MEETING OF APRIL 11, 1961.
The Southold Town Board met at the offic~,~of~ or~er M. 'Albert-
son at Greenport, N.Y. on Tuesday, April 1t,19611 'The meeting was called
to order at 3:00 P.M. with the following present:~.Supervisor Albertson;
CouD~ilmen Demarest and ~rathwohl; Justice Tuthill; TOWn Attorney Tasker;
Supt. of Highways Price and Town clerk Richmond.

WHEREAS, the Town Board has for the past= several months studied the
question of the institution of a tw~-~_s%at~Tm~tem of payment of real
property taxes in the Town of Southold and in connection therewith has
given comsideration to additional administration expenses which may be
incurred~as a result of such a system as well as the benefits which will
accrue to the taxpayers of the Town of Southold by the installment payment
of taxes, and
WHEREAS~ the Town Board believes that the conveniences and benefit to. the
taxpayers of the Town by the institution of a two-payment tax collection
system iWo~ld more th~ offset any additional administration 'expenses that
may be incurred and that the installment system of collection of taxes
would .be in the-interests of the people of the Town of Southold,
NOW, THEREFORE, BE IT RESOLV~: by the Town Board of the Town of Southold,
as foilers:
That after December 1st next suceeding, all taxes upon real
the tax roll shall be-due and payable and shall be and become
estate affected thereby, and shall be construe~ as and
deemed: thereon o~December 1st of each year, and not earlier,
and sh~tiremalin such~iens U~i~'paid. Provided, however, that there
shall be no penalty ~ 3one-ha~f?O~ all such taxes are paid to the receiver
of ~ore the~sucdeedihg 10th ~ay'of January and the second
[1 such taxes arepaid to the~e'ceiver of taxes on or ~efore
31st day of May. On all such~first one-half of taxes upon
remaining unpaid on the 10th da~ Of January, one percentum
the said one-half of the tax will be added, and mn addit-
ional onelpercentumwill be added for each month-thereafter, until the
return of the warrant to the County Treasurer. The second one-half of the
tax on real estate which is due on the preceding 1st day of December may
be paid without penalty on the 10th day Of May-or at any time thereafter,
until, ;bUt not including, the succeeding 1st day of June, providing the
first .one-half of such tax sh%ll have been paid or shall be paid at the
same time. The warrant annexed to the tax roll of the Town of Southold
shall be made to conform to the provisions of Section 13, Subdivision 5
of the Suffolk County Tax Act and the provisions of this resolution.

Section 2. This resolution shall take effect in~ediatel~, and shall be
subject to ~e~mi~§~> ~'~ferendum.

WHEREAS, the Burton Potter Post %185 American Legion has ~pplied to the
Town Clerk of the Town 6f Southold for a Bingo License, and
WHEREAS, the Town Board has examined-the application and after investig-
ating the matter, duly made findings and determinations as required by
Law, NOW, THEREFORE, BE IT RESOLVED: That the Supervisor be and he here-
by is authorized and directed to execute on behalf of this Board the
findings and determinations required by law and it is further
RESOLVED: That the Town Clerk be and he hereby is directed to issue a
Bingo License to the Burton Potter Post %185 American Legion.

WHEREAS, , THE Town Board of the Town of Southold, pursuant to due notice
thereof, held a public hearing on an application of the Long Island RaiD-
road Company for a franchise to operate an omnibus line on or over the
streets, highways and publicp~.&ces of the Town of Southold, Suffolk
New York, on Februa~'~2~.~, 1961, at which time all interested.,

persons were give~ an~opportunity to be heard, now therefore, be it
RESOLVED: That the Town Boardof the Town of Southold grant said franw
chise to the ~ong Island Railroad Company, subject to the following terms
~nd conditions:
A. That the route over which said omnibus shall operate shall b9 New
York State Route %25.
B. That no passengers shall be discharged in the Town of Southold.while
said omnibus is traveling in a westerly direction through said Town.
and that no passengers shall be picked up by said omnibus in the Town
of Southold while said omnibus is traveling in an easterly direction
through the Town of Southold.
C. That ~his franchise is contingent upon and subject to the Long Island
Railroad Company obtaining a.Certificate of Public Convenience and Necess-
ity to operate said omnibus line upon and over the Highways in the, Town
of Southold from New York State Publid Service Commission. In the event
that said Long Island Railroad Company fails to obtain said Certificate
of P~blic Convenience and Necessity from the New York State PublicServ-
ice Commission, then this franchise shall be null and v~id.~
D. That this franchise is g~anted ~ a term of two years from Apri!~ 11, 1961.
E. That the said, Long Islan-d-Railroad Company pay to the Town of SOuthold
the sum of thirty dollars 'a's~and' for a fee for the granting of.this
franchise.

