The question of whether an action may be significant is not always easy to answer. Frequent- ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine significance may have little or no formal knowledge of the enwronment or may be technically expert in environmental analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concern~ affecting the question of significance. The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination process has been orderly, comprehensive in nature, yet flexible to allow introduction of information to fit: a project or action. Full EAF Components: The full EAF is comprised of three parts: Part 1: Provides objective data and information about a given project and its site. By identifying basic project data, it assists a reviewer in the analysis that takes place in Parts 2 and 3. Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially- large impact. The form also identifies whether an impact can be msti§ated or reduced. GENERAL CONDITIONS General Condition '1: Facility Inspection by the Department The permitted site or facility, including relevant records, is subject to inspection at reasonable hours and intervals by an authorized representative of the Department of Environmental Conservation (the Department) to determine whether the permittee is complying with this permit and the ECL. Such representative may order the work suspended pursuant to ECL 71-0301 and SAPA 401(3). The permittee shall provide a person to accompany the Department's representative during an inspection to the permit area when requested by the Department. A copy of this permit, including all referenced maps, drawings and special conditions, must be available for inspection by the Department at all times at the project site or facility. Failure to produce a copy of the permit upon request by a Department representative is a violation of this permit. General Condition 2: Relationship of this Permit to Other Department Orders and Determinations Unless expressly provided for by the Department, issuance of this permit does not modify, supersede or rescind any order or determination previously issued by the Department or any of the terms, conditions or requirements contained in such order or determination. General Condition 3: Applications for Permit Renewals or Modifications The permittee must submit a separate written application to the Department for renewal, modification or transfer of this permit. Such application must include any forms or supplemental information the Department requires. Any renewal, modification or transfer granted by the Department must be in writing. No claim shall be made against the State of New York on account of any such removal or alteration. The State of New York shall in no case be liable for any damage or injury to the structure or work herein authorized which may be caused by or result from future operations undertaken by the State for the conservation or improvement of navigation, or for other purposes, and no claim or right to compensation shall accrue from any such damage. Granting of this permit does not relieve the applicant of the responsibility of obtaining any other permission, consent or approval from the U.S. Army Corps of Engineers, U.S. Coast Guard, New York State Office of General Services or local government which may be required. All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials associated with the project. Any material dredged in the conduct of the work herein permitted shall be removed evenly, without leaving large refuse piles, ridges across the bed of a waterway or floodplain or deep holes that may have a tendency to cause damage to navigable channels or to the banks of a waterway. 6. There shall be no unreasonable interference with navigation by the work herein authorized. If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the applicant shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore the site to its former condition. No claim shall be made against the State of New York on account of any such removal or alteration. It is with regard to these hearings that I feel compelled to address the board in this letter. As you are axvare, Local Law No. 3 of 2002, in section 6 thereof, provides that a variance or waiver from the moratorium instituted by the Local Law No. 3 will be granted on an individual basis where an "extraordinary hardship affecting a parcel of property" can be shown. The appeal provision goes on to state that the board shall take into account the existing land use in the immediate vicinity of the subject parcel and the impact of the variance or waiver on the "water supply, agricultural lands, open and recreational space, rural character, natural resources, and transportation infrastructure of the Town." The instant application clearly meets all of the criteria for waiver. A hardship will certainly result should the application not be granted, and furthermore, none of the identified natural resources or target areas will be impacted. Both parcels will be serviced by public water, the existing parcel already having been connected. There will be no impact to the services or other environmental concerns outlined in the laxv for consideration. Moreover, please be reminded that the parcel in question is a 2 acre parcel in an R-40 zone. The 2 parcel subdivision requested by the Marvins is outside the scope