2 SUPERVISOR SCOTT RUSSELL : I ' m
3 going to ask anybody that would like to
4 comment on any of the specific agenda
5 items to please feel free . Al ?
6 AL KRUPSKI : Hello, Al Krupski ,
7 Cutchogue . So Resolution ' s 1069 and
8 1070 relate to a proposed development in
9 Peconic on Carrol Avenue . And I
10 listened to the conversation this
11 morning at the Work Session about
12 accepting an RFP for the -- that ' s not
13 me, by the way . Accepting an RFP for
14 the -- from a developer for a proposal .
15 And there was a lot of discussion about,
16 well , if he ' s going to do this , he ' s
17 going to have to do that, and if he ' s
18 going to do that , then he ' s going to
19 have to do this . And then, especially
20 since it involves a sale of land that
21 the Town owns to a developer, I hope
22 that all the details of what was said at
23 the Work Session are somehow
24 memorialized in some legal document .
25 Because the devil is always in the

1 details on these things . These projects
2 also tend to go on for a long time . And
3 then people kind of forget what was
4 originally said on December 19, 2023 .
5 And I think it ' s important that all
6 those things be very clear to the
7 community and to the developer to be
8 fair with both of them .
9 COUNCILWOMAN JILL DOHERTY : Thank
10 you, Al .
11 SUPERVISOR SCOTT RUSSELL : I should
12 have acknowledged . I have so many
13 acknowledgments . I forgot, Albert had
14 served as my Deputy for about seven
15 years when we served in the Town Board
16 together . Albert, it was , it was an
17 honor serving for you . And you becoming
18 my successor, that ' s a real honor
19 because I think you ' re going to be the
20 best supervisor Southold Town has had in
21 probably a hundred years .
22 JUSTICE LOUISA EVANS : They ' re
23 putting the pressure on .
24 AL KRUPSKI : For the record, I ' ve
25 got big shoes to fill .

1 SUPERVISOR SCOTT RUSSELL : Would
2 anybody else like to address any of the
3 agenda items ?
4 ANNE MURRAY : Anne Murray from East
5 Marion . This housing proposal , we all
6 know the Town really needs affordable
7 housing . So I think it ' s great that
8 Rona and her partner have come forward .
9 However, my own personal opinion is that
10 in the future , the Town should keep the
11 land at least to developers . Because
12 the land, we ' ve seen how prices have
13 skyrocketed the past couple of years .
14 You ' re going to be enriching a developer
15 at some point . You know, where the --
16 if the Town could find a way to hold
17 onto it and maybe have a housing
18 something or other -- I think it would
19 be in the best interest of the Town .
20 Because we ' ve all seen, you know, in the
21 80 ' s and the 70 ' s , there were these
22 affordable housing projects , people got
23 homes . They churned over . The
24 affordability went away, and look what
25 happened to the Town . So please keep

1 that in mind for future projects , but
2 I ' m glad to see something is moving
3 forward on Carrol Avenue . And secondly,
4 two things , I wanna thank Sarah Nappa
5 because she was always available to
6 anybody who wanted to speak with her on
7 anything . And the same thing goes for
8 Scott Russell . When I was President of
9 EMCA, he always came when we requested .
10 He always took our phone calls . He
11 always answered his e-mails . He was
12 available all the time . So thank you,
13 Scott, and thank you, Sarah .
14 COUNCILMAN BRIAN MEALY : Thanks ,
15 Anne .
16 COUNCILMAN GREG DOROSKI : I think
17 just real quick to speak to the issue of
18 ownership . I think that ' s more
19 applicable in a rental/tenant situation .
20 This program that that we had issued the
21 RFP on back in April , that Georgica
22 Green Ventures responded to, is for
23 ownership . And as we discussed this
24 morning, as Legislator Krupski
25 mentioned, one of those details is

1 affordability in perpetuity . And I
2 think Legislator Krupski ' s comments are
3 well taken, but it ' s important to
4 remember that a majority of the Board
5 will be in public service still as this
6 project is making its way through Zoning
7 and Planning, and it ' ll be our
8 responsibility, including Legislator
9 Krupski to make sure that those things
10 that we said would get done, would get
11 done . So the public has faith both in
12 this project, and our ability to deliver
13 on future projects . So thank you .
14 COUNCILWOMAN JILL DOHERTY : And I
15 want to say that in the house --
16 developing the housing plan and also the
17 Housing Commission, one thing that
18 always comes up is our mistakes from the
19 past , which everything is going to be in
20 perpetuity . Because when you make
21 something a workforce housing,
22 affordable housing, if it doesn ' t last
23 forever, what good is it? Because it
24 might help somebody today, but we also
25 have to think about helping people

