The Southold Town Board met at the office of Supervisor Lester M. Albertson at Greenport, N.Y. on Tuesday, March 28, 196~. The meeting was called to order at 3:00 P.M. with the following present: Supervisor Albertson; Councilmen Demarest and Gtathwohl; Justices Tuthill and clark;~Town Attorney Tasker and supt., of Highways and Town Clerk Richmond. Moved'By Justice Clark; seconded by Councilman Demarest: RESOLVED: That the minutes of the meeting of March 7, 1961 be and they hereby are duly approved. Vote of Town Board: Ayes-Supervisor Albertson; C6uncilmen Demarest and Grathwohl; Justices Tuthill and Clark. Moved by Justice Clark; seconded by Councilman Demarest: RESOLVED: That the regular monthly meeting of the Town Board be held at the Supervisor's Office, 16 South Street, Greenport, N.Y. on Tuesday, April ~1, 1961, at 3 P.M. Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest andGrathwohl; Justices Tuthill and Clark. Movedby Justice-Tuthill~ seconded by Councilman Demarest: WHEREAS, the annual budget for the current fiscal year includes an appropriation in the amount of $7,115.46 for the East West Greenport Fire Protection - Fire, and W~EREAS,. ~f such sum so appropriated, $6,765.46 thereof remains unexpended to date, and W~EREAS, after due allowance for outstanding claims and for further expenditures chargable against such appropriation or account, there is an unexpended balance in said appropriation or account in the amount of $1197.91, be it RESOLVED: that $40.00 of said unexpended balance be and the same here- by is- :ansferred to the East-West Fire Protection- Water account or fund, that the amount heretofore appropriated for such purpose be and _ is increased by the amount of $40.00. Moved by Justice Clark; seconded by Councilman Grathwohl: WMEREAS, certain checks drawn on the General Fund of the Town of Sout~ old ~rior to 1959, namely checks % 182,940,2074,6756,2226,2238 ~nd 4651, a total of $60.01, have not to date been presented for payment andare presumed 19st, now, therefore, be it RESOLVED: That the a~ove listed checks be cancelled and the total amount of said!checks ($60.01) be redeposited in the General Fund. Moved by Conncilman Demarest; seconded by Justice Clark: WHEREAS, the Board of Assessors of the Town of Southold has requested permission to attend a school for Assessors at no? cost to the Town of Southold, said school to be held April 16 and 17, 1961, now therefore, be it RESOLVED: That the..Town'Board of the Town of Southold does hereby grant such permission. Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and Grathwohl; Just±ces ~thill and'Clark. Moved by Councilman Demarest; sec0~ded by Justice Tuthill: WHEREAS, the budget for snow removal, Item 4'; Highway; for the Year 1961 was set at $16,000.00, and '~ W~EREAS, due-to the severity of the winter this amount has not been sufficient to cover expenses, and ~' WHEREAS, as-of January 1, 1961 'there was in Item 4, Highway, an unexpend- ed balance of $2441.10, now, therefore, be it ~' ~' RESOLVED: PThat this balance of. $2441.10 be released for use. Robert Douglass appeared, before.the Town Board requesting a sign be erected on King Street, Orient, N.Y~ on~a blind drive used by'his~ truckS,~-S~pt. of Highways Price said he would take care of the matter, Stanly Corwin appeared before the Town Board with a petition, requesting a two-payment tax system. Supervisor Lester M. Albertson informed Mr. Corwin that the Board had been working on a two-payment system ~or~S0me time and it would, not. doubt be in'effect in the near future. Moved by Justice Clark; seconded by Councilman Demarest: WHEREAS, the SouthOtd ~oard of~ Education requested the Town Board ~to widen Oaklawn Avenue where the Southold High School is located, RESOLVED: That the TOWn Board meet With the'Board of Education to discuss this matter. Vote of Town Board: Ayes-Supervis='Albertson; Councilmen Demarest and Grathwohl; J~stices Tuthill and clark. At 3:30_P.M. in accordance with a notice published according to-law, bids were opened for purchase of 75,000 gallons of special gradegasotine. the following bids were submitted: G.L.'F.