Dear Ms. Smith:
The following resolution was adopted at a meeting of the Southold Town Planning
Board on Monday, November 10, 2003:
WHEREAS, the proposed minor subdivision involves the subdividing of a 3.915 acre
parcel into 2 lots where Lot 1 equals 85,265 sq. ft. and Lot 2 equals 85,265 sq. ft; and
WHEREAS, on May 10, 2000, the Zoning Board of Appeals, in its Decision #4812,
granted an area variance for a non-conforming lot (Lot 1 ) following the exclusion of the
wetland area; and
WHEREAS, the Zoning Board of Appeals, in a subsequent memorandum dated October
12, 2001, agreed to a revised lay-out which is reflected in the map currently before the
Planning Board, dated as revised September 27, 2002; and
WHEREAS, the Southold Town Planning Board granted sketch plan approval on
November 5, 2001 on the map, dated September 27, 2001; and
WHEREAS, on January 15, 2002 the Southold Town Planning Board, as lead agency,
granted a Negative Declaration for this unlisted action; and
WHEREAS, on November 26, 2001 the Town of Southold Board of Trustees issued a
Letter of Non-Jurisdiction, pursuant to Chapter 97, for the proposed action; and
WHEREAS, the State of New York Department of Transportation issued a Highway
Work Permit (Number 1002-0097) on May 24, 2002; and

WHEREAS, the Suffolk County Department of Health Services approved the proposed
action on November 22, 2002; and
WHEREAS, all conditions of conditional final approval have been met; therefore, be it
RESOLVED, that the Southold Town Planning Board grant final approval on the maps,
dated as revised September 27, 2003, and authorize the Chairman to endorse the
maps.
Enclosed please find a copy of the map that was endorsed by the Chairman. The mylar
maps, which were also endorsed by the Chairman, must be picked up at this office and
filed in the Office of the County Clerk. Any plat not so filed or recorded within sixty (60)
days of the date of final approval shall become null and void.

RESOLVED that the Town Board of the Town of Southold hereby approves the
following amendments to Chapter A106, Subdivision of Land, of the Code of the Town
of Southold, all in accordance with the recommendation of the Southold Town
Planning Board following a public hearing held by them on said amendments on April
22, 1991:
1. Section A106-21(A) (Sketch Plan) is hereby amended by adding thereto
two new subsections 1 and 2 to read as follows:
(1) All applications for sketch plan approval for a minor subdivision shall
be accompanied by a fee of five hundred dollars ($500.) per lot,
together with an inspection fee of one thousand dollars ($1,000.).
(2) All applications for sketch plan approval for a major subdivision filed
with the Town Clerk shall be accompanied by a fee of one thousand
dollars ($1,000.) plus one hundred dollars ($100.) per acre, or part
thereof, in the proposed subdivision. An inspection fee equal to six
percent (6%) of the amount of the approved performance bond must
be paid after approval of the bond amount by the Town Board and
before final approval of the plat.
2. Section A106-22(A) (Application and fee) is hereby amended to read:

RESOLVED that the Town Board of the Town of Southold hereby approves and adopts
the following amendment to Chapter A106, Subdivision of Land, from the Code of the
Town of Southold, as approved by the Southold Town Planning Board following a
public hearing on same held on May 14, 1990:
I. Section A106-38E.(3) (Money in lieu of land) of the Code of the Town of
Southold is hereby amended to read as follows:
(3) The amount to be deposited with the Town Board shall be two thousand
dollars ($2,000.00) per lot for each vacant lot in the subdivision. For the
purpose of this Section, a vacant lot shall be construed as a lot that does
not contain an existing residential structure at the time the subdivision
receives final approval. In a subdivision containing lots designated as
affordable pursuant to the Town's affordable housing code, those lots so
designated shall be exempt from this computation.
AND BE IT FURTHER RESOLVED that the Town Clerk be and she hereby is
authorized and directed to transmit this amendment to General Code
Publishers Corp. so they may make the appropriate amendment to the
Southold Town Code.