1 tomorrow . So that ' s something that ' s
2 always forefront in -- when we ' re, you
3 know, reviewing these projects .
4 SUPERVISOR SCOTT RUSSELL : Would
5 anybody else like to address the Town
6 Board?
7 RACHEL FLATLEY : Hello . Most of
8 you might remember me, Rachel Flatley,
9 Carrol Avenue . This is Ronan . I
10 apologize for the noise that he ' s
11 making . I just want to, again, thank
12 you . I know I ' ve spoken here many times
13 about the rezoning of Carrol Avenue .
14 And I know it was voted on here not by a
15 supermajority . And with every resident
16 on Carrol Avenue against it . So I just
17 want to make it, again, very clear that
18 we have not forgotten about this .
19 Because it does affect and will affect
20 our day-to-day lives . One thing that I
21 would like to ask, you know, as this
22 moves forward, because it ' s obviously
23 moving forward, is that, you know, it
24 just be very clear to the public what ' s
25 happening, you know . I think some of

1 these other projects that have been shut
2 down, which, you know, when you guys
3 voted on the change of zone, you made it
4 clear that it was approved because it
5 has not been approved any place else .
6 So we essentially, as residents of the
7 area, drew the short straw . And we have
8 this in our backyard now . That , you
9 know, you take into consideration the
10 people who live there, the people who
11 have invested their life savings in
12 their homes . We have mentioned before
13 that I think there ' s 16 or 17 people who
14 live on the block . And adding in
15 anything from 20 plus houses is going to
16 change the character of the neighborhood
17 and directly affect the people who live
18 there . I think as much as I want the
19 property to stay as park land, because
20 that was what it was originally
21 purchased for, I understand that I
22 essentially have been shut down from
23 that . Still pending litigation . But , I
24 think as residents , that we should have
25 a say in how this moves forward . You

1 know, and if the homeownership is one
2 thing that as owners that we would like
3 to see if it does move forward, but it
4 needs to be clear that it will not
5 change from that . That it will not turn
6 into a rental of any sort . Whether it
7 happens last minute or down the road or
8 whether that ' s actually the plan . Kind
9 of as a bait and switch, which is what
10 this whole project essentially was from
11 the beginning . Went from a pool to now
12 affordable housing without anyone ' s --
13 I ' m sure, again, unless you survey
14 people, they still don ' t know that this
15 is happening . So I just want to make it
16 clear to everyone that as residents , we
17 have not forgotten about this . We will
18 be here every session to continue to
19 fight for our rights as people who live
20 on the block, and have invested and are
21 raising their families there . Thank
22 you .
23 COUNCILMAN GREG DOROSKI : Just to
24 speak to the issue of ownership, I think
25 it ' s important and you ' ll see this in
DECEMBER 19, 2023 REGULAR MEETING 10
1 the resolution itself . What we are
2 approving is for ownership . This was
3 one of the details that was discussed
4 this morning that Legislator Krupski
5 raised that are going to be really
6 important here . Our RFP that was issued
7 was for ownership . And the resolution
8 that we ' re approving is for ownership .
9 And I will make a personal commitment to
10 you, that this project , if it ' s going to
11 happen, is going to be ownership .
12 RACHEL FLATLEY : Thank you, sir .
13 COUNCILMAN GREG DOROSKI : No , it ' s
14 all good .
15 RACHEL FLATLEY : Were there any
16 other proposals or was this the only
17 proposal?
18 COUNCILMAN GREG DOROSKI : This was
19 the only proposal we received .
20 COUNCILWOMAN JILL DOHERTY : And we
21 put the RFP out for 60 days . And when
22 we put it out , we put it out to all the
23 papers . And make sure all the people
24 that do this kind of construction know
25 that it ' s out there . And this is the

1 only one that came back .
2 GORDON MURPHY : So it ' s closed
3 currently . So this is -- you have
4 accepted this bid?
5 COUNCILWOMAN JILL DOHERTY : Yes .
6 COUNCILMAN GREG DOROSKI : That ' s
7 what the resolution is for tonight .
8 SUPERVISOR SCOTT RUSSELL : It ' s not
9 a bid . It ' s just accepting the proposal
10 as submitted . I will say that the
11 proposal uses the word tenant many, many
12 times . And if it ' s the intent of this
13 Board to make sure it ' s ownership, ask
14 the applicant to redraft it, to just use
15 the word owners , ownership .
16 COUNCILWOMAN JILL DOHERTY : The
17 proposal gave ownership or rentals and
18 we discussed today, and majority said we
19 want ownership . So that ' s what we
20 intend to -- there ' s going to be papers
21 drawn up by our attorney . That will be
22 an agreement . And that will detail more
23 than the resolution . But the resolution
24 has to happen first before those details
25 can be ironed out .

