This INDENTURE, made the 28h day of November, two thousand and twenty-two(2022)
Arthur J Bortz and Dana Filipowicz Bortz,husband and wife, and Dana Yolanta Filipowicz
Bortz as Executor of the Estate of Halina Filipowicz,all residing at 67 Dakota Dr., Hopewell
Junction,NY 12533,party of the first part, and
Diana E. Bortz as Trustee of The Bortz Family Irrevocable Trust,having an address of 67
Dakota Dr.,Hopewell Junction,NY 12533,party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten and no/100 ($10.00)
dollars, lawful money of the United States,and other good and valuable consideration paid by
the party of the second part,does hereby grant and release unto the party of the second part,
successors and assigns of the party of the second part forever,
ALL THAT certain plot, piece, or parcel of land, with the buildings and improvements thereon
erected, situate,lying and being in the Town of Southold, at Cutchogue, County of Suffolk, State
of New York,known as Lots 44,45,46, and 47 on a certain map entitled"Map of Eugene Heights
owned by Jacob F. Bowers,situate at Cutchogue,N.Y.,surveyed by Otto W.Van Tuyl, Surveyor,
Greenport,N.Y. October 12, 1928" and filed in the Office of the Clerk of Suffolk County as Map
No. 856 and known as Tax Map No. 136.-1-7.1 and described on the Schedule A attached hereto
and made a part hereof.
TOGETHER with a right-of-way 25 feet in width bordering the westerly boundary of said lots,
and all said right,title and interest of grantors' rights, in said right-of-way.
BEING the same premises conveyed by Edward F. Hindermann and Joan Hindermann to Artur
M. Filipowicz and Halina Filipowicz, husband and wife(Artur having died on 3/27/2013 and
Halina having died on 12/7/2017),and Arthur J. Bortz and Dana Filipowicz Bortz,husband and
wife, by deed dated 9/12/1994 and recorded with the Suffolk County Clerk on 9/23/1994 in Liber
11695 of Deeds at Page 531;
TOGETHER with all right,title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, and the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever,except as
aforesaid.
AND the party of the first part,in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust fiend to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose. The word "party" shall be

construed as if it read "parties" whenever the sense of this indenture so requires.