State Environmental Quality Review
FULL ENVIRONMENTAL ASSESSMENT FORM
SEQR
Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a project
or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequent-
ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine
significance may have little or no formal knowledge of the environment or may be technically expert in environmental
analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting
the question of significance.
The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination
process has been orderly, comprehensive in nature, yet flexible to allow introduction of information to fit a project or action.
Full EAF Components: The full EAF is comprised of three parts:
Part 1: Provides objective data and information about a given project and its site. By identifying basic project
data, it assists a reviewer in the analysis that takes place in Parts 2 and 3.
Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides
guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially-
large impact, The form also identifies whether an impact can be mitigated or reduced.
Part 3: If any impact in Part 2 is identified as potentially-large, then Part 3 is used to evaluate whether or not the
impact is actually important.

The following resolution was adopted at a meeting of the Southold Town Planning
Board on Monday, June 9, 2003:
The final public hearing was closed.
WHEREAS, the proposed minor subdivision involves the subdividing of a 3.915 acre
Parcel into 2 lots where Lot 1 equals 85,265 sq. ft. and Lot 2 equals 85,265 sq. ft; and
WHEREAS, on May 10, 2000 the Zoning Board of Appeals, in its Decision #4812,
granted an area variance for a non-conforming lot (Lot 1) following the exclusion of the
wetland area; and
WHEREAS, the Zoning Board of Appeals, in a subsequent memorandum dated October
12, 2001, agreed to a revised lay-out which is reflected in the map currently before the
Planning Board, dated as revised September 27, 2002; and
WHEREAS, the Southoid Town Planning Board granted sketch plan approval on
November 5, 2001 on the map, dated September 27, 2001; and
WHEREAS, on January 15, 2002 the Southold Town Planning Board, as lead agency,
granted a Negative Declaration for this unlisted action; and
WHEREAS, on November 26, 2001 the Town of Southold Board of Trustees issued a
Letter of Non-Jurisdiction, pursuant to Chapter 97, for the proposed action; and

WHEREAS an application has been made by Diane Alec Smith for a waiver fi.om the

for Major Subdivisions, Minor Subdivisions and Special Exception Use Permits and Site Plans
containing Dwelling Unit(s) in the Town of Southold" pursuant to Section 6 "Appeal
Procedures" of Local Law #3-2002 to permit the Planning Board to consider an application for a
minor subdivision for the parcel of property known as SCTM# 1000-109-01-07; and
WHEREAS the application involves the subdivision ora 3.915 acre parcel into 2 lots; and
WHEREAS the Town Board has reviexved the file, conducted a public hearing, and considered
all pertinent documents; and
WHEREAS the criteria that the applicant must meet is set forth in section 6. (Appeal Procedure)
of Local Law #3-2002 and Local Law #3-2003 and the section states:
Section 6. APPEAL PROCEDURES a. The Town Board shall have the authority to
vary or waive the application of any provision of this Local Law, in its legislative
discretion, upon its determination, that such variance or waiver is required to alleviate an
extraordinary hardship affecting a parcel of property. To grant such request, the Town
Board must find that a variance or waiver will not adversely affect the purpose of this
local laxv, the health, safety or welfare of the Town of Southold or any comprehensive
planning being undertaken in the Town. The Toxvn Board shall take into account the
existing land use in the immediate vicinity of the property and the impact of the variance
or waiver on the water supply, agricultural lands, open and recreational space, rural
character, natural resources, and transportation infrastructure of thc Town. The
application must comply with all other applicable provisions of the Southold Toxvn Code.
WHEREAS the Town has hired a "moratorium group" consisting o f in-house and outside
planners and attorneys who are working on a "Comprehensive Implementation Strategy" of the
Comprehensive Plan of the Town of Southold and certain comprehensive planning currently
being undertaken includes, but is not limited to a 80% preservation of open space throughout the
To~vn and a 60% reduction in density and clear establishment of the Hamlet Centers and a
possible Transfer of Development Rights component (a full description of the "action" is set
forth in the SEQ1L~ Resolution dated January 7, 2003 for the Southold Comprehensive
Implementation Strategy which is incorporated by reference into this decision); and
WHEREAS the Town Board finds that the application is not in contrast xvith the extensive
planning initiatives being undertaken by the "moratorium group", or the Comprehensive Plan of
the Town of Southold; and
WHEREAS the Toxvn Board finds that this application will not adversely affect the purpose of
the Local Law # 3 of 2002 and Local Law #3 of 2003; and
WHEREAS the Town Board of the Town of Southold finds that the application will not
adversely affect the health, safety, or welfare of the Toxvn of Southold; and
WHEREAS the Toxxm Board of the Town of Southold finds that the minor subdivision
application is consistent with the existing land use in the surrounding area and has a minimal
impact on water supply, rural character, natural resources and transportation infrastructure of the
Town; and
WHEREAS the Town Board of the Town of Southold finds that the application has no effect on
agricultural lands and open and recreational space; and
WHEREAS based on the application, all relevant documentation, the comments set forth at the
public hearing on this matter, the comprehensive planning currently being undertaken by the
Town, the above referenced facts, m~d the criteria set forth in Local Law No. 3 of 2002 and
extended by Local Law No. 3 of 2003, Section 6. Appeals Procedures, the applicant has met its

