SCTM#1000 91-1-19, 20 & 21 ZBA #7888
The Planning Board has reviewed the requested variances and is not opposed to the
action for the following reasons:
1. The proposed transfer of Lot 20 will extinguish a single and separate
nonconforming lot in the R-40 Zoning District in a sensitive environmental area.
2. The split and transfer of the Lot 20 acreage evenly to Lots 19 and 21 would
increase the area and lot width of two nonconforming lots in the R-40 Zoning
District.
3. The subject parcels are in a FEMA Flood Zone AE (Structural Hazard Area).
Further expansion of structure within these areas is not recommended.
Conversely, structure in these areas should be minimized to prevent damage and
loss from storm events.
The Planning Board has considered the parcel location, surrounding community
character, existing build-out, and location of structures and vegetation on the parcels.

REASONS FOR APPEAL (Please be specific, additional sheets may be used

I. An undesirable change will not be produced in the CHARACTER of the
neighbor or a detriment to nearby properties if granted, because: the two owners (Lot
19 and Lot 21) did not want to see another house built on Lot 20 and they want to
make improvements to their homes. They bought the lot together and intend to split
the acreage to make each of their lots bigger. Their respective improved parcels
would be made larger, and each home could expand, as desired, with the additional
land purchased added to their parcel. They would prefer to avoid obtaining variances
for their homes if they have additional land.
2. The benefit sought by the applicant CANNOT be achieved by some method
feasible for the applicant to pursue, other than an area variance, because: The
improved parcels and new parcels are existing lots in Captain Kide Estates. The lot
sizes are pre-existing nonconforming. Based on the enclosed Single & Separate Title
Searches, the lots are all single & separate.
See 280-10 (3) If the lot is not on the maps described in former § 100-12,uthe
nonconforming lot has been held in single and separate ownership from July 1,
1983, to date.
3.The amount of relief requested is not substantial because: the improved lots will be
increased substantially (by 50%) and the center lot (Lot 20) will be extinguished,
the acreage added to the improved parcels and the improved lots will be "more
conforming".
4.The variance will NOT have an adverse effect or impact on the physical or
environmental conditions in the neighborhood or district because: the two
improved parcels will be increased in size and be made "more conforming" and
therefore the variance will not have an adverse effect or impact on the
environmental conditions of the neighborhood.

Property Location: 355 Sound Beach Drive, Mattituck CTM 99-1-19
SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type It category of
the State's List of Actions, without an adverse effect on the environment if the project is implemented
as planned.
PROPERTY FACTSIDESCRIPTION: The applicants' 7,500 square foot parcel has 50 feet along
Sound Beach Drive and lot depth of 150 feet. The applicants propose to demolish the existing
single family dwelling shown on the February 2, 2005 survey prepared by Joseph A. Ingegno (Map
No. 25-040).
A IS OF APPLICATION:. Building Department's October 20, 2005 Notice of Disapproval,
amended December 8, 2005, citing Section 100-244 in its denial of an application for a building
permit to construct a new dwelling, after demolishing the existing dwelling, for the reason that the
new dwelling will not have a total side yard area of 25 feet, when a minimum of 10 feet is shown on
a single side.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on January 26, 2006, at which
time written and oral evidence were presented. Based upon all testimony, documentation, personal
inspection of the property, and other evidence, the Zoning Board finds the following facts to be true
and relevant:
AREA VARIANCE RELIEF REQUESTED- The applicants wish to construct a new single-family
dwelling, after demolishing the existing dwelling. The new dwelling is proposed with minimum side
yards at 10.5 feet on each side yard, for a total of 21 feet instead of the code-required 25 feet.
REAS NS F R BOARD ACTION: On the basis of testimony presented, materials submitted and
personal inspections, the Board makes the following findings:
1. Grant of the variance will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. The replacement dwelling is centered and will

have a conforming yard on the westerly side, increased from the existing dwelling setback of 9.6
feet, to the new dwelling setback of 10.5 feet. The applicant's has modified the design from the
original plan to conform to the code required 20% maximum lot coverage, and it is designed in such
a way as to ensure that no undesirable change will be produced in the character of the
neighborhood.
2. The extent of nonconformance is minimal at four feet for the total side setbacks, given the
narrowness of the lot is 50 feet and the modest width of the proposed dwelling at only 29 feet.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for the
applicant to pursue, other than an area variance, based on the narrowness of the lot.
3. The variance granted herein is substantial, representing a reduction of four feet from the 25 ft.
total side yard requirement.
4. The difficulty is placing a new dwelling is related to the narrowness of the property.
5. No evidence has been submitted to suggest that a variance in this residential community will
have an adverse impact on the physical or environmental conditions in the neighborhood.
6. Grant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of a replacement dwelling, while preserving and protecting the
character of the neighborhood and the health, safety and welfare of the community.
RES LUTION OF TIME BOARD: In considering all of the above factors and applying the balancing
test under New York Town Law 267-13, motion was offered by Member Simon, seconded by
Chairwoman Oliva, and duly carried, to
GRANT the variance as applied for, as shown on the amended January 11, 2006 site map
prepared by James J. Deerkoski, P.E. and amended house diagrams dated 1/11106.
This action does not authorize or condone any current or future use, setback or other feature of the
subject property that may violate the Zoning Code, other than such uses, setbacks and other
features as are expressly addressed in this action.

