The Southold Town Board met at the office of the Supervisor, Lester~M.
A%bertson, at Greenport, on Tuesday, March 7, 1961, at 3:00 P.M. with
the following present: Supervisor Albertson; Councilmen Demarest and
Grathwohl; Justices Tuthill and Clark; Supt, of Highways Price; Town
Attorney Tasker and Town Clerk Richmond.
Movedby Councilman Grathwohl; seconded by Councilman Demarest:
RESOLVED: That the minutes of February 14, 1961 and the Special Meeting
of February 1Z, 1961 be and they are hereby duly approved as read,

RESOLVED: Thatthe regular meeting of the Town Board will be held at
the office of the Supervisor, Lester M. Albertson, 16 South Street,
Gre~nport, N.Y. on Tuesday, March 28, 1961, at 3:00 P.M.

WHEREAS, Southold Town Planning Board has prepared an official report
and recommendation upon the petition of Procan Inc., William Baxter
and Martin Filla requesting a change of zone of certain property situ-
ated on Main Street, Mattituck, N.Y. and more fully described in said
petition from "A" Residential and Agricultural District to NB" Business
District, and
WHEREAS, this request left a 60 foot section zoned "A" Residential and
Agricultural District, and it was the opinion of the Town Board that
this 60~foot piece should be zoned "B" Business District,
RESOLVED: That the Town Board zone all this property on its own motion
from "A" Residential and Agricultural District to "B" BusineSs District,
and be it further,
RESOLVED: That a public hearing will be held by the Sour hold Town Board
at the Supervisor's Office, on Thursday, March 23, 1961, at 7:30 P.M.
on the above mentioned petition and thattthe Town Clerk be and he here-
by is authorized and directed to cause a notice of said hearing, to be
published in the Suffolk Times pursuant to the requirements of Iaw.

WHEREAS~ ~outhold Town Planning Board has prepared an official report
and recom~eadation upon the petition 6f George Alec for a change of zone
from "A" Residential and Agricultumal District to "M" Multiple Residence
,District on certain real property situated in Cutchogue, N.Y.
NOW, :THEREFORE, BE IT RESOLVED: That a public hearing will be held by
the Southold Town Board at the Supervisor's Office, on Thursday, March
30~1961, at 7:30 P.M. on the above %mentioned petition and that the
Town be and he hereby is authorized and directed to cause a notice
o~ ' to be published in the Suffolk Times pursuant to the

Pursuant to Section 303, Subdivision 4 of the Multiple Residence Law,
the Supervisor approved the assignment of the following persons as~fire

RESOLVED: That Supervisor Lester M. Albertson be and he hereby is
authorized to purchase one tranquilizer gun for the use of DOg ~Warden.

WHEREAS, land of Frank McBride adjoins the Town Dump, and .~,
WI~REAS, this strip of land adjoins land already owned by the Townof
Southold,
NOW, THEREFORE, BE IT RESOLVED: That Supervisor Lester M. Albertson.and
the-Dump Committee investigate the possibility and advisability of pur-
chasing this strip of land and report to the Town Board.

RESOLVED: That Supervisor Lester M. Albertson be directed to convey
to the Suffolk County Board of Supervisors that the Town Board of the
Town of Southold, after due consideration and favorable comment from
the Southold Planning Board, go on record as being in favor of the
formation of Suffolk County Airport Authority and that the Town of
Southold be included in said authority.

WHEREAS, the Supt. of Highways has advised the TOWn Board thata~serious
highway drainage condition exists in the vicinity of the north end of
Depot Lane, in Cutchgoue, N~Y., in the Town of Southold, and
WHEREAS, the Supt. of Highway recommends that the Town acquire a pa,rcel
of land in this area for the purpose of h~ghway drainage,
RESOLVED: That the Highway Co~,ittee and Supervisor Albertson investigate
the situation and report to the Town Board:

WHEREAS, it has-been necessary, due to an increased work load, at the
office of the Town Assessors and Tax Receiver to employ part time help
for several years, and
WHEREAS, THIS work has increased to such proportions that it now be-
comes necessary to employ a full time clerk,
NOW, THEREFORE, BE IT RESOLVED: That the Town Board of the Town of
Southold does hereby create the position of clerk on a rut1 time basis
to assist the Board of Assessors and the Tax Receiver.