1 RACHEL FLATLEY : The public has no
2 say on accepting this ?
3 COUNCILWOMAN JILL DOHERTY : No, no .
4 That ' s not how it normally happens .
5 RACHEL FLATLEY : How many units ?
6 COUNCILWOMAN JILL DOHERTY : We
7 don ' t know at this point . Because there
8 has to go through certain approvals and
9 has to go through Zoning and Planning .
10 COUNCILMAN GREG DOROSKI : As it
11 stands though, right now it is 32 units
12 as we discussed originally with this
13 project . And it would be my preference
14 to have 32 for sale units there , on this
15 site . But it ' s gonna make its way
16 through ZBA and through Planning . And
17 we ' ll see . But it is the sale of the
18 property will be contingent on these
19 approvals and contingent on it being an
20 ownership site for this .
21 RACHEL FLATLEY : So I don ' t know if
22 I can wrap my head right -- how you ' re
23 going to fit 32 units on that parcel of
24 land, but, again as -- speaking for the
25 residents of Carrol Avenue, if you can

1 just keep in mind the number of units or
2 houses that are currently on that block .
3 And 32 is double that . So you ' re -- you
4 know, really adding to our resources or
5 taking away from our resources and that
6 is a significant number . When there ' s
7 16 houses on the block . And Peconic is
8 super small you know . Whether they ' re
9 high end houses or low income houses .
10 To me, that doesn ' t matter . I mean, 32
11 is a significant number . And you ' re
12 just changing the entire landscape of
13 our neighborhood like that .
14 SUPERVISOR SCOTT RUSSELL : The
15 current code only allows 21 houses if
16 they ' re going to be built for ownership .
17 Only 21 . Not 32 . 32 would require
18 approval by the Zoning Board of Appeals ,
19 which cannot be presumed . If the Town
20 Board again is sincere in its effort to
21 make sure that it ' s owner occupied and
22 ownership units , then we should ask the
23 applicant to redraft the proposal and
24 adopt it based on the 21 .
25 COUNCILWOMAN JILL DOHERTY : The 21

1 is under rentals , and if it ' s done by a
2 regular subdivision, you can get a lot
3 more units in than 32 .
4 COUNCILMAN BRIAN MEALY : Yeah, I
5 wanted to make that point .
6 SUPERVISOR SCOTT RUSSELL : Under
7 the current code , you ' re only required
8 to have 10 , 000 square feet per unit . By
9 planning staff calculations , the yield
10 would only be 21 units or less for home
11 ownership . Not for rentals .
12 COUNCILWOMAN JILL DOHERTY : Thank
13 you for coming in when you didn ' t have a
14 babysitter . We understand . Thank you .
15 SUPERVISOR SCOTT RUSSELL : Anybody
16 else like to address any of the agenda

22 CHAPTER 215 SEWERS & SEWAGE
23 DISPOSAL FEES
24 COUNCILMAN GREG DOROSKI : So
25 tonight ' s first Public Hearing . And I ' m

1 reading a summary here that Missy
2 provided me on my phone . Thank you . Is
3 to consider certain changes to Chapter
4 215, Sewers and Sewage Disposal of the
5 Town Code . The proposed amendments to
6 be considered by the Board is to update
7 fees charged in Chapter 215 . The full
8 text of the proposed law can be found on
9 the Town ' s website, and posted on the
10 Clerk ' s bulletin board . In the folder
11 here , I have a copy of the resolution
12 setting this Public Hearing . An
13 affidavit of the posting the notice on
14 the bulletin board in the back . Copy of
15 the legal notice , and affidavit of the
16 publication and a copy of the ad in the
17 Suffolk Times . And also in The Day .
18 That ' s what I got .
19 SUPERVISOR SCOTT RUSSELL : Anybody
20 like to address the Town Board on this
21 particular Local Law?
22 JUSTICE LOUISA EVANS : Can you
23 let -- if people can hear us on Zoom, if
24 you want to speak, you should raise your
25 hand .

1 GORDON MURPHY : Hi . My name is
2 Gordon Murphy .
3 SUPERVISOR SCOTT RUSSELL : Yes , hi ,
4 Gordon .
5 GORDON MURPHY : Sorry . It ' s
6 difficult to hear you folks on the on
7 the Zoom call . Not that I ' m questioning
8 the raise in the fees , it ' s just that it
9 seemed to be rather accelerated, and no
10 notice was given to the constituents out
11 here on Fishers . We know that we ' ve
12 been needing it . Michael Collins has
13 been verbally telling us that we need to
14 raise the fees for many years , but it
15 was never put into place . And now it
16 seems to be quite a bit of a rush . The
17 Town used to provide quarterly and
18 annual reports on the Sewer District .
19 Those have faded away . We have no idea
20 what the status of the bond is that was
21 used . We ' re not sure when . There ' s a
22 lot of questions with the Sewer
23 District, and that I think we all should
24 you know have to have a level of
25 transparency that we ' re not seeing out

1 here at the Sewer District . We know it
2 needs help . We ' re all for that , but I
3 think we just need more reporting .
4 Thank you .
5 SUPERVISOR SCOTT RUSSELL : I would
6 suggest that if you ' re unhappy or if you
7 think that the current actions of the
8 current Sewer District Manager lack
9 transparency, the simple answer would be
10 to ask them to step down from the
11 position . He ' d be more than willing to .
12 JUSTICE LOUISA EVANS : Maybe ,
13 Scott, you can go through what Michael
14 Collins gave you, is why the fees are
15 going up? Because that would help . And
16 also what the last bond was for back in
17 2000 -- I can ' t remember the last bond,
18 what the date was .
19 SUPERVISOR SCOTT RUSSELL : Last
20 bond was 2007 , 2008 . That was for pump
21 station upgrades and for a new generator
22 and some other various repairs . The
23 fees themselves have not been increased
24 since 2007 . Prior to that was 1994 .
25 The septic tanks are about to be pumped