E RA DETERMINATION; The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions,
without further steps required under SEQRA.
PROPERTY FACTSfDES RIPTION: The applicants' 7,500 square foot parcel has 50 feet along
Sound Beach Drive and lot depth of 150 feet. The applicants propose to demolish the existing
single-family dwelling shown on the February 2, 2005 survey, revised January 21, 2006 prepared by
Joseph A. Ingegno (Map No. 25-121 C).
BASIS OF APPLICATION: Zoning Code Section 100-32, based on the Building Department's May
1 , 2006 Notice of Disapproval, in its denial of an application for a building permit to construct a new
dwelling, after demolishing the existing dwelling, for the reason that the new dwelling will exceed the
code limitation for a maximum of two and one half stories.
FINDINGS OF F CT
The Zoning Board of Appeals held a public hearing on this application on July 27, 2006, at which
time written and oral evidence were presented. Based upon all testimony, documentation, personal
inspection of the property, and other evidence, the Zoning Board finds the following facts to be true
and relevant:

UESTEI : An area variance is requested to construct a proposed
dwelling that will be three stories above grade instead of tate required 2 1/2 stories. Applicant was
issued an area variance from the ZBA (#5825) which allows for construction of a replacement
dwelling with insufficient side yard setbacks due to the narrowness of the lot,
E S NS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and
personal inspections, the Board makes the following findings:
1. Grant of alternative relief will riot produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. There are other properties in the area with similar
construction,with the third level at the ground floor (non-habitable) in the neighborhood.

2. The benefit sought by the applicant cannot be achieved by some method, feasible for the
applicant to pursue, other than an area variance procedure. The subject property is located in an AE
flood zone and the foundation cannot be backfilled. In order to build a dwelling with a garage on this
narrow 50 ft. lot, the garage by code must be at grade. Living space will be located 9 feet above the
cement floor of the "basement/garage".
3. The alternative relief granted herein is not substantial. The proposed height of 34 feet 2 '/ inches
is within the code allowable 35 foot maximum height, and the applicant has agreed to install a full
fire suppression system.
4. The difficulty has not been self-created. The property is located in an AE flood zone which
restricts construction of a standard foundation.
5. No evidence has been submitted to suggest that the grant of the variance will have an adverse
impact on physical or environmental conditions in the neighborhood.
6. Grant of the requested variance is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of a replacement dwelling, while preserving and protecting the
character of the neighborhood and the health, safety and welfare of the community.
RES LLITION OF THE LOAF D: In considering all of the above factors and applying the balancing
test under New York Town Law 267-B, motion was offered by Member Leslie Kanes Weisman,
seconded by Chairwoman Oliva, and duly carried, to
DENY the variance for a dwelling with three stories, and to
GRANT ALTERNATIVE relief, allowing the applicant's construction plan at the requested
number of stories with the lowest floor (above grade) for non-habitable basement area, and
the remaining two floors as habitable area (floors above the ground floor), subject to the
following Condition: The dwelling shall be equipped with a full fire suppression system.
Any deviation from the variance given such as extensions, or demolitions which are not shown on the
applicant's diagrams or survey site maps, are not authorized under this application when involving
nonconformities under the zoning code. This action does not authorize or condone any current or future use,
setback or other feature of the subject property that may violate the Zoning Code, other than such uses,
setbacks and other features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that
does not increase the degree of nonconformity.

The Zoning Board of Appeals held a public hearing on this application September 1,2011,at which time written
and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property
and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and
relevant and makes the following findings:

1. Town Law 267-b ,3 b 1 . Grant of the variance will not produce an undesirable change in the character of
the neighborhood or a detriment to nearby properties. Several properties in this neighborhood have nonconforming
setbacks similar to this application. The adjacent dwelling to the west of the subject property has a front elevation
and front yard setback that is identical to the proposed addition and setback. The front porch roof deck will allow
the applicant to enjoy a water view which is a common amenity in this neighborhood. The proposed rear yard
second story addition will not be visible from the street.
2. Town Law 267-b d b' 2 ., The benefit sought by the applicant cannot be achieved by some method, feasible
for the applicant to pursue, other than an area variance. The existing dwelling is situated at 36 feet from the front
property line and any addition that would be functional would require a variance. The total side yards are existing
at 15 feet which the proposed additions will maintain.The second floor addition to the rear of the dwelling is above
the existing first floor and will not create additional lot coverage which is already non-conforming at 21%.
3. Town Law 267_ b ;J' , The variances granted herein for the proposed lot coverage and total side yard
setbacks are mathematically substantial requiring a 20% and 40% relaxation from the code, respectively. The
variance for the front yard setback is not substantial requiring an 11% relaxation from the code.However,the total
side yards are existing at 15 feet which the proposed additions will maintain and the existing non-conforming lot
coverage of 21%will be increased by only 2.9%on this small 7,500 sq. ft. non-conforming property
4. Town Law 267-b b 4l No evidence has been submitted to suggest that a variance in this residential
community will have an adverse impact on the physical or environmental conditions in the neighborhood. The
subject property is relatively flat and contains no naturally regulated features.
5. Town Law 267-b 3 . The difficulty has been self-created. The applicant purchased the parcel after the
Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the
limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase.
6. Town Law "2�7 b. Grant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of a front and rear additions while preserving and protecting the character of the
neighborhood and the health, safety and welfare of the community.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area(which includes all of Southold Town).
3. If any question in Section C on this form is answered "yes", then the proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a
determination that it is consistent to the maximum extent practicable with the LWRP policy
standards and conditions. If an action cannot be certified as consistent with the LWRP policy
standards and conditions, it shall not be undertaken.
A copy of the LWRP is available in the following places: online at the Town of Southold's
website (southoldtown.northfork.net), the Board of Trustees Office, the Planning Department, all
local libraries and the Town Clerk's office.