of any consideration of upzoning now being undertaken bythe town. The subdivision, if granted, will merely create 2 one acre parcels to be developed by one additional dwelling which will not vary from the existing land use in the immediate vicinity. It is imperative that the board not combine its discussion or consideration of the instant application with any other waiver or appeal application now before it. The law prescribes individual consideration, and the granting of a waiver where the facts indicate it, as here, is warranted. I thank you for consideration of these important issues. THE FACTS: The instant application seeks the division into two one acre parcels of a single 2.081 acre property on Jackson Street, New Suffolk. The sole purpose of the application is to set offa second parcel on the property for the construction of a single family residence to be held, used and enjoyed by the Applicant, its relatives, grandchildren, guests and particularly as a writing studio for Applicant Edgar Marvin. Sketch Plan Approval was granted by the Planning Board on June 14, 1999 on a Map dated May 26, 1999. Application was then promptly made to the Suffolk County Department of Health Services (SCDH). DEC Permits were obtained in September, 2001. However, application before the SCDH was delayed, and approval was not obtained until November, 2002. In the meantime, two extensions of the referenced Sketch Approval have been granted by the Planning Board, the second of which will expire in February, 2003. The 3 x,5 year delay in obtaining approval from the SCDH has been an extraordinary hardship on the Applicants. The financial costs have been unreasonable and the emotional burden immeasurable. The maps have been re-dra~vn and submitted 6 times, each time revising in the most part the proposed water service to the parcels. Initial maps were submitted proposing the use of well water. The SCDH demanded the use of public water and the maps were revised. The Suffolk County Water Authority (SCWA) had at the time proposed limited service to the New Suffolk area, but water appeared available to the applicant. Later, we were to learn that Jackson Street would not be serviced. Applications were made again to the SCDlt showing well water and an appeal was begun for a variance from the requirement for public water, and to approve the use of a temporary well. Some time thereafter, Valerie Marvin was contacted by the SCWA and promised public xvater service, which service was soon after denied due to the imposition ora moratorium on such service by the SCWA. In the meantime, however, the Applicants had hooked-up their main house to public water at a cost of $3,000, abandoned a test well that had been dug at a cost of $2,000 and paid for the SCDH testing of the well at a cost of $1,750. All of these costs were in addition to the mounting costs of applications, surveys, engineering inspections and professional fees. Finally, on or about September 24'h, 2002, the SCWA issued a Tap Letter and a Letter of Availability for the project, the final Maps were submitted and the necessary approval was obtained froin the SCHD in November, 2002. In all this time, the plans for the project never changed and the Applicants tirelessly pursued, trusting that once the proper approvals were obtained from the SCDH they would obtain final subdivision approval and begin to build. In the process Applicant Edgar Marvin has watched his eightieth birthday come and go, and felt his dreams dashed again and again. THE PURPOSE OF LOCAL LAW NO. 3 OF 2002: As stated in the text, Local Law No. 3 of 2002 was passed to address threats on or concerns in the Town of Southold with regard to its "agricultural lands, its recreational space, rural character, natural resources and transportation infrastructure." It speaks also to "iH planned residential subdivisions and multi.family developments and.., insufficient affordable housing opportunities." (Emphasis added) None of the above threats is a possibility should this request be granted. Moreover, the four guiding planning objectives outlined in the Law, namely: 1) the preservation of farmland and agriculture; 2) the preservation of the Open Space and Recreational Space; 3) the preservation of the Rural, Cultural, Commercial and Historical Character of the Hamlets and Surrounding Areas; and 4) the preservation of the Natural Environment. are unaffected by the application at issue. The instant subdivision and request for waiver effect a single residential parcel not located in a farmland area, not involving any significant mount of Open Space or the development of open lands. It is not a multi-family development nor is it located in a hamlet or historical district. The area of New Suffolk at issue is one acre zoned. One look at the tax map will show that 99% of the parcels of property on the same side of Jackson Street have already been at one time divided into one acre or less, and one drive down the block will prove that most homes also have a second house or guest cottages already existing, similar the one proposed here. There is no plan to divide and sell the premises and no additional driveway will be made. All services, including garbage removal, property maintenance and the like will continue to be provided through the main house and property. Both the new dwelling and the existing home will