To:Amanda Nunemaker, Plans Examiner for the Town of Southold
For: Premises located at 1135 Shore Drive,Greenport NY 11944 SCTM 47.-2-15 ("Premises")
Dear Ms. Nunemaker,
I represent Silver Sands Holdings I LLC("Silver Sands")to resolve four(4)zoning violation tickets and help
align Southold Town Code ("Code")with the historic and proposed uses on the Premises and other
parcels on which Silver Sands operates its motel resort business. I look forward to collaborating on this
matter.
We are following your suggestions to provide you with this amended letter of intent, allowing you to
fulfill the interdepartmental communications required for the issuance of a notice of disapproval
("NOD")to be provided to the Southold Town Planning Board ("PB") and Zoning Board of Appeals
("ZBA").
The purpose of this letter of intent is to be able to speedily resolve our tickets, and expedite concurrent
applications before the PB and ZBA, which will ensure both actual and intended uses on the Premises are
compliant with Southold Town code and zoning.
Silver Sands intends:
1. To use the cottage (aka Cottage 33), which you currently designated as a 1-family residence
located on the Premises, as part of the proposed free-standing restaurant,which is a permitted
use on a Resort Residential property under Town Code Section 280-35;
2. To Install a commercial kitchen in Cottage 33;
3. To use the existing swimming pool on the Premises(approved by Suffolk County Department of
Health)as a commercial swimming pool.
4. To use the Boathouse building,which is currently considered to be an accessory structure on
same premises, as part of the proposed free-standing restaurant,which is a permitted use under
Town Code Section 280-35 Use Regulations on a Resort Residential property. We propose to
convert the loft apartment to an office and storage space for restaurant operations.
5. To move and alter a walk-in Mc LeL urrently placed adjacent to the Boathouse to a storage
building smaller than 144 Sq Ft and moved to a conforming location (and to withdraw all

6. To decide on a seasonal outdoor bar/bbq area as we may reflect in the applications,or not. P

Ok, I will update the file to indicate the walk-in cooler to be removed. If Silver Sands wants to apply for a cooler or any
type of storage shed, a building permit must be applied for. Again, Section 144-8A(2)(c) states; "Construction or
installation of one-story detached structures associated with one-or two-family dwellings or multiple single-family
dwellings (townhouses)which are used for tool and storage sheds, playhouses or similar uses, provided the gross
floor area does not exceed 144 square feet."

Dear Amanda
Thank you. With respect to the walk-in cooler—it is going to be entirely removed, deconstructed, and decommissioned.
If Silver Sands need to build a cooler as you suggested, they will happily apply for a building permit,which they should
be able to get from the BD without a problem, at a compliant location.
That was not the intent of the LOI.
What they would like to put up as I understand is just a storage shed pursuant to 144-8A(2)(c), not subject to
requirements of BP.
If not, and in that case, Silver Sands will comply with Code.