1 out at about $30 , 000-$ 40 , 000 at a
2 minimum . The fees -- the only option
3 would be -- actually, they ' re only
4 maintenance . Even if we had the option
5 of bonding out, most of the budget would
6 be paying debt service .
7 COUNCILWOMAN SARAH NAPPA: To be
8 fair, I don ' t think that the person is
9 questioning the raising of the fees , but
10 it ' s the procedure of which this was
11 rolled out . And I would just say that I
12 understand exactly what they ' re saying .
13 And I would apologize for the lack of
14 transparency that they received their
15 bills before this Public Hearing was
16 being held . And that was a misstep and
17 a miscommunication on our part .
18 COUNCILWOMAN JILL DOHERTY : I would
19 agree with Sarah and I think we should
20 look forward to, you know, solidifying
21 our procedure to make sure there ' s
22 better communication in our process .
23 SUPERVISOR SCOTT RUSSELL : I would
24 concede that . Yes , I jump the gun on
25 the reasons , and what we ' ll do is make

1 sure you get the reasons . But I will
2 say that Councilwoman Nappa is 1000
3 correct . And that ' s probably where I
4 should have limited my comment . She ' s
5 right . The process was what -- it was
6 not rolled out well . It was adopted as
7 part of the budget this past year by the
8 entire Town Board; however, you should
9 have received the advance notice . We ' ll
10 accept that . I agree with Councilwoman
11 Nappa 1000 .
12 JUSTICE LOUISA EVANS : And I also
13 agree that we should start back having
14 quarterly reports . I ' m not sure when
15 that fell off, but I remember we were
16 getting them. And I think that ' s a
17 valuable tool for us all to have .
18 MS . MISSY : I have another one .
19 Jane Ahrens . Jane, you have permission
20 to speak .
21 JUSTICE LOUISA EVANS : Jane, you
22 need to un-mute .
23 JANE AHREN : My name is Jane
24 Ahrens . I agree with everything that
25 everyone said regarding the bill . We

1 understand that it had to come, but it
2 came before -- the process was wrong as
3 Gordon mentioned . But at this point, I
4 think many of us who are -- live in the
5 Sewer District on Fishers Island would
6 like to know -- this rate went up 1000 .
7 Is there a possibility that they can
8 extend the payments due over quarterly
9 period during the year 2024 or are we
10 just stuck paying half of it in January
11 and half later?
12 SUPERVISOR SCOTT RUSSELL : Yeah, I
13 -- Billy asked me that a couple of weeks
14 ago . I do not believe that that ' s
15 possible because the budget is so lean
16 and so tight, that the Sewer District
17 Manager needs the money to get the work
18 done now . Particularly the pump out of
19 --
20 JANE AHREN : Okay . Then we should
21 have gotten notification that part of
22 our personal budget was going to go up
23 1000 in 2024 . We had no notice . I ' m
24 just asking for a little bit of help .
25 SUPERVISOR SCOTT RUSSELL :

1 Understood .
2 JANE AHREN : On behalf of all the
3 seventy something of us .
4 COUNCILMAN GREG DOROSKI : And was
5 the -- I thought the issue was phasing
6 it in that we said no on? There was
7 something -- was it ever discussed
8 breaking it into potentially quarterly
9 payments? I think it could warrant
10 further clarity on that point . If I
11 understand the question correctly . It ' s
12 not waiving them for a certain amount of
13 time . It ' s actually just breaking it
14 into four installments .
15 COUNCILWOMAN SARAH NAPPA: Maybe we
16 should check on that . Since we ' re going
17 to leave this Public Hearing open, we
18 could check and see if that can be done .
19 COUNCILWOMAN JILL DOHERTY : We ' ll
20 look into it and get an answer for you,
21 Jane .
22 JUSTICE LOUISA EVANS : And I think
23 the Town Board, when we set the Public
24 Hearing, agreed that if we couldn ' t do
25 that , we could at least have a grace

1 period for paying the first payment .
2 But hopefully we can do quarterly
3 payment .
4 COUNCILWOMAN SARAH NAPPA: 30 day
5 grace period .
6 SUPERVISOR SCOTT RUSSELL : Is that
7 paid as part of the tax bill ? Or is
8 that paid separately?
9 JANE AHREN : I might add that we
10 can ' t hear anything .
11 SUPERVISOR SCOTT RUSSELL : I ' m
12 sorry, we ' re just actually just raising
13 some questions so that we can gather
14 them and then certainly try to get you
15 the answers as quickly as we can .
16 COUNCILWOMAN JILL DOHERTY : So in
17 other words , Jane, we ' re gonna look into
18 it and see what we can do for the folks
19 on Fishers Island as far as when they
20 pay .
21 JANE AHREN : I ' m sorry, we can ' t
22 hear on Zoom to answer your questions .
23 COUNCILWOMAN JILL DOHERTY : We ' ll
24 have Louisa text you . We ' re going to

13 let me just assure you, we ' ll get the
14 answers to the questions you ' ve raised .
15 So we ' ll make sure that you get all the
16 information as to why the raise needed
17 to go up .

