No. 5376 - MICHAEL AND CATHY LEHRHOFF Property Location: 230 Wunneweta Road, Cutchogue; CTM #104-11 12.;1. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 26,185 sq. ft. parcel has a frontage of 238 feet along Wunneweta Road, 103.82 feet deep along the north side line, and 123.36 feet deep along the south side line. The property is improved with a two-level, single-family dwelling with decks and garage (under). BASIS OF APPLICATION: Building Department's March 4, 2003 Notice of Disapproval, amended May 20, 2003, citing Sections 100-242A and 100-244B, in its denial of applicant's request for an amendment to Building Permit #28945-Z, for additions, portions that do not meet the required 40 ft. front setback and required 50 ft. rear setback. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on August 21, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant is requesting area variances for"as built" reconstruction of decks that were removed, as shown on the site plan prepared June 13, 1978, revised August 27, 2003, and noted as follows: (a) 4' x 16' 6" rear deck and deck with variable dimensions of 9'1" x 3'9.5" and 54" x 2'6 - leaving a rear yard setback from the westerly lot line at 28 feet at its closest point, (b) 142" x 11' open deck at the side of the dwelling leaving a rear yard setback of approximately 36 feet. Also noted on the August 27, 2003 site plan is a front porch area including 5' 15/16" x 10' 3" step area, approximately 37 feet from the front lot line, and an open garden trellis 35'10" from the front lot line. ADDITIONAL INFORMATION: During the August 21, 2003 public hearing, the applicant was requested to submit a site plan to show all as built construction areas, proposed construction, and construction which was approved by prior variance. On August 29, Page 2—September 25, 2003 Appl. No. 5376— Michael Lehrhoff 10411-12.11 at Cutchogue 2003, a revised site plan was submitted to show applicant's request regarding new areas for board consideration, as well as the proposed garage addition on the north side, which received variance approval on 6/20/2002 under Appeal No. 5123 with respect to front and rear yard reductions. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The shape of the lot is 238 ft. long and narrow, with a depth of 103.82 feet at the north end. The applicant indicated that the hearing that two decks were weakened due to decay and an electric fire, recently in need of reconstruction for safety reasons. He stated that the decks existed for 28+ years, and when rebuilt, the applicant also extended a small piece of the deck and enclosed it to provide easy access into the shower area. A majority of the lots in the vicinity of applicant's property are vacant, and the applicant's property is on a partially improved road. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The shape of this 26,185 sq. ft. lot and layout of the existing construction areas create no alternative to build without a variance. 3. The relief requested is substantial, resulting in approximately 556 sq. ft. of new construction. The code requires a minimum rear yard of 50 feet and minimum front yard of 40 feet. The applicant is proposing a 28 ft. setback at its closest point, and variables greater than 28 feet, from the rear lot line, and approximately 37 feet, at its closest point, from the front lot line. The reduction is substantial from the code requirement, being a reduction of 22 feet from the rear setback, and reduction of 3 feet from the front lot line. 4. Although the applicant's home existed for many years in its present location, the difficulty was self-created when the applicant planned and designed decks and additions that did not conform to the current Town Code requirements. 5. There is no evidence that the grant of the relief will have an adverse effect or impact on physical or environmental conditions in the neighborhood or district. During the hearing, no opposition or concerns were submitted by adjacent or nearby landowners. The deck was a reconstruction of two attached decks that existed for many years on the southeasterly portion of the applicant's home, and was constructed generally in the same footprint. Grant of the relief requested is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additions, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Horning, and duly carried, to GRANT the variance as applied for, and shown on the Fairweather-Brown site plan dated June 13, 1978, revised August 27, 2003, SUBJECT TO THE FOLLOWING CONDITION: That the deck additions not be enclosed. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. BASIS OF APPLICATION: Building Department's May 13, 2002 Notice of Disapproval for the reason that applicants' proposed additions, for the reason that the front and rear setbacks will not conform to the code requirements for a 40 ft. front yard setback and 50 ft. rear yard setback. AREA VARIANCE REQUESTED: Applicants are requesting Variances under Sections 100-242A and 100-244B for a front yard setback for additions to the existing dwelling as shown on the March 15, 2002 Site Plan prepared by Fairweather-Brown Design Associates. The new 11' x 7' front porch is shown at 39'8" feet from the front line. The side addition is proposed with a 32 ft. rear setback. The rear addition is proposed at 28 feet from the rear line. (Please see maps disapproved by the Building Department of record.) FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on June 20, 2002, at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property and the area, and other evidence, the Zoning Board finds the following facts to be true and relevant. PROPERTY DESCRIPTION: The applicant's property is located on the west side of Wunneweta Road, Nassau Point Club Properties, in Cutchogue. The property is improved with a one-story frame house, shown on the Fairweather-Brown Design Architects site map, at 45 feet from the front lot line, 32 feet from the rear line, and 70'1" to the northerly side line. REASONS FOR BOARD ACTION: In accordance with the review standards set forth in Town Law 267b-3 "area variances," the Board has considered the benefit to the applicant if the variance is granted, as weighed against the detriment to the health, safety and welfare of the neighborhood and community by such grant, and determines that: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. The shape of the lot is 238 ft. long and narrow, with a depth of 103.82 feet at the north end of the lot. To technically satisfy the letter of the law would create a narrower dwelling, which would be impractical and would have no effect on the overall appearance. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The shape of the lot and layout of the existing dwellings limit the available area to expand livable area for the owners. 3. The variance granted herein is not substantial. The new area which extends closer into the rear yard is small, with a size of 4 ft. x 21.5 ft. The applicants are utilizing the setbacks as established for Page 2-June 20,2002 ZBA Appl.No. 5123-Michael Uhrhoff Parcel 104,-11-12.1 at Cutchogue the existing dwelling without further reducing the front or rear set backs for additional living area. The side yards and height restrictions remain conforming. 4. The variance granted will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. No evidence has been submitted to suggest that this minor variance will have an adverse impact on physical or environmental conditions in the neighborhood. 5. Grant of the requested variance is the minimum action necessary and adequate to enable applicant to enjoy the benefit of additions/alterations to the existing dwelling, while preserving and protecting the character of the neighborhood and the health, safety, and welfare of the community.