be serviced with public water. Moreover, every effort will be made to reduce any environmental impact the project may have through plantings of native shrubs and preservation to the greatest extent possible of existing trees and shrubs. The Applicant will endeavor to make minimal disturbance to the land and minimum irrigation is planned and will be employed with well water. THE APPEAL: Section 6 of Local Law No.3 of 2002 sets forth the Appeal Procedure and states in part that a variance or waiver may be granted where it is required to alleviate an extraordinary hardship affecting a parcel of property, and where [t]he Town Board finds that a variance or waiver will not adversely effect the purpose of this local law, the health, safety or welfare of the Town of Southold or any comprehensive planning being undertaken in the Town, the Town Board shall take into account the existing land use in the immediate vicinity of the property and the impact of the variance or waiver on the water supply, agricultural lands, open and recreational space, rural character, natural resources, and transportation infrastructure of the Town. There is no question that a waiver is applicable and necessary here. The project is clearly outside the directed scope of the Town's application of a moratorium as it clearly does not effect any of the areas ofconceru targeted by said moratorium. Moreover, it is keeping with the existing land use in the immediate vicinity of the property. There is no question that the Applicants have suffered greatly through this process and lost immeasurable time and wasted a great deal of money. There is also no doubt that once the moratorium is lifted, this project will certainly go ahead as planned as it is outside the scope of the moratorium. While the hold-up and amplified costs suffered by the Applicant are not the fault of any agency of Southold Town, the failure of the Town Board to grant a waiver of Local Law No.3 in this case would create and perpetuate extraordinary hardship on the Applicants and the property. Permits and approvals will expire, more money will be wasted and significantly, the Applicants will lose more time, precious time, the emotional hardships of which are again immeasurable. In conclusion, a waiver in this case is undeniably justified by the facts. Public water supply, although provided by the Suffolk County Water Authority. is determined through the current and projected use of the community. To date, the supply does not meet the demand, however, water use is controlled by an individuals' actions and can often be mitigated through numerous water conservation measures implemented during the planning process. Water quality is very difficult to control. Although point source pollution can usually be traced to its origin, non-point source pollution is boundless and one of the largest threats to local environmental and community health. Non-point source pollution has been identified as the primary cause of water quality degradation in more than 90 percent of New York State's impaired water bodies. In the Town of Southold, localized well and surface water contamination already exists. The project, as proposed, involves tile subdivision of a 2.081 acre parcel into two single family residential lots. Three structures currently exist on the project site, including a house, a garage with rooms above and a small house situated near the beach at the rear of the property. The subject property has been inspected and environmental references have been thoroughly researched. The LEAF, Part I has been reviewed and amended as necessary, The LEAF Part II has been prepared by this office. A synopsis of the project and analysis of potential environmental issues are presented below PROJECT SYNOPSIS The project site is located on the south side t~f Jackson Street. 431 57 feet east of Fifth Street, Hamlet of New Suffolk, Town of Southold, County of SutTolk, SCTM No. 1000-117-10-9. The property has 184.49 feet of street frontage on Jackson Street and its depth ,,'aries form 466.09 feet at the parcels eastern extent to 541.66 feet at its western terminus. The rear of the property has a +/- 20 foot bluff that slopes off to a beach that abuts Great Peconic Bay. The project site is currently developed with a residential dwelling, detached garage and small house at the beach. The project is Situated ~vithin tile R-40 zoning district requiring a minimum lot area of 40,000 SF. Marvin Subdivision EAF Part I Review The applicant is proposing to subdivide the 2.081 acre site into two single family residential lots varying in size from 0.916 acres to 1. 