land use planning; the consideration of and any comment upon any other
reasons as stated, are beyond the scope of this review.
The proposed action involves the subdividing of a 3.915 acre Parcel (SCTM#
1000-109-01-07) into two lots where Lot 1 equals 85,265 sq. ft. and Lot 2 equals
85,265 sq. ft. Lot 1 is improved with a single family dwelling and several
agriculture support buildings. Lot 2 is unimproved. The action would create one
new residential building lot. The parcel is located on the south side of State
Road 25; 242.68 feet west of Elijah's Lane in Cutchogue (Exhibit 1). The
properly is located in the R-80 (Low to Medium Density Residential) zoning
district. On November 05, 2001 the Planning Board granted sketch plan
approval on the map dated September 27, 2001.
The Planning Board has reviewed the progression of the application and the
request for waiver for the proposed Minor Subdivision of Diane Alec Smith and
makes a recommendation that the Town Board grant the request of waiver
for the application. This decision is based upon the following facts:
Land Use - ']'he dominant land use in the general vicinity is agriculture mixed
with Iow density residential. To the north, agriculture uses dominate. The Town
of Southold holds the development rights to the parcel directly north. The
residential development in the area is consistent with the "homestead"
development pattern, where a residence anchors a large tract of farmland. An
older residence and numerous supporting agricultural outbuildings currently
occupy Lot 1. The area proposed as Lot 2 is in lawn with a few interspersed
trees. Historic aerial photos (2001) show that, although small, the Lot 2 area was
in active agriculture.
The Peconic Land Trust owns the property directly south of the parcel. The
winery and vineyard of Pelligrini Vineyards borders the western boundary of the
parcel with larger agriculture operations farther west. To the east, the dominant
use is residential. Due to the size of lot 2 (85,265 sq. ft.) the potential of the area
to provide collective open space and/or open space easements is Iow.
Following the improvement of Lot 2, the view shed will be interrupted. During the
application process, the visual impacts were evaluated during the SEQR review
and no "significant" adverse impacts were identified. Note, however, that S.R. 25
is a Scenic Byway, and the view from S.R. 25 northwest across the property has
scenic value and all efforts to minimize the interruption of the view shed should
be taken.
The subject parcel is zoned R-80, which requires a minimum size of 80,000
square feet per lot. The R-80 zoning district is also located to the north, south
and east of the parcel. The property to the west is zoned A-C (Agricultural
Conservation). The Zoning Board of Appeals granted an area variance (Appl.
No. 4812) for the both Lots 1 and 2 on May 10, 2000 for a different lot
configuration. The variance was based upon the finding that although the total
parcel area is 3.915 acres, the wetland area (12,138 sq. ft.) was to be excluded
from the yield of the parcel. Currently the lot configuration has been amended
where Lot 1, excluding the wetland, is 73,120 sq. ft. and Lot 2 meets the
dimensional requirement within the R-80 zoning district.
Lots located to the east, west and north range from .66 acres to 3.8 acres; with
numerous lots close to 2 acres in size. Based upon such, the proposed action
would not significantly deviate from the general area land use and the parcel
sizes adjacent to S.R. 25.
Transportation Infrastructure -The applicant has applied for and received a
curb-cut permit from the State of New York Department of Transportation.
On January 15, 2002 the Planning Board issued a Negative Declaration pursuant
to the State Environmental Quality Review Act Section Article 8, Par[ 617
indicating that no significant traffic impacts are expected to occur if the project is
implemented as planned.
Natural Resources - The parcel is in residential use. The eastern section of the
parcel is comprised of a portion of a wetland (large pond). The remainder of the
property is in lawn with a few interspersed trees.
The building envelope of Lot 2 meets the 100' wetland setback. Correspondingly,
the Town of Southold Trustees issued a letter of non-jurisdiction on November
26, 2001.
On January 15, 2002 the Planning Board issued a Negative Declaration pursuant
to the State Environmental Quality Review Act stating that no significant
environmental impacts are expected to occur if the project is implemented as
planned.
The action does fall within the jurisdiction of the Suffolk County Planning
Commission. Comments from the Suffolk County Planning Commission have
been received and considered by the Planning Board.
Water Supply - The applicant has stated that water supply to the Lot 2 will be
accomplished via a private well. Sanitary disposal within the proposed
subdivision will be managed by on-site underground sewage leaching systems
The applicant has stated that they have received Suffolk County Department of
Health (SCDH) approval in November, 2002 (check). The Planning Board has
no record of SCDH approval and the statement is currently unverified.
Rural Character - The proposed action would result in the increase of one
residential structure on Lot 2. Due to the location of the new structure, the view
shed will be disrupted. As mentioned above, S.R. 25 is a scenic byway and
placement of the residence should be evaluated to minimize any adverse
impacts to the scenic quality of the area. The building envelope for Lot 2 is
proposed with a 60-foot setback from the southern property line adjacent to S.R.
25.
Agricultural Lands - The parcel is currently located within the R-80 zoning
district; a designation intended to permit residential development. In 2001,
approximately one third (1.3 acres) of the parcel was in active agriculture.
Currently the area is in lawn; therefore, no active agricultural loss will occur.
However, agricultural soils will be lost. Soil type of the parcel is Riverhead sandy
loam, 0 to 3 percent slopes (RdA) - Capability Unit Ils-1 and Riverhead sandy
loam, 3 to 8 percent slopes (RdB) - Capability Unit lie-2. The soils are listed as
prime agricultural soils by the USDA Soil Survey of Suffolk County (1972). All of
these soil types are well suited for crops.
Open Space and Recreation Space - Due to the size, location and current use
of the property, the potential to provide significant open space or recreational
uses are Iow.
Base upon the above, it is the Planning Boards finding that although the
proposed project does not fully suppor[ the planning objectives of the Town of
Southold which include: The preservation of open space and recreational space;
the preservation of the Rural, Cultural and Historical Character of the Hamlets
and surrounding areas and the preservation of the natural environment; the size,
location and residential use of the parcel limits the ability of the proposed action
to fully support such objectives.

