No. 5179 - CHARLES SIDOROW ICZ ou ?on er Property Location: 3300 Cox Neck Road, Mattituck; Parcel 113-8-4. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 39115 sq. ft. parcel has a frontage of 80 feet along the east side of Cox Neck Road and is improved with a two-story frame house with accessory garage, as shown on the August 8, 1989 survey, amended June 24, 2002, by Peconic Surveyors, P.C. BASIS OF APPLICATION: Building Department's June 5, 2002 Notice of Disapproval, citing Sections 100- 30A.4 and 100-33, in its denial of a building permit to construct an accessory garage, after removal of the existing garage, on the grounds that the garage is proposed in a side yard. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on October 17, 2002 and December 12, 2002 for presentation of written and oral evidence. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: After removal of the existing 24' x 24' garage, applicant wishes to construct a new 26' x 26' garage with a setback of 6.7 feet between the most southerly corner of the garage to the side property line and 9.5 feet from the opposite corner of the garage to the side property line, as shown on the survey prepared by Peconic Surveyors, P.C. dated August 8, 1989, revised June 24, 2002. The height to the ridge of the one-story garage will be less than 15 ft, and is shown on the detailed plans prepared by Penny Lumber dated May 22, 2002 REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The existing garage is 24' x 24' and the alternative relief will allow a garage of the same size to be 8.7 ft. from the side Page 2—March 12, 2003 Appl. No. 5179—C. and C. Sidorowicz 113-8-4 at Mattituck line, instead of the 6.7 ft. requested by applicant. The garage proposed to be removed had overlapped the side property line which existed for many years, as shown on the October 16, 1978 survey prepared by Roderick VanTuyl, P.C. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicants furnished a copy of the Supreme Court decision dated September 15, 1999 indicating the land which contains the existing garage (proposed to be removed), slab/carport and two driveways was to be clarified by new deeds to reflect the applicants' ownership. 3. The relief requested is substantial because the entire garage is located in the side yard. 4. The difficulty is self-created because applicants became aware of the property limitations and limited yard area at the time of planning the new garage. 5. No substantial evidence has been submitted to suggest that the proposed garage will have an adverse impact on physical or environmental conditions in the neighborhood. By letter dated June 10, 2002, the Board of Town Trustees determined that the garage does not require a wetland permit under the Wetland Code Ch. 97. 6. Grant of the requested variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new garage, after removal of the existing garage, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Chairwoman Tortora, seconded by Member Goehringer, and duly carried, to DENY the relief requested for a 6.7 ft. side yard setback shown on the survey prepared by Peconic Surveyors, P.C. dated August 8, 1989, revised June 24, 2002. GRANT Alternative Relief for a proposed garage at 8.7 ft. from the side property line.
