SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated October 26,2023stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a conforming 45,545 square foot lot located in the Residential R-40 Zoning District. The northerly property line measures 180.1 feet, the easterly property line measures 253.38 feet,the southerly property line measures 177.47 and is adjacent to the Main Road, and the westerly property line measures 252.17 feet. The parcel is improved with a two-story frame dwelling with a ground level deck at the rear of the dwelling with a second story rear deck and stairs along with an inground swimming pool in the rear yard with a brick patio surrounded with a chain link fence. To the northeast of the pool is a framed barn as shown on the survey map prepared by Ward Brooks, LS and dated November 30, 2020. BASIS OF APPLICATION: The applicants request a Special Exception pursuant to Article III, Section280-1313, subsection 14 of the Zoning Code, to operate a Bed and Breakfast within their existing single-family dwelling,accessory and incidental to their principal residential occupancy under the Building Department's Certificate of Occupancy#44566 dated September 24,2023. The proposed One(1)bedroom or lodging and serving of breakfast to 2 guests Bed and Breakfast casual, transient roomers was created with an existing bedroom as well as additions and alterations to the applicants' existing one family dwelling by conversion of a stairway and private entrance to the bedroom under Certificate of Occupancy No.44566 dated August 2, 2023. ADDITIONAL INFORMATION: The residence is located in the Town of Southold Historic Preservation District and received a Certificate of Appropriateness dated June 22,2023, for the alterations and additions as described in the Site Plan drawings prepared by Nicholas J.Mazzafeiro,LPE,received October 20,2023, along with drawings of the layout of the dwelling rooms as prepared for the B&B by Nicholas J.Mazzaferro, Page 2,January 18, 2024 #7861SE, Norris SUM No. 1000-102-2-18 LPE and dated October 12, 2023. The guest bedroom is separated from the family bedrooms by stairs making it a private area. The guests can enter by the newly built stairs with a private door entry on'the newly built deck on the second story. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on January 4, 2024, at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,and upon review of the code requirements set forth pursuant to Article III, Section 280-13B (14) to establish an Accessory Bed and Breakfast, the Board finds that the applicant complies with the requirements for the reasons noted below: 1. Sean and Catherine Norris, the applicants herein, are the owners of the property, located at 30325 Main Road, Cutchogue, NY. SCTM#1000-102-2-18. It is improved with a two-story frame dwelling as shown on the survey map dated September 20, 2020. The owners/applicants will continue to occupy same as their principal residence while the Accessory Bed and Breakfast facility is managed and operated. The applicant(s) have submitted the following proof that the subject premises is their principal dwelling: redacted NYS tax return,utility bill from National Grid, Suffolk County Water Authority bill, New York State driver's licenses, voter registration, a Star Property Registration. 2. The owner/applicant submitted the following documents to confirm the principal occupancy of the dwelling as submitted by all of the above documents. 3. The applicant's plans comply with the on-site parking requirements and provide for 4 parking spaces, two for the principal single-family use and one (1) for each of the Accessory Bed and Breakfast bedroom(s) 4. The applicant(s) complies with the requirements of a dwelling unit as defined in Section 280-4 of the Zoning Code 5. The Accessory Bed and Breakfast, as applied for, is reasonable in relation to the District R-40 in which it is located, adjacent use districts, and nearby and adjacent residential uses. 6. The Special Exception is accessory to the principal use and will not prevent the orderly and reasonable use of adjacent properties. 7. This accessory Bed and Breakfast will not prevent the orderly and reasonable uses proposed or existing in adjacent use districts. 8. No evidence has been submitted to show that the safety, health, welfare, comfort, convenience or the order of the town will not be adversely affected. 9. This zoning use is authorized by the Zoning Code through the Zoning Board of Appeals as noted herein, and issuance of a Certificate of Occupancy from the Building Inspector is required by code before an Accessory use may be occupied. 10. No adverse conditions were found after considering items listed under Section 280-142 and 280- 143 of the Southold Town Zoning Code. 11. Submission of a Certificate of Compliance or similar document will be necessary for issuance by the Building Inspector certifying that the premises conforms to Chapter 280 of the Zoning Code for an Accessory Bed and Breakfast use. RESOLUTION OF THE BOARD: In considering all of the above factors,motion was offered by Member Weisman(Chairperson) seconded by Member Lehnert, and duly carried to Page 3,January 18,2024 #7861SE, Norris SUM No. 1000-102-2-18 GRANT the Special Exception permit for an Accessory Bed and Breakfast for One(1) guest bedroom to be used only in conjunction with the applicants-owners residence,as applied for and shown on the Site Plan received on October 20,2023, Floor Plan,dated October 12,2023,and Elevations,dated February 1,2023, all prepared by Nicholas J. Mazzaferro, LPE. SUBJECT TO THE FOLLOWING CONDITIONS: 1. This Special Exception Permit requires an operating permit and inspection by a Building Inspector from the Building Department that must be renewed annually.It is the applicant's responsibility to contact the Building Department each year to schedule the required inspection.Failure to do so may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein. 2. This Special Exception permit cannot be transferred to new owners. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings, cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. In the event that this is a special permit subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. Any violations of the conditions, occupancy or other requirements described herein, may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception permit as granted herein. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. The dwelling shall have at least two (2) exits and there shall be a window to code to provide emergency egress in every sleeping room for B&B use. Means of egress shall include at least one of the following alternatives: • A portable escape ladder that attached securely to the sill, shall be provided for second story rooms for B&B use, constructed with rigid rungs designed to stand off from the building wall, it shall be capable of sustaining a minimum load of 1,000 pounds, and shall extend to and provide unobstructed egress to open space a grade • An exterior stair per code • Or limited area sprinkler system per code 6. There shall be no exterior signage identifying the use as a Bed and Breakfast in residential areas; 7. No accessory apartment, as authorized by Section 280-13(8)(14) shall be permitted in or on premises for which a Bed and Breakfast is authorized or exists; 8.