19 need to make a motion to leave it open?

22 So I ' ll make a motion to --
23 PAUL DECHANCE : May I suggest again
24 maybe that the Board consider closing
25 its subject to written comments within a

1 time period? And then ultimately the
2 Board can make a motion to allow for
3 payments in whatever manner the Board
4 decides . It will just be then a closed
5 Public Hearing subject to comment, so
6 we ' re not carrying it over into the new
7 year .
8 COUNCILWOMAN SARAH NAPPA: Okay .
9 So I make a motion to close the hearing
10 subjects to written comments for 30
11 days .
12 COUNCILWOMAN JILL DOHERTY : Second .
13 JUSTICE LOUISA EVANS : Can I also
14 though? The bill people got was due
15 January lst . So I think if nothing
16 else , we should extend the first payment
17 date .
18 COUNCILWOMAN SARAH NAPPA: Well , we
19 did that already . We ' ve already done
20 the 30-day grace period .
21 SUPERVISOR SCOTT RUSSELL : We did a
22 30-day grace period .
23 COUNCILWOMAN SARAH NAPPA: So
24 actually on that motion, I would make it
25 that we close the Public Hearing, except
DECEMBER 19, 2023 REGULAR MEETING 25
1 for written comment for 30 days .
2 Reiterating the 30-day grace period .
3 And then also , to be decided by the Town
4 Board, how the payments can be done at a
5 later date .
6 COUNCILWOMAN JILL DOHERTY : And
7 then effectively communicated to us .
8 JUSTICE LOUISA EVANS : We ' re only
9 leaving the hearing open for two weeks ,
10 right?
11 COUNCILWOMAN JILL DOHERTY : The
12 hearing is closed subject to written
13 comments for 30 days .

15 think that ' s a good idea .

5 second public hearing, and again I ' m
6 going to read a summary on my phone . So
7 apologies . Is to consider certain
8 changes to Chapter 148 , Flood Damage
9 Prevention of the Town Code . The
10 proposed amendment to be considered by
11 the Board adopts the revised letter of
12 map revision LOMR, prepared by New York
13 State DEC, is required to maintain
14 national flood insurance program
15 participation, including the replacement
16 of existing floodplain management
17 regulations and incorporating updated
18 New York State program changes ,
19 including revised definitions , rules ,
20 and regulations . The full text of the
21 proposed law can be found on the Town ' s
22 website and posted on the Clerk ' s
23 bulletin board . In the folder here, I
24 have a copy of the resolution setting
25 this Public Hearing, an affidavit that

3 would like to address the Town Board on
4 any issue, to please feel free .
5 PETER HARRIS : Good evening,
6 members of the Town Board . Peter
7 Harris , 212 Knapp Place, Greenport .
8 This is a -- I knew this was going to
9 happen, Scott . You ' re going to make us
10 cry . Former 12-year highway
11 superintendent during Scott ' s period of
12 supervisor . I cannot stress what a
13 great working relationship we have . The
14 door was open . I peeked in . I said,
15 "Got a minute? " The door was always
16 open, come in . And many, many times , you
17 know, when the political machines work
18 and just so happens , Scott was on Team
19 A . I was on Team B . But you know what,
20 there was no Team A, Team B, because we
21 had that kind of working relationship .
22 He took a lot of heat many times during
23 Board meetings . Something that the
24 Highway Department had done under my
25 leadership . He gave kudos to me and my

1 department . And he took a lot of heat
2 from his own party . "What the hell are
3 you doing? " I ' m saying good things
4 about this guy . Well , you know, after
5 the election ' s over, it ' s not A or B .
6 It ' s a team. It ' s always supposed to be
7 a team. And that ' s what Scott Russell
8 has been his entire time sitting up on
9 that dais . It ' s always been what ' s best
10 for Southold . Not for it , you know, not
11 for it -- A Team or B Team. And it
12 was -- he was the first person I told
13 when I made up my mind not to run . And
14 he was -- he was , " you got to stay . You
15 got to stay . " And I said, you know, if
16 it was , if it was only for you, I would
17 stay . But the picture ' s a lot bigger
18 than just you and I . And I had to do
19 what I thought was best for me
20 personally, professionally, family . So
21 Scott, you know, you will be missed .
22 And like Albert says , he has big shoes
23 to fill . He will be able to , because he
24 will represent this Town the same that
25 you have during your tenure as a Town

