At your written request of Robert Grigonis of Grigonis Contracting, for a Certificate of
Occupancy final site inspection, date received on August 7, 2006, Planning Department staff
performed a site visit on August 14, 2006.
In reference to the above, the Planning Board held a work session on August 14, 2006 to
review the site plan approved August 11, 2003 and ske visk staff comments. This is to
inform you that the ske plan requirements have been satisfied and no further ske plan review
is required at this time
This letter does not condone any changes from the approved site plan and approvals from
other agencies if required.

Dear Mr. Sambach:
The following resolution was adopted at a meeting of the Southold Town Planning
Board on Monday, August 11,2003:
The final public hearing was closed.
The following resolution was adopted:
WHEREAS, the proposed site plan, to be known as Site Plan for the Mattituck Park
District, is for a new 2,940 square foot accessory building on a 3.1 acre parcel in the R-
40 Zone; and
WHEREAS, Mattituck Park District is the owner of the property known and designated as
Mattituck Park District, located at 9233 Peconic Bay Blvd., on the s/w/c of Bay Ave., in
Mattituck, SCTM#1000-126-6-18; and
WHEREAS, a formal application for approval of this site plan was submitted on May 13,
2003; and
WHEREAS, the NYS Department of Environmental Conservation, on September 1,2001,
issued NYSDEC Permit Number 1-4738-01147/00005 authorizing this project; and
WHEREAS, the applicant has received approval from the Suffolk County Department of
Health, dated April 16, 2003, Permit Number c10-00-0015; and
WHEREAS, the Mattituck Fire District responded on June 14, 2003 after review of the
site plan and the Planning Board accepted the recommendations for approval; and
WHEREAS, on June 19, 2003, the Architectural Review Committee reviewed and
approved the proposed site plan application; and

WHEREAS, the site plan, dated Mamh 13, 2003, was certified by the Southold Town
Building Inspector on July 3, 2003; and
WHEREAS, the site plan, dated Mamh 13, 2003, was reviewed on July 11,2003 by the
Southold Town Trustees and determined the proposed building to be out of the wetland
jurisdiction under Chapter 97 of the Town Wetland Code and Chapter 37 of the Town
Code, 2003; and
WHEREAS, on June 9, 2003 the Southold Town Planning Board, acting under the State
Environmental Quality Review Act (Article 8), Part 617, performed a coordinated review
of this Unlisted Action. The Planning Board established itself as lead agency, and as
lead agency, made a determination of non-significance and granted a Negative
Declaration on July 14, 2003; and
WHEREAS, the Town Engineer has reviewed the drainage calculations and the
Planning Board has accepted his recommendation for approval; and
WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of
Public Hearing, has received affidavits that the applicant has complied with the
notification provisions; and
WHEREAS, all the requirements of the Site Plan Regulations of the Town of Southold
have been met; be it therefore
RESOLVED that the Southold Town Planning Board grant final approval on the site plan
prepared by Warren Sambach Sr., dated March 13, 2003, and authorize the Chairman
to endorse the final surveys with the following condition and subject to a one year
review from the date of the building permit;
1. All outdoor lighting shall be shielded so that the light source is not visible from
adjacent properties and roadways. Lighting fixtures shall focus and direct the
light in such a manner as to contain the light and glare within property
boundaries.
Enclosed please find two copies of the approved site plan, one for your records, and
one to be submitted to the Building Department when you apply for your Building
Permit.

State Environmental Quality Review
FULL ENVIRONMENTAL ASSESSMENT FORM
Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a project or action may
be significant. The question of whether an action may be significant is not always easy to answer. Frequently, there are aspects of
a project that are subjective or unmeasurable. It is also understood that those who determine significance may have little or no formal
knowledge of the environment or may not be technically expert in environmental analysis. In addition, many who have knowledge
in one particular area may not be aware of the broader concerns affecting the question of significance.
The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination process
has been orderly, comprehensive in nature, yet flexible enough to allow introduction of information to fit a project or action.
Full EAF Components: The full EAF is comprised of three parts:
Part 1: Provides objective data and information about a given project and its site. By identifying basic project data, it assists
a reviewer in the analysis that takes place in Parts 2 and 3.
Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides guidance
as to whether an impact is likely to be considered small to moderate or whether it is a potentially-large impact. The
form also identifies whether an impact can be mitigated or reduced,
Part 3: If any impact in Part 2 is identified as potentially-large, then Part 3 is used to evaluate whether or not the impact is
actually importanL.

