HomeMy WebLinkAboutLP-12/12/2023 LAND PRESERVATION COMMITTEE MEETING Minutes & Discussion Notes from Meeting held Tuesday, December 12, 2023 at 7:00 p.m. This Regular Meeting was held in the Annex Executive Board Room, located on the 2nd floor at Southold Town Hall Annex, 54375 Route 25 (Main Road), Southold, New York. The public had access to view and listen to the meeting as it was happening via Zoom. If an attendee did not have access to a computer or smartphone, there was an option to listen in via telephone. Comments from the public may not be solicited nor received without an appointment. It is expected that the Committee will enter into Executive Session* at some point after opening the Regular Meeting for the purpose of discussing applications regarding proposed acquisitions of real property where publicity would substantially affect the value thereof. Committee Minutes and Administration • Acceptance of LPC meeting minutes from November 28, 2023 MOTION made by Sam McCullough, seconded by Doris McGreevy, to accept the November 28, 2023 LPC meeting minutes. Motion carried: 4/0 (Will Lee abstained) • Next LPC Meeting Date: January 9, 2024 • The Committee thanked Sarah for her service to the Committee as its Liaison. They expressed their appreciation for her investment in the Land Preservation program, and they wished her well on her next chapter. General Preservation • None Inquiries/Applications for Uses or Structures on Preserved Property • None Stewardship and Management • Further North Farms LLC SCTM#1000-108.4-1.4—Update Re: Potentially Improper Storage of Equipment Unrelated to Agricultural Production Lilly informed the Committee that Code Enforcement wrote multiple tickets on the property for violations unrelated to the Town's easement. Lilly also recapped an email she received from Mr. Principi regarding his current activities on the property, wherein he reported that he moved the equipment off the DRS property and that he is still in the process of completing the work the Committee reviewed in 2022. The Committee discussed their recent observations of the property, including the fact that Mr. Principi moved the boats from the DRS to the DRI portion of the property but did not move other non-agricultural equipment from the DRS area. For example, the screening plant on the DRS area is a landscaping tool, not an agricultural tool, which is likely being used to screen gravel from topsoil. The Committee reiterated their concerns about potential topsoil excavation. The Committee also considered the possibility of instituting an expiration date for Committee determinations that a proposed use or structure is consistent with the relevant Town easement.This would require landowners to resubmit their use/structure applications if they did not complete the work reviewed by the Committee within a predetermined timeframe. The Committee directed Lilly to provide Code Enforcement with the Committee's concerns regarding the remaining equipment on the easement area. • Treiber Farms LLC SCTM# 1000-69.-1-9.1 — Follow Up Re: Artist Residency and Proposed Art Walk Lilly summarized a draft notice letter to Mr. Treiber, which explained that the Committee reviewed public posts demonstrating easement violations and directed Mr. Treiber to schedule a site visit within a designated timeframe. If Mr.Treiber does not contact Land Preservation, then Lilly will schedule a site visit and inform Mr. Treiber of the date and time. Lilly also explained that she did not involve Code Enforcement because neither Chapter 70 nor the Town's development rights easements defines a penalty for easement violations that do not violate other Town Code provision. • Flowers & Flores Farm LLC SCTM# 1000-55.-2-10.4 [Added to Agenda During Meeting] Eric asked whether the owner/lessee submitted any new structures applications for Committee review, because he observed hoop houses during his September monitoring visit that the Committee never reviewed. Lilly will follow up with the landowner to ensure that the owner complies with the applicable easement terms. Land Preservation Applications & Potential Applications: • EXECUTIVE SESSION- Proposed Acquisitions of Real Property Where Publicity Would Substantially Affect the Value Thereof MOTION made by Sam McCullough, seconded by Eric Keil, to enter into EXECUTIVE SESSION. Motion carried: 5/0 The LPC members entered into EXECUTIVE SESSION at 7:33 p.m. Meeting locked. o Lillian McCullough, Land Preservation Executive Assistant, gave updates on inquiries, new applications, appraisals and current applications. MOTION made by Eric Keil, seconded by Sam McCullough, to exit Executive Session. Motion carried: 5/0 EXECUTIVE SESSION ENDED at 9:01 p.m. Land Preservation Applications & Potential Applications -OPEN SESSION MOTION made by Eric Keil, seconded by Sam McCullough, to recommend that the Town extend a purchase offer to the landowner, as discussed while in Executive Session, for a development rights easement acquisition on a certain parcel of land at a price supported by the Town's authorized appraisal. The proposed offer is a recommendation to the Town Board and subject to the Town Board's direction to proceed. The offer letter to the landowner will be valid for 30 days.
