exist concurrently. The applicant did not share where she lives when the house is rented. The applicant presently has two open building permits at the subject property:#48648,dated December 22,2022, for the construction of an inground swimming pool with an attached raised patio, and#49908, dated October 19, 2023, for the installation of roof mounted solar panels. A Town of Southold Notice of Violation (complaint) was issued June 30, 2023 to the property owner (15105 Oregon Road LLC, 1199 Park Avenue,New York City,NY 10 128)for a deer fence in front yard location with a follow-up inspection date of July 10;2023. Town of Southold Fire Marshall, Fredric Visser, in response to a request for comments from this Board, replied November 8,2023 stating that he will review the file once the open building permits and violations are resolved. The applicant did not include a required parking plan illustrating parking for a minimum of seven(7)cars,'one for each B&B guest room and two for the primary owner/occupant. Furthermore,the applicant did not provide copy of a STAR rebate commonly used to support residency. The house plans illustrated a series of en suite bedrooms complete with full baths and an open plan living room/dining room/kitchen and a den. Multiple letters of opposition were received in advance of the public hearing from adjoining property owners and other members of the community.During the public hearing several people spoke against this application, including a representative of Friends of Oregon Road,representing 40 homeowners on Oregon Road. Included in the verbal and written testimony of the adjoining property owners was the consensus that no one lives at this address full time. Further,applicant is advertising the property as having an `ocean view' where there are in fact no ocean views in the Town of Southold. Additionally, in response to the Board questioning the applicant about her listing the premises as a working agricultural parcel,neighbors,stated the rows of grapes were just planted and appear to be for aesthetic landscaping purposes,which the applicant did not refute. There were numerous contradictions between the testimony and information provided by the applicant and the testimony and information provided by the applicant's neighbors.No member of the public or a neighbor spoke in favor of this application. One individual who spoke in opposition to this application indicated that she communicated with the `owner', a gentleman named Craig Nassi,via the Airbnb platform, asking if she could rent the subject premises for 5 days (knowing there is a Town Code 14-day minimum rental period). In her email communication(not provided but offered as verbal testimony)the request was granted, in contravention of the Town of Southold Rental Code. 4 Page 3,January 18, 2024 #7865SE, Nassi—Special Exception—Bed & Breakfast SCTM No. 1000-73-1-1 FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on January 4,2024 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, and upon review of the code requirements set forth pursuant to Article III, Section 280-13B(14)to establish an Accessory Bed and Breakfast,the Board finds that there is not enough evidence presented for the Board to conclusively find that the applicant complies with the requirements set forth below. 1. Sharon Nassi, is the applicant and owner of the property, located at 15105 Oregon Road, Cutchogue,NY 11935.The owner/applicant has stated she will continue to occupy same as her principal residence while the Accessory Bed and Breakfast facility is managed and operated. However,the testimony offered and the documents submitted do not corroborate this intent. There was not enough written proof to establish the premises as her primary residence. Conflicting documents show her address in New York City and purported residence in Cutchogue. There was also a substantial discrepancy between the applicant's verbal testimony regarding her family and the occupancy she proposed for the B&B. Applicant stated she will live alone in Cutchogue and her husband and three children will live in New York City. 2. The owner/applicant submitted the following documents,which do not conclusively confirm her principal occupancy of the dwelling: a. Copy of a deed transferring the property from 15105 Oregon Road, LLC to Sharon Nassi, dated February 17,2023.The applications for files,#7870 and 7865SE are both in the name of the LLC with a New York City address. b. Copy of a 2022 U.S. Individual Income Tax Return form 1040, dated September 27, 2023, for a married couple filing jointly,with applicant's name as Sharon J.Richter. The tax return lists the applicant's profession as `Registered Dietitian' and listing three (3) minor dependents. Spouse, Craig Nassi, is listed as a real estate developer. No address was provided. At the hearing the applicant stated that she is a Registered Dietitian with a`virtual' practice consulting clients from her home in Cutchogue. Based on a google.com search, Sharon Nassi (Richter), Registered Dietitian,has an office located at 200 W 57th St. Suite 1400,NYC,NY 10019.which highlights her practice and career based in Manhattan. c. Copy of a PSEG Long Island utility bill,for service to: 15105 Oregon Road,Cutchogue,NY