RECOMMENDATION OF LETTER OF NON-JURIsDICTIoN NJ10 Moved by Bruce Loucka, seconded by Jack Hagerty, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the request for a Letter of Non-Jurisdiction by PETER HAEFFNER 70-10-26 to construct a one family dwelling, sanitary system, well, bluestone driveway and underground utilities. Work is in excess of 75~ of nearest wetland. The CAC recommends disapproval because the project should go through the permit process; the building activity will be within 75! of the wetlands. We have revised ours plans somewhat from what was originally approved by you. The amount dredged, location of the bulkhead, etc. all remains the same. Raynor, Jr. 320 Love Lane Mattituck, NY 11952 RE: NYSDEC Permit Application #1-4738-00611/00001-0 Strong'S Marine Dear Mr. Raynor: The Department has reviewed the above referenced permit application. A field inspection has shown that the applicant will be dredging high marsh, shoals and mudflats and intertidal marsh. This activity is a presumptively incompatible use of the tidal wetlands. This area is an extremely productive shoal and mudflat which is home to fiddler crabs, juvenile menhaden and killies along the shoal and clumps of intertidal marsh and a small band of spartina patens~and phragmites (high marsh). Dredging this habitat is not compatible with the preservation and protection of Tidal Wetlands [6NYCRR Part 661.(b) (1) (i)] as it will greatly reduce habitat for the above mentioned species and negatively impact marine food production. The juvenile finfish are using this area for protection and feeding grounds. The proposal to dredge is not reasonable or necessary as it must be pursuant to 6NYCRR Part 661.9(b) (1)(iii). The applicant has stated that there is no intent to enlarge the facility, therefore, dredging is not necessary. The applicant has stated that the project is necessary in order to install adequate walkways, however, existing walkways appear adequate. Placement of a bulkhead and filling in a tidal marsh is a presumptively incompatible use of the wetlands as per 6NYCRR Part 661(b) (1) (v), and therefore does not meet the standards for permit issuance. It appears that when the road was paved some sort of drain was installed by the previous owner causing slu~ping, and a cedar tree is toppling over causing bank failure. The applicant is advised to cut the tree down and fix the drain problem. A bulkhead in this location will eventually cause scour to the intertidal marsh to the west (partially by boat wakes). e It appears that the facility has adequate docking depths at present, therefore unless expansion is planned for the future, there is no need to relocate docks or dredge. The Department does not object to removal of the pavement. Making the parking or roadway pervious will alleviate runoff problems. Three copies of plan views and cross-sections will be required. The Department would not object to modification of the application to show revegetation of the slope and area seaward of it with tidal wetland plantings. Planting of intertidal marsh seaward of the slope will greatly reduce slumping and loss of fill. Prior dredging in this area in 1987 is not likely as the original permit prohibited dredging within 12 feet of the tidal marsh vegetation on the south shore. If the applicant is willing to revise the proposal, three copies of plans revised as discussed above must be submitted. Should the applicant wish to proceed with the project as proposed the application must be determined to be complete, a Notice of Complete application must be published in a local newspaper and a public comment period must follow. The application will remain incomplete pending either receipt of a Negative Declaration of Significance or notice that a Final Environmental Impact Statement has been accepted by the Town of Southold, the Lead Agency for the State Environmental Quality Review. By copy of this letter I am notifying the Town of the Department's concerns. The Department will then refer the matter to the NYSDEC office of Hearings for an adjudicatory hearing and will recommend denial of the application. Hearing costs and the burden of showing that the proposal meets the standards for permit issuance are on the applicant. I have enclosed a copy of the Tidal Wetlands Land Use Regulations for your use. Please notify this Department by October !, !993, as to how the applicant wishes to proceed. STATE ENVIRONMENTAL QUALITY REVIEW ACT (SEQRA) Under policies the Trustees have adopted this project is a t!rpe I action, or one which is more likely to have a significant impact on the environment. To issue a permit for activities on an emergency basis which include new structures and dredging and have not concluded the SEQRAprocess would be an open invitation for a claim that we have not properly conducted an environmental review of this project under our agency's rules° 2. STANDARDS FOR EMERGENCY PERMITS Although no written standard exists for the issuance of emergency permits under the wetland ordinance, the Trustees have typically only granted relief for pre-existing permitted structures and for those dredge activities for which there is a history of operations which the Board is familiar with or which are covered by an existing permit from the NYSDEC or Army Corps of Engineers. ~ As can be seen the Trustees are not in a good position to grant emergency relief in this case. The photographic evidence of erosion you presented the Board would clearly indicated care in the planning of pervious .structures landward of the bulkhead is in order.