-.025 per gallon off'the posted consumer's tank wagon price in Riverhead on ~he day ofdelivery (exclud- ing .state and Federal Tax) and R. A. McCollum - .1486 per gallOn'~ Moved by Councilman Demarest; seconded by Justice Clark: WHEREAS, R. A. McCallum, Socony Mobil ~il Company, was the lowest bi~der for the 75,~00 gallons of special grade gasoline, RESOLVED: That Supervisor Lester M. Albertson be and herebY~is d-irec~ed to enter into a contract~With R. A. McCallum, Socony Mobile Oil Co%, -- for the purchase of 75,000 gallons of special grade gasolin~e~at~a pride of .1486 cents per gallon for the~use by'the Southold-Town ~Police-and the Southold Town Highway Department or as-much thereof as may'~e~re- quir~dd, during the period fromiAprii 1, 1'961' to March 3t, 196~. Moved by Councilman Demarest; seconded by Justice Clark: RESOLVED: 'That the, Supt,. of HighwaYS of the Town of Southold be'-a~thor~ ized to advertise for bids and purchase from the lowest responsible bidder, 2000 ton or as much thereof as may be needed of 3/8 blue stone, for the repair of the Town Highways from April 15,1961 to Dec.31,1961~. Moved by Justice Tuthill; seconded by Councilman Demarest: RESOLVED: That the Supt. of Highways of the Town of Southold be author- ized to. a~vertise for bids and purchase from the lowest responsible bidder, 400,000 gals of Asphalt Road Material, or as much thereof as may be needed,~ 20,000 .gals. or as much thereof as maybe needed, to be delivered to Fishers Island for the repair of Town Highways frDm April 15, 1961 to December 31, 1961. Moved by Justice 'Tuthill; seconded by Councilman Demarest: WHEREAS, Elliott Winter has applied to the Town Board for a single trailer .p~mit dated March 28, 1961, NOW,-,~THEREFORE, BE IT RESOLVED: That the application of Elliott Winter to locate a single trailer on the property of Adam V. Moved by Comncilman Demarest; seconded by Justice Clark: RESOLVED: That the Town Clerk of the Town of Southold be and he hereby is directed to request the Long Island Lighting Company to remove one 100 cp street light and install one Mercury vapor street light on pole 2-7J NYT Co. on King Street, Orient, N.Y. in the Orient Lighting District. Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and Grathwohl; Justices Tuthill and Clark. Moved by Councilman Grathwohl; seconded by Justice Clark: WHEREAS, W~ Harry Lister as President of Boatman's Harbor applied to the Town Board for financial assistance in dredging the entrance of Wickham Creek, a Town waterway, now, therefore, be it RESOLVR~: That Supervisor Lester M. Albertson be and he hereby is author- ized to contribute half of the cost up to but not to exceed the sum o£ $475.00 toward the cost of dredging the entrance of Wickham Creek at Fleet~s Neck, Cutchgue, Town of Southold, N.Y. Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Bemarest and Grathwohl; Justices Tuthill and Clark. Moved by Justice Tuthill~ seconded by Councilman Grathwohl; WHEREAS, Procan, Inc., William Baxter and Martin Filla by petition =erified Jan. 23, 1961, requested a change of zone of certain property situated on Main Road, Mattituck, N.Y. and more fully described in said petition from "A" Residential and Agricultural District to "B" Business District, and WHEREAS, this request left a 60 foot section zoned "A" Residential and Agricultural District , and WHEREAS, at a meeting held on Feb. 14, 1961, the TOWn Board made a motion to zone all this property on its own motion from "A" Residential and Agricultural District to "B" Business District, and ~r6EREAS, the said resolution was referred to the Planning Board for its recommendation and report, and W~KREAS, the Town Board pursuant to ~ue notice thereof held a ~earing thereon on March 23, 1961, at which time all interested persons were given opportunity to be heard, minutes of which were recorded by Judith Boken, NOW, THEREFORE, BE IT RESOLVED: That the Southold Town Building Zone Ordinance, including the Building Zone ~aps, be amended by changing from "A" Residential and Agricultural Distrcit to "B" Business District the following described property: ALL that certain tract or parcel of land situated at Mattituck, in the Town of Southold, Suffolk County, New York, and more particularly bounded and described as follows: BEGINNING at ~ intersection of the northerly line of Main Road with the westerly line of Elijah's Lane and running thence northerly along said westerly line of Eli~ah's Lane 495 feet, more or less, to land of Maston; thence westerly along the southerly line of land of said Maston and its extension 474 feet, more or tess, to land of Boleslaw Kruk; thence s°Utherlyalong said land of Boleslaw Kruk, 263 feet~ more or less, to the northerly line of ,Main Road; thence easterly along · said line of Main Road 557 feet, more or less, to the point of'beginning.