This is an appeal pursuant to Section 6 of local law entitled "Local Law in
relation to a Temporary Moratorium on the Processing, Review of, and making Decisions
on applications for Major Subdivisions, Minor Subdivisions, and Special use Permits and
Site Plans containing Dwelling Unit(s) in the Town of Southold".
Pursuant to the Section 6 appeal procedures, the Town Board has the authority to
waive the application of the Temporary Moratorium enacted by the above local law in
order to alleviate an extraordinary hardship. The Town Board must find that a waiver
will not adversely affect:
1) the purpose of the local law as set forth at Section 1 of the law (summarily
stated as preservation of farm land, open space, natural environment and
rural, cultural and historical character of the hamlets; or
2) the health, safety or welfare ofthe Town or any comprehensive plan being
undertaken in the Town
It is submitted that the Town Board should exercise its discretion in favor of the
applicant herein and conclude that the criteria above stated has been met for the following
reasons:
This is an application for a two lot subdivision first submitted in February 2000.
It was caught up in the recently enacted local law because of the time necessary to
comply with the Planning Board's request to change the boundary lines of the proposed
lots and because of the delay within Suffolk County Health Department. The property
has been held within the family of the applicant for more than 50 years. The existing
land use in the immediate vicinity of the property is not intensive and a waiver will have
no appreciable effect on water supply, agricultural lands, open space or the rural
character and natural resources of the Town.
Particular hardship would be created by a failure to grant a waiver in this matter
since the spouse of the owner applicant is currently undergoing experimental treatment
for a possibly terminal illness (see Exhibit I attached). Significant expenses have been
incurred in regard to this subdivision application. It is critical that the applicant complete
the subdivision procedure in a timely manner in order to consolidate her assets and better
secure her uncertain financial future.
It is the applicant's hope that the sale proceeds from the created second lot will
finance her relocation with her minor children to the remaining improved lot.