Public Hearings
Under the current site plan application procedure, the process for
reviewing a site plan application is: a public hearing is not scheduled and
held by the. Planning Board until after, among other things, the site plan
has received a stamped Health Department approval.
The applicant shall now have the following options:

As an interested abutter to Mattituck's Veteran's Pork, our family continues to be
concerned about the randomness and lack of direction in the use of this town park.
For over thirty years, we have watched the apparent haphazard erection of
structures that seem questionable for a recreational town beach and park.
There are several questions that need to be addressed.
1. What is the height of this planned structure?
2. What is the purpose of this structure?
3. Is this appropriate for a park setting?
4. Will it replace all of the structures that currently exist on the property?
5. boas the town own any other land on which this building could be erected?
With the close proximity of the playground to the existing buildings; the issue of
safety is uppermost in our minds. We question if ANY building outside of o small
snack bar/rest room should exist.
In conclusion, is there any overall plan to unify the use and structures of this park?
i.e. form and function? If the park is meant as an nrea for the townspeople to swim
and to enjoy the natural beauty of the surroundings, is there a plan for the
structure to blend in such a way as not to interfere with this use?

This letter is in response to your recent notification of planned construction of a new
facility at Veteran's Memorial Park in Mattituck. As resideptial neiehbors of the park, we
are opposed to construction unless several demands are met to better facilitate the
operation, safety and neighborliness of the park. Our opposition stems from repeated
attempts on the part of the residents to get the Mattituck Park District to police and
maintain Veteran's Memorial Park. The park District has allowed the park to become an
attractive nuisance through its failure to police loud noise late into the night when their
published hours call for the park to be closed. Further, the parking has turned into a drag
race park for cars at all hours of the day and night. The lack of adequate landscaping
around the perimeter and interior of the park has led the park to take on a tenement look
in a very upscale residential neighborhood. Chain link fencing that has deteriorated over
the years looks unattractive and is the leading culprit in trying to close the park after
hours. Numerous attempts by neighbors to correct these and other problems have led to
our frustration with the District and therefore our opposition to their current request.
We are not opposed to the park as it is a valuable asset to our community. But the failures
of the District to even begin to consider its neighbors after repeated requests at meetings
and calls to the Town police to quell the noise and vandalism at the park have fallen on
deaf ears leave us no course but to oppose the authority in their efforts.
We would, however, suggest that to garner our support the Mattituck Park District
consider the following as part of their request to your board:
1 ) Closing the park physically after dusk. That means adequate fencing and gates
which are locked each and every night at dusk.
2) Fully screening the fencing with natural plantings with irrigation and maintenance
to minimize noise coming from the park and to block the visual pollution of large
numbers of parked cars. (It is truly ironic that the best looking large use building
and landscaping in Mattituck is the McDonald's)
3) Have the Town of Southold maintain a no parking zone along all road boarders of
the Park, including no parking at the Bay Avenue extension to Peconic Bay. This
request results from the large number of non-permitted entrants to the park
especially during the summer months.
4) Parking lot improvements to include landscaped islands and curbs to prevent
speeding through the parking lot at any time.
5) The park authority to give the Town of Southold and its police department
authority to close the park after dusk and eject anyone from the park after hoars.
6) Limit all large functions to no more than 100 people and 25 cars. With all
entertainment to cease at dusk.
Regrettably, this letter is coming to you late in your approval process. However, as most
of us are summer residence and live far from where notices of such efforts occur we trust
that our position will have weight. And in the future the Town of Southold and the
District should develop some method of notifying non-resident taxpayers on a timely
basis.
Lastly, we are requesting the Town of Southold adopt a noise ordinance and enforce it
vi~_ orously.
It must be remembered that the majority of this area is single family residential and that
the park must begin to act as a good neighbor. Thank you for your consideration of our