for the period of September 25 to October 10, 2023. d. Copy of a NYS Voter Registration form(application) e. Copy of the applicant's (Sharon Nassi)New York State Driving License illustrating an address other than the subject premises (505 East 79th Street#19e, NYC, NY 10075). Applicant stated she does not live at that address but rather lives alone in Cutchoque. f. Copy of Peoples Premium Finance statement illustrating an address other than the subject premises (505 East 79th Street#19e,NYC,NY 10075). This is the same address as her driver's license. g. Copy of a marketing mailer/postcard from Crate & Barrel (retail store) sent to the.subject property. h. Copy of several images taken from www.NorthFork.com illustrating the exterior/interior of the subject residence. i. Copy of architectural plans for the house, including site plan, floor plan, elevations, window & door schedule, and window & door elevation prepared by Scott Specht, Registered Architect dated July 13, 2021. 3. The applicant's plans do not comply with the on-site parking requirements and provide for seven (7) parking spaces,two for the principal single-family use and one(1)for each of the five proposed Accessory Bed and Breakfast bedroom. The survey submitted did not show a parking plan layout to confirm the location of seven designated parking spaces. The Accessory Bed and Breakfast, as applied for, is reasonable in relation to the District in which it is located,adjacent use districts, and nearby and adjacent residential uses 6. The Special Exception is not accessory to the principal use (as a primary residence) and will prevent the orderly and reasonable use of adjacent properties. The applicant did not provide floor plans illustrating any personal/private spaces (bedroom, bathroom, living room, kitchen, etc. or a home office location where the applicant can conduct her practice as a Registered Dietician away from B&B guests.Nor were there any designated public areas noted where B&B guests are permitted. Additionally, upon personal inspection by the Board members,the premises appeared sterile,all bedrooms were furnished identically, including the owner/applicant's bedroom, and no personal items were observed to indicate that someone was living in the house. Therefore,the Board cannot conclusively find the premises to be the applicant's principal use as a primary residence and the proposed B&B use accessory same. 7. This accessory Bed and Breakfast will not prevent the orderly and reasonable uses proposed or existing in adjacent use districts. 8. Evidence has been submitted to show that the safety,health,welfare,comfort,convenience or the order of the town will be adversely affected. The applicant has open building permits and noted violation(s). Furthermore,the applicant was unaware of the open permits. This was unsettling for the Board to find a homeowner unaware of an open permit for a swimming pool,which could be a danger to anyone- 9. The use of this property is not sufficiently established and therefore cannot be in harmony and promote the purpose of the B&B code requirements. 10. The Board is also unable to determine if the use is compatible with the surroundings and community in general, especially with regard to scale and overall appearance because the applicant has not proven this will be her sole residence and the property will be a B&B. 11. Although the structures may be accessible for fire and police, the requirements in Chapter 280 Section 142 cannot all be determined by the Zoning Board. 12. This zoning use is not authorized for use by the applicant,by the Zoning Code through the Zoning Board of Appeals as noted herein, and the issuance of a Certificate of Occupancy from the Building Inspector is required by code before an Accessory use may be occupied. 13. Adverse conditions were found after considering items listed under Section 280-142 and 280-143 of the Southold Town Zoning Code. Thus,the Board cannot accurately find that the standards required by the Code for a Special Exception are met. 14. Submission of a Certificate of Compliance or similar document will be necessary for issuance by the Building Inspector certifying that the premises conforms to Chapter 280 of the Zoning Code for an Accessory Bed and Breakfast use. My intent was to sell the development rights and upon my death turn the Landover to the Town. • Our elected representative continually boast about the tranquility and historical significance of Oregon road and how"we the people",preserved one of the last agricultural roads on Long Island, why would you agree to a structural design that is so far out of character and offensive to the residents of Cutchogue? • Adding what might be-insult to injury, the town appears to have bent over backwards to issue a building permit to an out-of-town developer with no roots or vested interest in the community allowing them to construct an ultra-modern and architecturally out of place structure on vacant farmland to make a quick buck. And then, adding more insult to injury, after failing to sell the property for a price in excess of$7,000,000 the owner has the temerity to ask the town to consider (and I understand that the meeting Thursday is the first step in a process), a "hail Mary"to protect