LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. REQUEST MADE BY APPLICANT: The Applicant-Owner requests a Special Exception under Zoning Code Section 280-13(B)(13)to establish an Accessory Apartment in an existing accessory structure. An existing structure 30.1 feet by26.3 feet garage will be converted to an accessory apartment to accommodate the applicant's sister. PROPERTY FACTS/DESCRIPTION: The subject property is a conforming 71,546 square foot parcel located on the Residential R-40 Zoning District. The northerly property line measures 119.09 feet and adjacent to Pine Road, the easterly property line measures 193.22 feet and is adjacent to Maple Road,the southerly property line measures in total 250.30 feet and is adjacent to Chestnut Road, and the westerly property line measures 383.63 feet and is adjacent to Birch Road. The parcel is improved with a one- story frame dwelling, with an inground swimming pool with a brick patio located north of the residence. A one-story frame two car garage is located south of the residence as shown on the survey map prepared by Nathan Taft Corwin, III, LS and dated July 19, 2023, and the Site Plan drawings prepared by Charles M.Thomas, Architect and dated August 23, 2023. ADDITIONAL INFORMATION: At the public hearing the applicant testified that he sold his principal dwelling on Shelter Island and that the subject dwelling will be his principal dwelling upon completion of some renovations. The applicant has requested variance relief for the expansion of the accessory structure in related ZBA file#7863. Both the variance and special exception applications were opened together at the public hearing. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on January 4, 2024, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and the surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant. Page 2,January 18,2024 ##7860SE,Kim SCTM No. 1000-115-2-11 In considering this application, the Board has reviewed the code requirements set forth pursuant to Article III, Section 280-13(B)(13) to establish an Accessory Apartment in an Accessory Structure and finds that the applicant does comply with all of the requirements for the reasons noted below: 1. The owner confirms that the accessory apartment shall contain no less than 220 square feet and shall not exceed 750 square feet of livable floor area and shall have no more than two bedrooms and one bathroom with the entirety of the livable floor area of the accessory apartment located on one floor of the accessory structure. The architectural plans prepared by Charles M. Thomas, Architect and dated August 23,2023 propose an accessory apartment with.one full bathroom entirely on one floor of the one-story building in the accessory structure with a conforming 719 square feet of livable floor area, as verified by the Building Department's "Verification of Livable Floor Area"request by the ZBA dated November 21,2023. 2. The dwelling unit complies with the definition of same in §280-4 of the code 3. The accessory structure does comply with the code requirement as defined in Section 280-13(B)(13)(e) of the Zoning Code which states the accessory structure must have been certified a minimum of three years prior to the establishment of the accessory apartment. The applicants were issued a Certificate of Occupancy No: Z-19313 for the subject accessory structure dated August 22, 1990. 4. The applicant herein, owns and resides at the property as documented by Affidavit of Principal Residency, Bargain and Sale Deed, a letter from utility PSEG confirming service to the applicant as of September 22, 2023, copy of the amount paid by the applicant to the Peconic Bay Region Community Preservation Fund,New York State copy of Combined Real Estate Transfer Tax Return,a New York State Driver License with the Southold address, A Suffolk County Voter Registration and a New York State STAR Registration Application Form, and confirms that: occupancy of the residential structures on the premises shall be subject to the issuance of an annual rental permit in accordance with 280-13D and the following requirements: one of the dwelling units shall be for the sole, exclusive occupancy of the owner or family member, as defined in chapter 280-4. The other dwelling unit shall be leased for year-round occupancy evidenced by a written lease for a term of one or more years to a family member or a resident who is currently on the Southold Town Affordable Housing Registry and eligible for placement. The applicant testified that the tenant of the accessory apartment will be the applicant's sister as evidenced by a signed lease by the applicant and his sister, Patricia K. Han for a period of 24 months at$1,000.00 a month. Although, the signed lease is for year-round occupancy for the sister,the applicant asserted that it will be occupied for only 6 months each year by his sister,and that no other person shall occupy the dwelling unit. The applicant was asked to provide a notarized affidavit attesting that the tenant is his sister. An affidavit was received from Patricia Kim Han on January 16,2024,dated January 13,2024 confirming that she is Bruce Kim's sister. 5. The owners' plans comply with the on-site parking requirements of three spaces, two for the principal dwelling and one for the accessory apartment, and provide for a total of 3 parking spaces as shown on a copy of a survey received on January 16, 2024, prepared by Nathan Taft Corwin, III, L.S., dated July 19, 2023. Original copies of the survey should be provided. 6. Only one accessory apartment will be on the subject property and no Bed and Breakfast facility, as authorized by Section 280-13(B)(14) hereof shall be permitted in or on premises for which an accessory apartment is authorized or exists. 7. This conversion is/shall be subject to a building permit, inspection by the Building Inspector, approval by the Suffolk County Department of Health Services of the water supply and sewage disposal system(s) and the issuance/renewal of an annual permit in accordance with Chapter 280-13D. No special exception shall be granted unless the Zoning Board of Appeals, in addition to the considerations,determinations and findings required in Chapters 280-142(General Standards)and 280-143 (Matters to be Considered)specifically finds and determines the following: 1. That the granting of the special exception will not adversely impact the privacy and use and enjoyment of any adjoining parcel. 2. That the granting of the special exception will not adversely impact the character of the neighborhood in which it is located. 