Gentlemen,
I cannot attend the August 1 lth meeting. Please accept this letter as if you heard
its content at the meeting.
I own a home on the northwest comer of Veterans' Park and have observed how
this Park has changed over the last 27 years. Yes, I have seen it abused (loud
parties through the night, boom boxes in the parking lot, cars parked on the lawns
just offthe beach, huge messes left on the beach), but what upsets me more is how
the natural beauty of the park has gradually eroded by man-made structures which
appear with no public involvement or approval.
Some examples: In the last 2 weeks a storage shed/garage has popped up. A few
years ago pressure treated posts and rails were added along a driveway (which
seems to serve no purpose since cars park everywhere); a pressure treated corral
was built just off the beach which is filled with pieces of wood, a garbage drum
and other miscellaneous items of metal and plastic. Along Peconic Bay a second
bocci court was installed (which I have never seen used); and, for years, a
dumpster was parked in the middle of the lawn resulting in a mountain of garbage
at the end of every weekend day (which was finally moved out of sight after years
of complaints). A couple of years ago a basketball court was contemplated near
the latest bocci court.
Again, I say the natural beauty of the park is disappearing and there is no formal
process by which the public can stop and/or reverse this trend.
So, I have two proposals: one is short term to deal with the proposed
pole-barn and the other long term to change the process by which future
modifications to our parks are approved.
Short Term: Pole Barn
I support the idea to improve facilities and to remove/replace existing structures.
The new facility should be pleasing to the eye, functional and the pride of the
community. I am not convinced that a pole barn meets these objectives.
I suggest:
1) that there should be no less than three designs (including renderings) for the
public to preview and vote upon.
2) All current structures be removed including the corral and the latest bocci court.
Grass should be planted in their place.
Long Term: Board of Park Trustees
To get the public linked to "all" changes made to Veterans' Park I propose the
creation of a board of publicly elected Park Trustees. As an example, there could
be 5 trustees. There would be no salary. They would be elected for a two year
term and would meet quarterly or more often, if needed. Their primary
responsibilities would include overseeing how Park budget monies are spent,
reviewing and approving all changes made to the Park and interfacing with the
public on such changes before they vote. All changes deemed significant would
be put to public vote. They would be the eyes, ears and voice of the "public."

community of Salt Lake Village is and has been aware of this proposed new construction. Although I find
it somewhat difficult to understand why residents would pose demands on a construction project when
upon completion, screening landscaping and new fencing are a part of this plan. 1 am a person that likes, if
not tbsters discussion with all District residents. I m requesting that the residents of Salt lake Village
come to our September meeting to discuss any and all concerns. The date of the meeting is September 1 I,
2003 at 7:00 P.M. or I would like to schedule a meeting at mutual convenience before the end of the

Dear Mr. Sambach:
The following resolution was adopted at a meeting of the Southold Town Planning
Board on Monday, July 14, 2003:
WHEREAS, the proposed site plan is for a new 2,940 square foot accessory building on
3.1 acres in Mattituck; and
WHEREAS, a formal application for approval of this site plan was submitted on May 13,
2003; and
WHEREAS, the N.Y.S. Department of Environmental Conservation on September 1,
2001 issued NYSDEC permit number 1-4738-01147/00005 authorizing this project; and
WHEREAS, the applicant has received approval from the Suffolk County Department of
Health, dated April 16, 2003 permit number cl 0-00-0015; and
WHEREAS, the N.Y.S. Department of Environmental Conservation responded on June
16, 2003 to the lead agency coordinated request with no objection to the Town of
Southold assuming lead agency status; and
WHEREAS, the Mattituck Fire District responded on June 14, 2003 after review of the
site plan and the Planning Board accepted the recommendations for approval; and
WHEREAS, the site plan, dated March 13, 2003 was certified by the Southold Town
Building Inspector on July 3, 2003; and
WHEREAS, the Suffolk County Department of Health responded on July 3, 2003 with
no objection to the Town of Southold assuming lead agency status; and