165 acres. The survey for lot I which contains the detached garage does not indicate if the detached garage will be removed. Lot 2 contains the existing dwelling and small house at the rear of the property. ENVIRONMENTAL AND PLANNING CONS[DFIL&TIONS The site is zoned R-40, Low Density Residential, which requires a minimum lot size of 40,000 SF. Land use in the surrounding area is predominantly residential, R-40, with the only exception being a small area at the corner of New Suffolk Avenue and Fifth Street that is zoned R1L Resort Residential. The subject property abuts residential uses to the north, west and east and Great Peconic Bay to the south. The Southold Town Planning Board accepted the yield map via a resolution dated June 14, 1999. The project site and subdivision map contain a detached garage and small structure at the rear of lot 2~ The Southold Planning Board may wish to ascertain the applicants plan for these two structures. Should these structures be utilized as dwellings, this would impact the dwelling density of the project and thereby need to be considered when calculating septic system and water supply requirements. In addition, from a planning and zoning standpoint each lot should contain only one (1) principal use. Analysis in this report is limited to a two lot subdivision with two single family dwellings. The proposed subdivision abuts Great Peconic Bay. This puts this subdivision within jurisdiction of Article 25 of the Environmental Conservation Law, Tidal Wetlands. Part 661.4 (ee)(l)(v) states that any portion of a subdivision of land located in any tidal wetland or adjacent area is a regulated activity. The shoreline area along Great Peconic Bay is designated by Suffolk County as a Critical Environmental Area (CEA). Prior to the 1996 SEQRA revisions, an Unlisted Action situated adjacent to a CEA made that action Type I. That provision of SEQRA has since been removed. Therefore this project remains an Unlisted Action pursuant to SEQRA This project will require a Tidal Wetlands Permit from the NYSDEC and all development restrictions (section 661) included within the Tidal Wetlands regulations should be incorporated into this project. This would include but not be limited to building setback from the wetland line, a 100 foot setback from the on site septic system to the wetland and any other site specific conditions the NYSDEC may incorporate on thc Tidal Wetlands Permit. The location of the septic system(s) are not included on the subdivision plan. This information should be required as it will be needed to apply tbr' the Article 25 Permit The LEAF states that the applicant is proposing a private well for the potable water supply. The location of this well has not been included on the subdivision plan. It is estimated that the proposed project will utilize approximately 600 gallons of water per day. The site is located within SCDHS Groundwater Management Zone IV which encompasses the North Fork, Shelter Island and part of the South Fork The Lo~g /s/and Comprehensive Special Groundwater Protection Area P/a~ (EIRPB, 1992) characterized Zone IV as a shallow flow system where portions of the system have been contaminated Therefore it is recommended that the on site Page 2 Marvin Subdivision EAF Part l Review well be tested regularly. The location of the well must satisfy the SCDHS minimum 150 foot setback requirement to the septic system. It is recommended that the applicant indicate the location of the well and septic systems to show that all required setbacks can be met. It is anticipated that the proposed project will not have a significant impact on water supply resources. The site is relatively flat until reaching tile top of the bluff From there the elevation quickly drops approximately 20 feet until reaching the beach and Great Peconic Bay. Haven Loam (HaA, 0 to 2% slope) and Riverhead Sandy Loam (RdB, 3 to 8% slope) make up the upper elevation portion of the site with Beach Sand comprising the remaining bluff and beach. Both the Haven Loam and Riverhead Sandy Loam series are described in the Suffolk County Soil Survey as suitable for housing development. Development on the bluff and beach is not proposed and should be discouraged All sanitary disposal in the vicinity of the project is managed by on-site septic systems. The subject site is located within SCDHS Groundwater Management Zone IV, which according to SCSC Article VI has an allowable flow of 600 gallons per day (gpd) per acre. Therefore, the allowable Nitrogen bearing flow for the site is 1,248.6 gpd The sanitary design flow can be calculated using the SCDHS manual Standards .fi~r Approval of Plans and Construction for Sewage Disposal Systems for Other lhan Single Famil)' Residences. The manual establishes a design flow for single family houses of 300 gpd per housing unit. Therefore a flow of 600 gpd can be expected from this project. This calculation assumes two single family dwellings on the site. Should the other structures on the site be utilized as separate dwellings, the flow calculations xvould need to be amended. No adverse impact is expected on groundwater resources from this subdivision. The elevation of the water table at the test bore location is greater than 17 feet. Based on this data, it appears that adequate depth is provided to install a septic system to meet SCDHS requirements. However, the septic system must be located such that it meets NYSDEC setback requirements with respect to Tidal Wetlands and also maintain the required setback from the proposed water supply well. SCDHS and NYSDEC approval on the location of the septic system should be required prior to issuance of final town approval. Prior to acting on this subdivision it is recommended that the Southold Town Planning Board require the following: 1. The applicant apply for and receive a NYSDEC Article 25 Permit. 2. Determine thc status of the detached garage and small dwelling at the rear of the property. 3. Locate on the plan the proposed water well and septic systems. The location of these improvements will be required by County and State regulato~ agencies.