1 official . Now on a lighter note, I ' ve
2 got to tell one story of what happened
3 during the course of my 12 years as a
4 Highway Superintendent .
5 COUNCILWOMAN JILL DOHERTY : Only
6 one?
7 PETER HARRIS : This is the good
8 one . This is the good one . Okay . Goes
9 back to our late Pat Finnegan, Town
10 Attorney . And we had a situation in
11 Nassau Point where we had a contour of a
12 road goes this way, this way, and this
13 way . And on a heavy rainfall , all this
14 water would go down a dead-end road, and
15 it would wash it out into the Great
16 Peconic Bay, and it would make it
17 anywhere from a six to eight foot deep
18 ravine . And at the time, I said to my
19 deputy, I said, "What do you do? What
20 have you been doing? I mean, this can ' t
21 be the first time this ever happened . "
22 Yeah, we just truck fill in, fill it
23 back up . Smooth it out . I said, "Well ,
24 you know, it ' s got to be a better . " So,
25 came up and we devised a storm drainage

1 system to be installed . To catch the
2 water . Have it percolate back into the
3 ground, and not just a flush out into
4 the great Peconic Bay . We build the
5 system. System worked great . Just so
6 happens , New York State DEC, the
7 gentleman that was in charge , him with
8 Trustee Jim King was taking a ride out
9 to check something out on Nassau Point .
10 He says , "Hey, I want to show you this
11 drain system that the Highway Department
12 put in . " They go down there and right
13 away the guy goes , "Oh, this is no good .
14 This is no good . " He said, " it ends up
15 within 300 feet of the water . " So they
16 come back, and he files a $ 10 , 000 --
17 he ' s going to put a $ 10 , 000 fine against
18 the Town of Southold . So Pat Finnegan
19 contacts me, listen, we have to
20 Setauket . We got to go to the State
21 University at their offices , and we got
22 to have a hearing . And the whole time
23 we ' re writing this , it ' s now Pete, I
24 know you ' re a very strong -- you ' re a
25 very strong willed person, and you say

1 what you whatever you feel is what you
2 want to say . So I ' m just going to ask
3 you, please just sit there and just
4 listen . I said, Pat, I ' m going to
5 listen . I ' m going to do exactly what
6 you said . We arrive . We go into his
7 office, and the first thing this
8 gentleman does , he takes his service
9 revolver out and he sets it on the
10 table .
11 JUSTICE LOUISA EVANS : I know
12 exactly who this is . And I ' m looking at
13 this guy, and Pat ' s looking at me, and
14 she just taps me on the leg, and I ' m
15 good . So I ' m sitting there, and he
16 starts it . And I ' m looking on the wall
17 up behind him with all the different
18 certificates and this and that of his
19 knowledge of his job . And he says to
20 me, he says , "am I boring you? " I said,
21 " absolutely not . " He says , but "you ' re
22 not looking at me, you ' re looking up . "
23 I says , " I ' m just admiring all these
24 different certificates that you have on
25 the wall . " He says , " Pretty damn

1 impressive , ain ' t it? " I says , "Yep,
2 but you ' re missing one . " And Pat, she
3 just grabs my leg ' cause she knows what
4 I ' m gonna say . And he says , "What
5 certificate am I missing? " I said,
6 "Certificate of Common Sense ' cause you
7 don ' t have any . " I said, the system
8 that my department built and installed
9 and works , and you have the audacity
10 that you ' re going to find the Town
11 $ 10 , 000 because the bubble pipe ends up
12 within -- I said I got eight drains and
13 they ' re piped together and it keeps
14 going chambers so that the water
15 percolates . All the residue is stayed
16 inside . It ' s not going into the water
17 and you ' re telling me I don ' t know what
18 I ' m talking about . You ' re the guy that
19 is the Conservation Department, but yet
20 you ' re telling me I don ' t know what I ' m
21 doing . So he turns around and he says
22 to Pat, go back to your Town Board and
23 you better hire an engineering firm to
24 go do engineering study . To come up
25 with a better plan . Town goes and they

1 hire an engineering company . They come .
2 They do the plan . The plan comes back .
3 We couldn ' t design a better plan than
4 what the Highway Superintendent had
5 already done . So that was probably one
6 of my biggest highlights of being the
7 Highway Superintendent . The fact that a
8 Town Board stuck behind me . I gave my
9 Town Attorney a heart attack almost, but
10 the fact that , you know, intimidation by
11 other forms of government was trying
12 to -- that didn ' t happen . Again,
13 Supervisor, thank you so much for your
14 tenure as supervisor .
15 SUPERVISOR SCOTT RUSSELL : Thanks ,
16 Pete . Just so you know, Pete, we stood
17 behind you so much, we did the budget
18 mod to pay for the fine . Would anybody
19 else like to address the Town Board?
20 Yeah, of course .
21 THERESA MCCASKEY : Hi , Theresa
22 McCaskey, and of course with the
23 Southold Town Aircraft Test Committee .
24 So I just want to come up here and say
25 thank you to the entire Board, and the

1 legal team . And one of my members right
2 here in the committee is here . So on
3 behalf of our Aircraft Noise Committee,
4 thank you for supporting us for so many
5 years . Sarah, thanks for the e-mails .
6 The late evening meetings that you try
7 to do around your family and answered
8 our e-mails . And I look forward to
9 working with the Board . And Scott , you
10 know, I was very persistent . Our entire
11 committee was very persistent . Thank
12 you . And I know it ' s -- one point the
13 Town Board was like , why would they
14 listen to what we have to say? Because
15 we were right . And we ' re going to
16 continue fighting . It ' s not over, but I
17 think quality of life has gotten better .
18 So whoever I ' m going to work with, I ' m
19 going to miss you dearly, but whoever
20 we ' re going to be working with, I warn
21 you now, please use kind words . Because
22 Sarah and Scott, like, passionate . You
23 know, maybe persistent . You know, we ' re
24 committed to protect Southold Town just
25 as much as you all are . We live in a