WHEREAS, the site plan, dated March 13, 2003 was reviewed on July 11,2003 by the
Southold Town Trustees and determined the proposed building to be out of the wetland
jurisdiction under Chapter 97 of the Town Wetland Code and Chapter 37 of the Town
Code, 2003; be it therefore
RESOLVED, that on June 9, 2003 the Southold Town Planning Board, acting under the
State Environmental Quality Review Act, performed a coordinated review of this
Unlisted Action. The Planning Board establishes itself as lead agency, and as lead
agency, makes a determination of non-significance and grants a Negative Declaration;
and be it
FURTHER RESOLVED that the Southold Town Planning Board set Monday, August
11, 2003, at 6:15 p.m. for a final public hearing on the site plan maps, dated March 13,
2003.
Please refer to the enclosed copy of Chapter 58, Notice of Public Hearing, in regard to
the Town's notification procedure. The notification form is enclosed for your use. The
sign and the post will need to be picked up at the Planning Board Office, Southold Town
Hall. Please return the enclosed Affidavit of Posting along with the certified
mailing receipts AND the signed green return receipt cards before 12:00 noon on
Friday, August 8th. The si.qn and the post need to be returned to the Planning
Board Office after the public hearing.

This notice is issued pursuant to Part 617 of the implementing regulations pertaining to
Article 8 (State Environmental Quality Review Act) of the Environmental Law.
The Southold Town Planning Board, as lead agency, has determined that the proposed
action described below will not have a significant effect on the environment and a Draft
Environmental Impact Statement will not be prepared.

Description of Action: The proposed action involves a new 2,940 sq. ft. building on a 3.1 acre
parcel. The proposed building will replace the existing building. The new building will be utilized
for equipment storage, office, bathroom facility and kitchen. The proposed building will be
located approximately +/- 200' from the Great Peconic Bay in the R-40 Zoning District.
Reasons Supporting This Determination:
An Environmental Assessment Form has been submitted and reviewed, and it was determined
that no significant adverse effects to the environment were likely to occur should the project be
implemented as planned.
There has not been any correspondence received from the Town of Southold Trustees or
Southold Town Board in the allotted time. Therefore, it is assumed that there are no comments
or objections from these agencies.
SEQR Negative Declaration - Page Two
The correspondence received from Southold Town Building Inspector on July 3, 2003 stated
that "The proposed use Park District Building is/are a permitted use in this R-40 district and is
so certified". Therefore, it is assumed that there are no additional comments or objections from
that agency.
The correspondence received from the Department of Health Services Office on July 3, 2003
stated no objection to the Town of Southold assuming lead agency status. The applicant has
made an application to SCDHS, reference number c10-00-0015. Therefore, it is assumed that
there are no comments or objections from that agency.
There has not been any correspondence received from the Suffolk County Water Authority
Office in the allotted time. Therefore, it is assumed that there are no comments or objections
from that agency.
The correspondence received June 16, 2003 from the New York State Department of
Environmental Conservation indicated, "This Department has no objection to the Town of
Southold assuming lead agency status for this action". It also referenced NYSDEC Permit # 1-
4738-01147/0005 authorizing this project. Therefore, it is assumed that there are no additional
comments or objections from that agency.
There has not been any correspondence received from the U.S. Army Corp of Engineers in the
allotted time. Therefore, it is assumed that there are no comments or objections from that
agency.
The correspondence received from Mattituck Fire District on June 14, 2003 stated "The above
named site does not require any additional fire wells at this time". Therefore, it is assumed that
there are no additional comments or objections from that agency.
The Southold Town Trustees reviewed the site plan, dated March 13, 2003 on July 11, 2003
and determined the proposed building to be out of the wetland jurisdiction under Chapter 97 of

The applicant will have to comply with the requirements of the Suffolk County Sanitary Code
(SCSC) and all relevant standards of water supply and sewage disposal systems. Design and
flow specification, subsurface soil conditions and site plan details will have to be approved by
the Suffolk County Department of Health Services (SCDHS). This impact is not considered
significant due to the anticipated project compliance with established requirements of the SCSC
and the SCDHS and the required relevant
permits.