Office of Wastewater Management. Surrounding well and septic system locations will be a
required submission. Proposed sanitaD' and water supply locations should be submitted on
revised plans. Test xvell results will be necessary.
The applicant must comply with the requirements of the Suffolk County Sanitary Code and
relevant construction standards for water supply and sewage disposal. Design and flow
specifications, subsurface soil conditions, and complete site plan details are essential to the
review of this project. These considerations m-e reviewed completely at the time of SCDHS
application. SCDHS maintains jurisdiction over the final location of sewage disposal and water

The following resolutions were adopted at a meeting of the Southold Town Planning
Board on Monday, November 5, 2001:
WHEREAS, the proposed minor subdivision is for 2 building lots; and
WHEREAS, the Zoning Board of Appeals, in its Decision ~4812, granted an area
variance for a non-conforming lot; and
WHEREAS, the Zoning Board of Appeals, in a subsequent memorandum, dated
October 12, 2001, agreed to a revised lay-out which is reflected in the map currently
before the Planning Board, dated September 27, 2001; be it therefore
RESOLVED that the Southold Town Planning Board grant sketch plan approval on the
map, dated September 27, 2001, with the following conditions:
The building envelopes on the westerly side of the property is to be set
back at least 100 ft. from the edge of the wetlands as determined by the
Southold Town Trustees;
Receipt of the Curb Cut Permit from the NYS Department of
Transportation;
Approval from the Suffolk County Department of Health Services; and, be
it further resolved

RESOLVED that the Southold Town Planning Board start the lead agency coordination
process on this unlisted action.
Sketch plan approval is conditional upon submission of final maps within six (6) months
of the date of sketch approval, unless an extension of time is requested by the
applicant, and granted by the Planning Board. The final map, six (6) paper prints and
two (2) mylars must contain a current stamp of Health Department approval and must
be submitted before a final public hearing will be set.
The Planning Board has reviewed the property and has decided that it is inadequate in
size for a reservation of land for park and playground use. Therefore, a cash payment in
lieu of land reservation will be required as per Section A106-38(e) of the Town Code.
The amount required shall be $5,000.00 (five thousand dollars per new vacant lot in the
subdivision). Payment is required prior to any final endorsement of the subdivision.
The sketch plans have been referred to the Suffolk County Planning Commission, the
Town Engineering Inspector, the Town Trustees and the Cutchogue Fire Department for
review. The Planning Board may require additional covenants and restrictions upon
review of the reports and review of the final map. You will be notified if any additional
covenants and restrictions are required.

I believe your letter incorrectly referrers to a subdivision of three building lots while I
am only requesting for a subdivision of one building lot on my existing land.
Your letter requests a Curb Cut Permit form NYS Department of Transportation
however the proposed division already has an appropriate curb cut and existing
driveway.
Your letter advises that a payment of $5000.00 per vacant lot is required prior to any
final endorsement of the subdivision however Bob Kassner told me that the cost
would be $3000.00. and the application submitted to the zoning board 3/14/2000 also
states $30(30.00. I believe that this costs was agreed upon be~'o~ my payment of
$1500.00 (Aug. 24, 2001 ) to the planning board and at no time had I heard otherwise
until this letter dated 11/6/2001. I believe that if your office had not had the staffing
problems that this matter would have been completed prior to any price increase and
in accordance with what I was originally told.

The most landward limit of freshwater wetland should be field flagged by a qualified expert, verified
by the appropriate agency & shown on the plan.
No new dwelling or sanitao faciliw should be located closer than 100' from the freshwater wetland.
A buffer or conservation easement at least 50 feet in width should be established along SR 25 to
help preserve the natural vegetation along the road, so as to enhance the aesthetics of the road,
contribute to the preservation of residential amenities from traffic activities and noise, and to help
minimize the erosion potential.
Clearing and cutting within this area should be limited to that necessary for proper lnaintenance and
removal of diseased, decayed, or dead material and obnoxious plant species. Such cleariug and
cutting shall be subject to review by the Town to insure proper maintenance and preservation of the
natural buffer.

