Rich III, Chairman �� Members of the Planning Board Date; April 2, 2024 Re: Request for Comments Thermos, Barbara & Kapetanos, Alexandra SCTM#1000 91-1-19, 20 & 21 ZBA #7888 The Planning Board has reviewed the requested variances and is not opposed to the action for the following reasons: 1. The proposed transfer of Lot 20 will extinguish a single and separate nonconforming lot in the R-40 Zoning District in a sensitive environmental area. 2. The split and transfer of the Lot 20 acreage evenly to Lots 19 and 21 would increase the area and lot width of two nonconforming lots in the R-40 Zoning District. 3. The subject parcels are in a FEMA Flood Zone AE (Structural Hazard Area). Further expansion of structure within these areas is not recommended. Conversely, structure in these areas should be minimized to prevent damage and loss from storm events. The Planning Board has considered the parcel location, surrounding community character, existing build-out, and location of structures and vegetation on the parcels. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on January 26, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED- The applicants wish to construct a new single-family dwelling, after demolishing the existing dwelling. The new dwelling is proposed with minimum side yards at 10.5 feet on each side yard, for a total of 21 feet instead of the code-required 25 feet. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant's has modified the design from the original plan to conform to the code required 20% maximum lot coverage, and it is designed in such a way as to ensure that no undesirable change will be produced in the character of the neighborhood. 2. The extent of nonconformance is minimal at four feet for the total side setbacks, given the narrowness of the lot is 50 feet and the modest width of the proposed dwelling at only 29 feet. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance, based on the narrowness of the lot. 3. The variance granted herein is substantial, representing a reduction of four feet from the 25 ft. total side yard requirement. 4. The difficulty is placing a new dwelling is related to the narrowness of the property. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a replacement dwelling, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. FINDINGS OF F CT The Zoning Board of Appeals held a public hearing on this application on July 27, 2006, at which time written and oral evidence were presented. The subject property is located in an AE flood zone and the foundation cannot be backfilled. In order to build a dwelling with a garage on this narrow 50 ft. lot, the garage by code must be at grade. Living space will be located 9 feet above the cement floor of the "basement/garage". 3. The alternative relief granted herein is not substantial. The proposed height of 34 feet 2 '/ inches is within the code allowable 35 foot maximum height, and the applicant has agreed to install a full fire suppression system. 4. The difficulty has not been self-created. The property is located in an AE flood zone which restricts construction of a standard foundation. 5. No evidence has been submitted to suggest that the grant of the variance will have an adverse impact on physical or environmental conditions in the neighborhood. 6. Grant of the requested variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a replacement dwelling, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RES LLITION OF THE LOAF D: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Leslie Kanes Weisman, seconded by Chairwoman Oliva, and duly carried, to DENY the variance for a dwelling with three stories, and to GRANT ALTERNATIVE relief, allowing the applicant's construction plan at the requested number of stories with the lowest floor (above grade) for non-habitable basement area, and the remaining two floors as habitable area (floors above the ground floor), subject to the following Condition: The dwelling shall be equipped with a full fire suppression system. The existing dwelling is situated at 36 feet from the front property line and any addition that would be functional would require a variance. The total side yards are existing at 15 feet which the proposed additions will maintain.The second floor addition to the rear of the dwelling is above the existing first floor and will not create additional lot coverage which is already non-conforming at 21%. 3. Town Law 267_ b ;J' , The variances granted herein for the proposed lot coverage and total side yard setbacks are mathematically substantial requiring a 20% and 40% relaxation from the code, respectively.