The Suffolk County Department of Health Services (SCDHS; "Department") has received your letter
dated June 12, 2003, concerning the above-referenced project. The Department has no objection to the
Town of Southold Planning Board assuming lead agency.
This correspondence is intended primarily to expedite the procedural requirements of SEQRA
pertaining to the establishment of lead agency. The comments provided below are, therefore, general in
nature, representing several of our most common concerns regarding Suffolk County projects. The
department wishes, however, to reserve its right to provide more detailed information within the comment
period(s) established for this action.
Article VI Application Status:
Our agency has received an application for the above-referenced project on October 16, 2000 (HD
Ref # C10-00-0015), as required by Article VI of the Suffolk County Sanitary Code. The Office of
Wastewater classified the project as an unlisted action, and after a thorough review of design and flow
specifications, subsurface soil conditions, and complete site plan details, the proposal was approved on
April 16, 2003.

Item A: Permlttee Accepts Legal Responsibility and Agrees to Indemnification
The permittee expressly agrees to indemnify and hold harmless the Department of Environmental Conservation
of the State of New York, its representatives, employees, agents, and assigns for all claims, suits, actions, damages,
and costs of every name and description, arising out of or resulting from the permittee's undertaking of activities or
operation and maintenance of the facility or facilities authorized by the permit in compliance or non-complianca with
the terms and conditions of the permit.
Item B: Permlttee~$ Contractors to Comply with Permit
The permittee is responsible for informing its independent contra~i0rs, employees, agents and assigns of their
responsibility to comply with this permit, including all special conditions while acting as the permittee's agent with
respect to the permitted activities, arid such persons shall be subject to the same sanctions for violations of the
Environmental Conservation Law as those prescribed for the permittee.
Item C: Permlttee Responsible for Obtaining Other Required Permits
The permittee is responsible for obtaining any other permits, approvals, lands, easements and rights-of-way that
may be required to carry out the activities that are authorized by this permit.
Item D: No Right to Trespass or Interfere with Riparian Rights
This permit does not convey to the permittee any right to trespass upon the lands or interfere with the fipadan
dghts of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or
interest in real or personal property held or vested in a person not a party to the permit.
GENERAl.: CONDITIONS ·
General Condition 1: Facility Inspectlol~ by the Department
The permitted site or facility, including relevant records, is subject to inspection*at reasonable hours and intel~als
by an authorized representative of the Department of Environmental Conservation (the Department) to determine
whether the permittee is complying with this permit and the ECL. Such representative may order the work suspended
pursuant to ECl. 71-0301 and SAPA 401(3).
The permittee shall provide a person to accompany the Department's representative during an inspection to the
permit area when requested by the Department.
A copy of this permit, including all referenced maps, drawings and special conditions, must be available for
inspection by the Department at all times at the project site or facility. Failure to produce a copy of the permit upon
request by a Department representative is a violation of this permit.
General Condition 2: Relationship of thle Permit to Other Department Orders and Determinations
Unless expressly provided for by the Department, issuance of this permit does not modify, supersede or rescind

General Condition 3: Applications for Permit Renev~ats Or ModifiCations
The permittee must submit a separate wdtten application tothe Department for renewal, modification or transfer
of this permit. Such application must include any forms or supplemental information the Department requires. Any
renewal modification or transfer granted by the Department must be in writing.
The permittee must submit a renewal application at least:
a) 180 days before expiration of permits for State Pollutant Discharge Elimination System (SPDES),
Hazardous Waste Management Facilities (HWMF), major Air Pollution Control (APC) and Solid Waste
Management I~acilities (SWMF); and
b) 30 days before expiration of ali other permit types.