I would like for you to consider changing the lot configuration of my property (22445
Main Road) currently being subdivided. This new configuration, proposed by the
planning board, would better suit the property and meet my needs as well.
The new configuration would eliminate the need for a dght of way and movement of a
drainage culvert on the main mad and give the new lot mad frontage on mute 25.
The lots would still be evenly divided and I believe the division still conforms to the
original specifications set forth by the zoning board.
I feel that this change stiJt conforms to the spirit of the odginal judgment made by the
zoning board for the approval of the vadance set forth on the first survey and I would
greatly appreciate your allowing for this change. I hope it will not be necessa~j for a
new meeting to be scheduled with the zoning board and that this matter can be
expedited as soon as possible. Please advise me of your decision and what steps I
need to take to finalize this matter.

FINDINGS OF FACT
PROPERTY FACTS: The subject property comprises 165,117 sq. ft. with 271.7 feet of frontage on
Main Road in Cutchogue. The southerly portion, near Main Road, is improved with a house and a
number of other buildings. A pond, principally located on the property immediately to the west,
covers the westerly part of the property for a distance of 40 to 60 feet from the westerly property
line. A 25-foot right-of-way from Main Road runs along the easterly side of the property for about
218 feet.
BASIS OF APPEAL: Building Inspector's Notice of Disapproval dated March 22, 2000 denying an
application for subdivision into two lots, on the ground that, omitting the underwater land in
accordance with Code section 100-239, both of the resulting lots would be less than the 80,000 sq.
ft. required in the R-80 zone.
RELIEF REQUESTED: Applicant requests a vadance uner the zoning code for the lot area in this
proposed subdivision of two lots: Lot 1 on the rear (northerly) section of the property with 73,677
sq. ft. of land above water and 6,323 sq. ft. of underwater land, and Lot 2 on the front (southerly)
section with 79,302 sq. ft. of land above water and 5,815 sq. ff. of underwater land.
REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented,
materials submitted and personal inspection, the Board makes the following findings:
(1) The subject property is owned by George Aiec, applicant's father. It is the segment that
was retained when the former family farm was sold. The owner wishes to subdivide in order to
enable his daughter to build a home on proposed Lot 1. The existing improvements are located on
proposed Lot 2.
(2) The property existed in its current dimensions well before the area was zoned to require
80,000 sq. ff. lots. Although the property contains 165,117 sq. ft., it cannot be subdivided without a
variance because 12,138 sq. ft. are underwater according to the survey presented by applicant.
(3) Although Code section 100-239 provides that underwater land is not to be counted in
determining lot size, on this property the presence of the pond does not detract from the viewer's
sense of the size of the lot. Also, the prospects are limited for development on adjacent lands,
which include an established vineyard and property on which development dghts have been sold.

(4) ~ requested relief is not substantial: the above water portions of the two proposed
lots, aA~ercentages of the required 80,000 sq. ft., are 92% for Lot 1 and over 99% for Lot 2.
. (~ There is no evidence that grant of the requested relief will have an adverse effect or
impac{,,.Cj~ physical or environmental conditions.
(6) For the foregoing reasons, grant of the requested relief will not produce an undesirable
change in the oharacter of the neighborhood or detriment to nearby properties.
(7) The action set forth below is the minimum necessary and adequate to enable applicant
to enjoy the benefit of the proposed subdivision while preserving and protecting the character of
the neighborhood and the health, safety and welfare of the community.

Dear Southold Town Zoning Board:
I would like for you to consider changing the lot configuration of my property (22445
Main Road) currently being subdivided. This new configuration, proposed by the
planning board, would better suit the property and meet my needs as well.
The new configuration would eliminate the need for a right of way and movement of a
drainage culvert on the main road and give the new lot road frontage on route 25.
The lots would still be evenly divided and I believe the division still conforms to the
original specifications set forth by the zoning board.
I feel that this change still conforms to the spirit of the original judgment made by the
zoning board for the approval of the vadance set forth on the first survey and I would
greatly appreciate your allowing for this change. I hope it will not be necessary for a
new meeting to be scheduled with the zoning board and that this matter can be
expedited as soon as possible. Please advise me of your decision and what steps I
nccd to take to finalize this matter.

(6) For the foregoing reasons, grant of the requested relief will not produce an undesirable
change in the oharacter of the neighborhood or detriment to nearby properties.
(7) The action set forth below is the minimum necessary and adequate to enable applicant
to enjoy the benefit of the proposed subdivision while preserving and protecting the character of
the neighborhood and the health, safety and welfare of the community.