1 very unique place, and I ' ve said that a
2 million times , and they ' re just going to
3 keep hearing me say that . So -- and
4 that ' s why we do what we do . So thank
5 you . And I also want to mention that I
6 don ' t think you guys got enough credit
7 for this . I ' m just following the note
8 about the AAA Bond ratings by Moody .
9 Congratulations on all your hard work
10 and doing that for Southold Town . I
11 don ' t think you guys got enough credit
12 for that so . And finally, Happy
13 Holidays to you all . And again, I look
14 forward to working with everybody in
15 2024 , and including our Legislator, Al
16 Krupski . I hope you will be able to

2 people and drive the committee . And now

3 525 Greenport . I want to thank Scott
4 Russell for everything he has done and
5 allowing me to serve on the -- before
6 seven years ago, I was on the anti-bots
7 task force . And I was the youngest
8 member . I want to thank you, Scott, for
9 allowing me to appreciate the serve on
10 that committee . And now I ' m on the PAC
11 Committee, and I want to thank Sarah
12 Nappa for the working group and all the
13 work and dedication work we did with
14 that work . And thank you, Scott Russell
15 for everything you ' ve done for the Town .
16 COUNCILWOMAN SARAH NAPPA: Thanks ,

20 NICK DEEGAN : Hi , Nick Deegan from
21 Mattituck . I just wanted clarification
22 on the -- wasn ' t around for the meeting,
23 the Work Session . So on the flooding
24 issue that you ' re looking into, or it
25 was part of the public hearing?

1 SUPERVISOR SCOTT RUSSELL : I think
2 that ' s part of the MS4 . That ' s just an
3 update of the MS4 .
4 COUNCILWOMAN JILL DOHERTY : I don ' t
5 think we had public hearing . So the New
6 York State -- We have a SPDES Permit,
7 which every town has to abide by from
8 New York State laws . And they changed
9 some of the laws on us . And just when
10 we were thinking that we were making
11 progress , they broadened our expansion
12 of area, of where we have to qualify .
13 And so it just made more work and harder
14 work for the town . So that ' s what was
15 said to us at the Work Session today .
16 Also that was said is both the
17 Superintendent of Highways and the
18 engineer are working very hard on
19 cutting off all our outflow pipes to our
20 creeks and bays . And they have done --
21 what did they say, 450 of outflow pipes
22 are closed . And they ' re going to
23 continue working on them. It ' s going to
24 take years . And if we get to 750 of our
25 outflow pipes closed, then we do not

1 have to be under the SPDES Permit . So
2 we ' re working towards getting out from
3 under their feet . It will take a few
4 more years , but we ' ve made some quite a
5 bit of progress , and they gave us more
6 work to do . So we have more work . So
7 that was the gist of today ' s Work
8 Session .
9 SUPERVISOR SCOTT RUSSELL : Just a
10 quick clarification, there ' s a program
11 called the MS4 program that has to do
12 with municipal drainage . And that ' s a
13 Federal and State program . The problem
14 is a lot of the work is administrative .
15 It requires a great deal of work . We ' ve
16 done a lot of drainage work in the town .
17 We ' ve improved water quality . The
18 problem is the administrative side is
19 very cumbersome . Particularly for urban
20 areas . And for some reason, they ' ve
21 classified us as an urban area . Not a
22 rural area . So the work here is to show
23 them all the work is done and start
24 calling us what we are , which is a rural
25 area . So there ' s a lot of bureaucracy

1 to it .
2 NICK DEEGAN : Yeah, I can imagine .
3 Just wondered about the farm runoff .
4 Would that be encompassed in all this
5 reports and work? Well , the farms
6 runoff onto the roads and go down into
7 the creeks and ponds? That would be
8 done like with berms or -- and like that
9 would be --
10 SUPERVISOR SCOTT RUSSELL : By
11 Federal Law, we are not allowed to
12 impose drainage code or drainage, any
13 type of drainage restrictions on
14 agricultural farmland, by Federal Law .
15 They ' re exempt from all drainage code ,
16 all drainage laws .
17 NICK DEEGAN : Okay .
18 PAUL DECHANCE : Mr . Deegan, if you
19 have any issues you ' d like to discuss
20 with the Law Department, please feel
21 free to contact my office . We can have
22 it sit down and whatever issues that you
23 have , if you want to discuss , I can do

8 work with the farmer directly . And
9 they ' re usually very receptive .
10 NICK DEEGAN : Yeah, I ' m taking a
11 Wolf Pond of course right now . You know
12 and they farms up the road from . And
13 I ' d like to see the swale and the
14 ( inaudible ) water before it gets into
15 the pond . And you know bias swales
16 should be used a lot more as a for sure
17 of the farm runoff . And I think we have
18 a great system there at the pond where
19 we just need to make it work . We had it
20 working for a year until it wasn ' t . So
21 I would like to get , you know, picked
22 that up again somewhere down the road .