If future operations by the State ~ew.¥tbrk reqaire an alteration in the position of the structure or work herein
authorized, or if, in the opinion of the DepartmentOf Environmenta! Conservation it shall cause unreasonable
obstruction to the free navigation of said waters or flood flows or endanger the health, safety or welfare of the
people of the State, or cause loss or destruction of the natural resources of the State, the owner may be ordered
bythe Department to remove or alter the structural work, obstructions, or hazards caused thereby without expense
to the S~ate, and if, upon the expiration or revocation of this permit, the structure, fill, excavation, or other
modification of the watercourse hereby authorized shall not be completed, the owners, shall, without expense to
the State, and to such extent and in such time and manner as the Department of Environ mental Cor~serVation may
require, remove all or any portion of the uncompleted structure or fill and restore to its former condition the
navigable and flood capacity of the watercourse. No claim shall be-made against the State of New York on
account of any such removal or alteration.
The State of New York shall in no case be liable for any damage-or injury to the structure or work herein
authorized which may be caused by or result from futura operations undertaken by the State for the conservation
or improvement of navigation, or for other purposes, and no claim or right to compensation shall accrue from any
such damage.
Granting of this permit does not relieve the applicant of the responsibility of obtaining any other permission,
consent or approval from the U.S. Army Corps of Engineers, U.S. Coast G ua rd, New York State Office of General
Services or local government which may be required.
4. All necessary precautions shall be taken to preclude contamination of any wetland or waterWay by suspended
solids, sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachata or any other
environmentally deleterious materials associated with the project.
5. Any material dradged in the conduct of the work herain permitted shall be removed evenly, without leaving large
refuse piles, ridges across the bed of a waterWay or floodplain or deep holes that may have a tendency to cause
damage to navigable channels or to the banks of a waterway.
6. There sJ~all be no unreaSOnable interference with nav~gatr(~n by'the'work herein authorized.
If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the
applicant shall, without expense to the State, and to such extent and in such time and manner as the Department
of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and
restore the site to its former condition. No claim shall be made against the State of New York on account of any
such removal or alteration.
If granted under 6NyCRR Part 608, the NYS Department of Environmental Conservation hereby certifies that the
subject project will not contravene effluent limitations or other limitatiohs or standards under Sections 301,302,
303, 306 and 307 of the Clean Water Act of 1977 (PL 95-217) provided that all of the conditions listed herein are
met.
9. At least 48 hours prior to commencement of the project, the permittee and contractor shall sign and return the top
portion of the enclosed notification form certifying that they are fully aware of and understand al! terms and
conditions of this permit. Within 30 days of completion of project, the. 13ottom portion of the form must also be
s gned and returned, along with photographs of the completed work and if requ red a survey.

'SPECIAL CONDITIONS

(upland) and removed to an approved upland area for disposal. No debris is permitted in tidal wetlands and or
protected buffer areas.
3. The storage of construction equipment and materials shall be confined to within parking areas within the park.
4. Necessary erosion control measures i.e., haybales, silt fencing, etc. are to be placed on the downslope edge of
any disturbed area. This sediment barrier is to be put in place before any disturbance of the ground occurs and is to
be maintained in good condition until thick, vegetative cover is established:

The ARC met at Town Hall at 4:30 p.m.. Members present were:

Also present were Bruno Semon of the Planning Board ,Warren Sembach, Gall
Wickham and Gerard Goehringer for the Mattituck Park District; Harold E.
Gebhard and Patricia Moore for the Stanley Malon Building; as well as Nancy
Steelman and Ural Talgt for Sang Lee Farms.
Moved by Garrett Strang and seconded by Robert Keith, it was
RESOLVED to APPROVE the MINUTES of the meeting of April 3, 2003
Vote of the Committee: Ayes All.
MATTITUCK PARK DISTRICT (Peconic Bay Boulevard - Mattituck)
It was RESOLVED by Robert Keith and seconded by Garrett Strang to TABLE the
application. Although conceptually agreeable, the Committee requests revised
plans showing the Hardy Plank siding with battens, a gable roof (the same pitch or
stepped down) extending over the porch, the missing elevations, the color of the
roof shingles, siding and trim aswell as the location of the mechanicals and roof
penetrations.
Vote of the Committee: Ayes All
STANLEY MALON BUILDING (Main Road - Cutchogue) Presubmission
The Committee had no serious objections but noted that revisions may be
necessary dependent on the decision of the Zoning Board of Appeals. Comments
included a recommendation that the cupola be reduced in scale, the location of
mecharlicals and roof penetrations be documented and that cuts of wall and

SANG LEE FARMS (North Road - Peconic)
Itwas RESOLVED by Herbert Ernst and seconded by Robert Keith to APPROVE
the application with the CONDITION that revised drawing be provided to show