3. That the cumulative effect'of approving the present application along with previously approved applications will not have a cumulative adverse impact on the surrounding neighborhood. 4. That the cumulative effect of approving the present application along with previously approved applications will not have a cumulative adverse impact on the school district in which the property is located. 5. That sufficient off-street parking exists on the subject property to accommodate the proposed accessory apartment. 6. Whether adequate buffer yards and screening can and will be provided to protect adjacent properties from possible detrimental impacts of the proposed use. RESOLUTION OF THE BOARD: In considering the entire record and the applicable code requirements, motion was offered by Member Acampora, seconded by Member Lehnert, and duly carried, to GRANT the Special Exception Permit as applied for as shown on survey prepared by Nathan Taft Corwin, III, L.S., dated July 19, 2023 and architectural plans prepared by Charles M. Thomas, Architect, dated August 23, 2023. SUBJECT TO THE FOLLOWING CONDITIONS: 1. This Special Exception Permit requires an annual renewal by a Code Enforcement Officer. It is the applicant's responsibility to apply to the Building Department each year to renew the accessory apartment permit. Failure to do so may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein. 2. This Special Exception permit cannot be transferred to new owners. 3. The applicant shall provide the Board with an original signed and sealed survey depicting the required parking plan showing three(3) parking spaces. 4. The applicant shall provide the Board with a copy of the Sales Deed recorded/filed with the Clerk of Suffolk County, for his Shelter Island dwelling and the purchase of the Southold Town property. 5. When the subject accessory apartment is not being occupied by the applicant's sister,Patricia Kim Han,as applied for,the accessory apartment may not be rented to or occupied by anyone else. 6. Per Town Code, the applicant may not rent his principal dwelling or apply for a permit to establish a bed-and-breakfast use as long as the accessory apartment approved herein exists. The subject accessory apartment may not be occupied until the applicant is residing in the subject principal dwelling That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision, may result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. In the event that this is a special permit subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. Any violations of the conditions, occupancy or other requirements described herein, may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein. (a)TENANT'S DEFAULTS: Landlord shall give Tenant three days written notice to correct any of the following defaults: i. Failure to pay rent,utility deposit and/or security deposit as scheduled. ii. Improper assignment of the Lease or subletting of the Premises. iii. Tenant's failure to comply with all laws, ordinances, and regulations of Federal, State and Local governments, applicable to the Premises and Tenant's use thereof. iv. Failure to perform any term in the Lease. If Tenant fails to correct any and all defaults under the Lease within five days of written notice thereof by Landlord, Landlord may cancel the lease by giving Tenant a written three-day notice stating the date on which the Term will end. On that date, the Term and Tenant's rights in the Lease shall automatically terminate and Tenant must vacate the Premises and remove all of Tenant's personal property and return to Landlord by such date. Thereafter, Tenant will be responsible for rent, expenses, damages and losses due as of the date of termination,which shall be deemed additional rent. (b)LANDLORD'S DEFAULTS: Except as otherwise provided herein, Tenant shall give Landlord five days written notice to correct any default of Landlord's express obligations to Tenant. In the event of Landlord's failure to perform any term in the lease, Tenant shall be entitled to a pro rata return of any rental payments made hereunder commencing from the date of default. 11. INSPECTION OF PREMISES: Tenant has been advised to inspect the Premises before entering into this Lease. Tenant has either: (i) inspected the Premises, its fixtures, appliances and equipment and the personal property, if any, included in the lease, knows the condition thereof, and agrees to accept the same "'as is", i.e. in the condition they are in on the date hereof and Tenant does not rely on any representations,other than those contained herein,made by any Broker or by the Landlord or anyone acting or purporting to act on behalf of the Landlord as to any matters which might influence or affect the decision to execute this Lease; or, (ii) elected to sign this Lease without performing the aforesaid inspections,knowing that it has read this provision and has been advised to inspect the Premises. Landlord hereby warrants that, to Landlord's knowledge, all fixtures, appliances and equipment and personal property have been properly maintained and are in good working order for the purposes for which they are intended. 12. I can't be certain because I have not seen the floor plans and elevations for the Bruce Kim application. It might be possible that a change in the entry design that is enlarging the pre-existing non-conforming structure might be able to be eliminated. Or the applicant has the option of getting the NOD in advance and therefore applying during the hearing for the expansion but in general the Board has not wanted to permit this (remember Pisani?) I explained that the ZBA Board will ask for a lease before making a decision on your application for an accessory apartment in an existing accessory structure. Mr. Kim stated that he will not be renting the apartment. I asked why did he apply for an accessory apartment. He stated that it was going to be for "overflow when company comes to visit". I explained that the code does not allow for this. Kim (ZBA) then spoke to him and he stated that the apartment will be used six (6) months out of the year for his sister. Kim (ZBA) explained the code again, and stated that the ZBA Board would make their determination based on the information provided in his application. Mr. Kim will provide a lease; however, we do not know the extent of the rental at this point. This Special Exception Permit requires an annual renewal by a Code Enforcement Officer. It is the applicant's responsibility to apply to the Building Department each year to renew the accessory apartment permit. Failure to do so may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein. 2. This Special Exception permit cannot be transferred to new owners. 3.