25 regret is I should have asked for more

9 gotten an appraisal on the Carrol Avenue
10 property? That doesn ' t sound right to
11 me . And so before you agree and do any
12 more legal papers , and selling it to the
13 developers , I think you should
14 absolutely get an appraisal . I think
15 this $500 , 000 price seems a little low
16 to me, but I ' m not in real estate . And
17 do you remember, Scott , what the Town
18 paid for it? ' Cause I know you did
19 bonds --
20 SUPERVISOR SCOTT RUSSELL : $ 750 , 000
21 though .
22 COUNCILWOMAN SARAH NAPPA: $ 750 , 000
23 though, but it was 10 acres . This is
24 half the parcel .

3 The appraisal would -- should take place

11 there ' s no requirement based on this
12 resolution to get one . So value is

16 VINCENT ORLANDO : Good evening,
17 Mr . Supervisor, Town Board Members , Town
18 Clerk, I just have a few issues to go
19 over tonight . I ' m just kidding . This
20 is a list I have to get done before
21 Christmas . I just wanted to come here
22 and thank you, Mr . Supervisor, for 30
23 years of dedication to this Town . I ' ve
24 known you for over 20 years . We watched
25 our children grow up together . I ' ve

1 served as a public servant as you for 16
2 years . Four years with the Zoning Board
3 of Appeals , four years with, as a
4 councilman sitting with you, with Mr .
5 Krupski , Mr . Whitcomb, Mr . Ruhlin,
6 Louisa Evans , Councilwoman Evans , and as
7 Mr . Harris said, we are all A' s and B ' s ,
8 but we got so much done in those four
9 years because we all cared about the
10 Town during those years . We had so much
11 legislation . Two that popped into my
12 head were detached affordable housing .
13 I ' m sorry, detached accessory garages .
14 So you can put a bot into it to help
15 young people someplace to go . And dark
16 skies . They popped into my head while I
17 was sitting here . We did that year --
18 many other things that came out just so
19 well . And also I enjoyed our
20 conversations when I came before you as
21 Superintendent of Highways . Talking
22 about, of course , this happened with Mr .
23 Harris said, it ' s also , we want more
24 money and we want more trucks .
25 Sometimes I got it . Sometimes I didn ' t .

1 We always had a discussion about it and
2 eventually figured out that I was right
3 and you were wrong . But at the end, we
4 got some trucks and not . But then while
5 walking around town, people would say,
6 but you ' re on the same A Team as Scott,
7 why didn ' t you? And I said, Scott truly
8 is physically responsible for the town .
9 And you are a problem solver, not a
10 problem maker . Like I hope that I am as
11 well . And you didn ' t say, no . You said,
12 no, let ' s try and do something next
13 year . Let ' s try and do this . Let ' s try
14 and do something that . So it was always
15 in the explanation, which you cared
16 about the town . Just because we ' re on
17 the same team . You didn ' t cough over
18 trucks and equipment to me . And I
19 appreciate that very much . I thank you
20 for all your service . And it ' s been
21 enjoyable working for you . And getting
22 to know you, as Albert said, the newly
23 elect supervisor . You really get to
24 know you when you ' re on the Town Board
25 together because we ' re in the trenches

1 every day . And you really get to know
2 your philosophy and thoughts on Southold
3 Town and you were Mr . Southold Town . I
4 appreciate that . Trying to keep it the
5 way it is , and thank you so much for

9 VINCENT ORLANDO : And also
10 Councilwoman Nappa, I want to thank you
11 as well . I did get to know you when I
12 was on the Transportation Commission
13 with you as Superintendent of Highways
14 and as we chatted this summer . When you
15 came before during 20-21 , which was
16 crazy influx of people . You really came
17 back with the compassion of trying to
18 help people walk safely, jog safely,
19 ride a bike safely, but unfortunately
20 you probably found out that I already
21 knew . You taught past legislation for
22 good neighbors and common sense , as
23 Mr . Harris said as well . But you came
24 representing the people and you were
25 thoughtful about it . And you were

1 compassionate about it . And I also saw
2 that when I was sitting here waiting to
3 go before the Town Board . When a topic
4 came up about whatever issue it was , you
5 were prepared . You did your homework .
6 And you spoke to a person, whatever the
7 topic was . And you were ready for it .
8 So you can see the compassion . You just
9 didn ' t show up that day . You did your
10 homework . So you could ask responsible
11 questions to whatever the topic was that
12 day . And I appreciate that . And I know
13 you ' re eventually going to move and I
14 won ' t see you as much as the neighbor,
15 but I wish you all the best . And Mr .
16 Supervisor, both of you, I wish you all
17 the best . And whenever you go forward
18 with, and Scott, you have my cell phone
19 number . You want to do lunch one time,
20 feel free . Give me a shout . I ' ll buy .