the owner's financial interest by converting the property to a bed & breakfast-a commercial enterprise that will likely include destination weddings and the attending noise. • Furthermore, failing to sell the property and then seeking approval to convert it into a bed and breakfast appears to be contrary to the goals and policies outlined in the Town of Southold Local Waterfront Revitalization Program, specifically Section III which emphasizes the preservation, rural character and scenic quality of the town's waterfront areas. • The Southold Town Farm and Farmland Protection Strategy from 2000 strongly advocates for the preservation of farmland and open spaces in our community. The original building permit and the proposed conversion (and expansion) of this property—especially in an area known for its scenic landscapes—undermines every in- place conservation program by introducing commercial activity and increased traffic, irrevocably disturbing the peaceful and rural nature of Oregon Road. 5 I believe this property is in the "Agricultural Conservation / Residential zone (A-C / R-80)", which created zones specifically designed and intended to provide an open rural environment so highly valued by our residents of which I am one. At the risk of repeating myself, Mr. and Mrs. Nassi are not residents in the Town of Southold and as such, they have no vested interested in preserving the'tranquility of the area: they are developers, and they are in it for a financial payday. Sadly, and perhaps thankfully their plan failed but now they want/expect the residents to allow a variance to protect their investment until a buyer surfaces. Consider the following: using simple math and the Nessi's perception of the property's value ($7,000,000 +/-) the math does not work! To wit: if you impute an unrealistic daily rental charge of $2,000, and the house is rented 365 days a year, it will take ten years ($7,000,000/$2,000 = 3,500 rental days) to theoretically break even. For every dollar below $2,000 a day, extends the time line significantly especially when you consider that the house will be vacant more often than rented. With the above assumptions as a baseline, amortizing $7,000,000 will take more far more than 10 years and this time line analysis does not take into consideration inflation driven operating expenses, Property and Liability Insurance on what might be classified as a vacant house, routine maintenance, rental fees and Property taxes. On almost any logical basis, the financial model is flawed and unrealistic. If you view their website (bcndevelopment.com), the company's strategic focus is to "acquire, develop, own, manage, reposition, and financially engineer real estate assets." This property is showcased and- simply stated - has irrevocably altered the character of Oregon Road through its oversized, jarring aesthetic and ultra-modern design. It stands in stark contrast to the bucolic farms and open spaces that once defined Oregon Road. Allowing the property owners to make the property a place for tourists among our homes, families and-local farms would only heighten the relevant issues and it disregards the rights of Oregon Road residents! Compounding the above, there appear to be unfulfilled commitments by the property owners: 6 • They committed to'N,aatings along the property have not -.an realized, raising concerns about their commitment to preserving the area's natural beauty and integrity. • These vines were intended to reduce the visibility of the property to both neighbors and the community. • Mrs. Nassi states in her application that "no neighbors are within 1/4 mile," implying that this conversion and expansion would not disturb the local community. Clearly, there are many homes closer than % mile and she did not consider the new home nearing completion just west of the Nassi property. This property has disrupted our local community, and approving the owners' proposal will only make it worse. In addition, they erected — without town approval; unauthorized cheap plastic web deer fencing around the property that is an eye sore, but it may encroach on town property and changed entry to our homes on our private country road into little more than a path in an ever-growing rat maze of deer fencing. The grapes were not there before the construction, and I do not understand why we must accept an eye sore because they didn't consider the deer population before planting grapes or installing the fence. Based on the above, my neighbors and I strongly urge the Town to consider both the immediate and long-term impacts of this proposed conversion on our community's character, environment, and quality of life. The preservation of our unique, rural and scenic charm should be a paramount priority and should not be compromised to protect out of town investors looking to make a quick financial killing and when they fail, expecting the town to agree to variances to protect their ill-founded speculation or bail them out! I implore the Board to carefully consider the rights of the residents and well-being of the Oregon Road community and to make a decision that upholds the visions set forth in our community's strategic plans and policies and the wishes of the residents and the community.