Axien and Nell Rappa.
A letter was received from Mrs. Ann Currie-Bell thanking the BOard for

Board of Appeals of the TOWn of Southold expires on April 19, 1961, and
WMMREAS, in the past, as a member of the Board of Appeals Robert Bergen has
rendered the TOWn 6f Southold a most valuable service,
NOW, THERE~O~E, BE IT RESOLVED: That Robert Bergen be and he hereby is appoint-
ed as a m~mb~ of the Southold' Town Board of' Appeals for a term of five
years commencing April 19, 1961 and 'ending APril 19, 1966.

has rendered the Town of Southold 'a most valuable service,
NOW, THEREFORE BE IT RESOLVED: That Archibald Young be and he hereby is
appointed as a member of the Southold Town PlaD_uing Board for a term of
five years commencing April 30, 1961 and ending April 30, 1966.

A special meeting of the Southold Town Board was held at the Super~
visor's Office, 16 South Street, ~reenport, N.Y. on Tuesday, April
18, 1961, the members of the Board having wai~ed notice of the time,
p&ace and purpose of the meeting. The meeting was called to order by
the Supervisor at 1 P.M~ with the following present: .Supervisor Albert-
son; Councilmen Demarest and ~rathwohl; Justice Clark~

WHEREAS, a petition was received from Frederick C. Burnhardt, 20. Staten
Plaza, ~reat Neck, N.Y. requesting a change of zone of certain property
situated in Cutchogue, N.Y. and more fully described in said petition
from "A" Residential and Agricultural District to "M" Multiple Residence
District,
NOW, THEREFORE, BE IT RESOLVED: That the Town Clerk of the Town of
Southold be and he is hereby directed to transmit this petition to
the Planning Board in accordance.with Section 901, Subdivision C of
Article IX of the Building Zone Ordinance of the Town of Southold.

Lane, Cutchogue,. N.Y. be and hereby is granted for year round occupancy
for a two-year period.

N.Y., now, therefore, be it
RESOLVED: That apublic hearing ~ill be held by the Southold Town Board

Wednesday, May 3, 1961, at 7:30 P.M. on the following proposed amend-
ment to the Building Zone Ordinance of the Town of Southold, including
the Building Zone Maps, to wit:

of beginning being 280 feet more or less southerly from the highwater
mark of Long Island Sound, from said point of beginning running thence

WHEREAS, Herbert L. Kalin and LlOyd C. Kalin heretofore filed a petition
with the Town Board dated t~e llth day of April, 1961,~

to change the zone of the premises described in said petition from
"A" Residential and Agricultural District to "B" Business District, and
WHEREAS, ~he Town Board by resolution duly adopted on the 18th day of
April,-'1961, referred the petition to the Southold Town Planning Board
width a written request instructing the Planning Board to prepare an
official report on said matter in compliance with.Section 901 of the
Building Zone Ordinance of the Town of $outhold, and
WHEREAS, the said Planning Board has filed its official report with the
Town Board dated the t8th 'day of April, 1961, wherein the Planning Board
recommends that the premises of Albert Herzog, Jr. lying west of the
Kalin property be included in the "B" Business District, and
WHEREAS, t~'Town Board is of the opinion that it would be intthe public
interest to change the zpne of the premises of Herbert L Kalin and Lloyd

amend the Building Zone Ordinance of the Town of Southold including the

southeasterly corner of land of the Village of ~reenport; thence along
the westerly line of land now or formerly of Sledjeski; South 2 degrees

official report thereon to the provisions of Article IX, Section 901,
of the Building Zone Ordinance of the Town of Southold.
