AND the premises described herein shall not be independently improved by the
erection of any habitable structure, and can be merged with grantee's adjoining parcel if
applicable so as to form one single lot. There can be no further subdivision of the merged
parcel unless it is consistent with local town and/or village zoning codes and standards of the
Suffolk County Department of Health Services, applicable at the time application is made.
This restrictive covenant shall be enforceable by the County of Suffolk by injunctive relief
or by any other remedy, in equity, or at law. The failure of the County of Suffolk or any
agency thereof to enforce this covenant, shall not be deemed to impose any liability
whatsoever upon the County of Suffolk or any officer, employee or agent thereof. This
covenant and restriction shall run with the land and shall be binding upon the grantee, its
successor and assigns,and upon all persons claiming undembem;and
FURTHER, notwithstanding the above description, it is the intention of this
conveyance to give title only to such property as was acquired by the County of Suffolk by
Tax Deed on February 7, 1983, from Jean H. Tuthill, the County Comptroller of Suffolk
County, New York, and recorded on February 8, 1983, in Liber 9111, at Page 572. SCTM
#1000-059.00-09.00-006.000 also known as 950 Private Road#26,Southold,NY 11971.
TOGETHER with all right,title and interest, if any,of the party of the first part of,
in and to any streets and roads abutting the above-described premises to the center lines
thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the
first part in and to said premises;
TO HAVE AND TO HOLD the premises herein granted unto the party of the
second part,the heirs or successors and assigns of the party of the second part forever.