WHEREAS, it appears by an eligable list of the Suffolk County Civil Serv-
ice Commission dated February 23, 1961 that Mildred Chapman is eligable
for the appointment of Clerk to act in such capacity at the Assessors'
and Tax Receiver's Offices, Southold, N.Y.
NOW, THEREFORE, BE IT RESOLVED: That Mildred Chapman be and she hereby
is appointed to the position of Clerk in the Assessors' and Tax Receiver
Office, and be it further
RESOLVED: .That Mildred Chapman be compensated for such services in the
amount of $4000.00 per year payable in regular monthly payments, and be
it further
RESOLVED: That the effective date of such appointment be March 1, 1961.

RESOLVED: Thattthe Town Clerk be and he hereby is directed to request the
Long Island Lighting Company to re~lace 100 cp lights on pole $21 NTT-
Village .Lane and pole 169 NYT-Main Road and Platt's Road with mercury
vapor Lights and install mercury vapor light on pole $3-Orchard Street,
all in the Orient Llghting District.

RESOLVED: That Supervisor Lester M. Albertson contact the Agriculturel
Department and request any action necessary to control the spread of
Dutch Elm Disease in the Town Of Southold.

RESOLVED: That Supervisor Lester M. Albertson be and he hereby is author-
~zed.and directed to advertise for bids for 75,000 gallons of special
grade gasoline for Highway and Police purposes, fo~thefpeti~d~from
4/1/61 to 3/31/62, said bids to be opened at 3:30 P.M. on March 28, 1961
at the Supervisor's Office, 16 South Street, Greenport, N.Y.

WHEREAS,, Desire B. Layman applied to the Town Board for some~ financial
assistance in dredging at the entrance of Dam Pond, East Marion, N.Y.,
NOW, THEREFORE, BE IT RESOLVED: That Lester M. Albertson, Supervisor, be
and he hereby is authorized to contribute half of the cos~ up to but not
to.exceed the sum of $475.00 toward the most of dredging Dam Pond at
East Marion, Town of Southold, N.Y.

WHEREAS, the Cutchogue Fire Department has asked permission of the Town
Board to holdthe North Fork Fireman's Association Annual Drill and Field
Day%in New Suffolk, N.Y. on July 1, 1961, and
WHEREAS, Grathwohl Road was chosen as the site to hold this affair and to
place a~hydrant on the west side of this road, and
WHEREAS, the Drill Committee will carry the necessary insurance to cover
-the Town.of Southotd,
NOW, T~EREFORE, BE IT RESOLVED: That the Cutchogue Fire Department be
granted'permission to use Grathwohl Road and to place a hydrant on said

road upon the condition that liability insurance protecting the Town of
~Southold be obtainedby said Department. '

RESOLVED: That the General Bills in the amount of $14,444.03; Lighting

Bills in the amount of $7,918.23; E-W Fire District Bill in the amount
of $6,765.46 be and the same are hereby ordered paid.

The Town Board reconvened at the Sup~visor'S Office, 16 South Street,

The Public Hearing on proposed amendments of the Southold Town Ordinance
entitled "Boat Ordinance of the Town of Southold" was opened by the
Supervisor at 7:00 P.M. The minutes of this hearing were recorded by
Judith Boken.
Moved by Justice Clark; seconded by Councilman Demarest:
WHEREAS, pursuant to a resolution duly adopted by the Town Board on'the
14th day ofFebruary,-1961, a publichearing was held by the Town ~Board'
of the Town of Southold on the 7th day of March, 1961, at 7 o"clock P.M.
of said day on the matter of the adoption of the following amendments to
the Southold Town Ordinance entitled "Boa~ Ordinance of the Town.of
Southold". and
WHEREAS, the Town Board deems it in the best interest of the Town of
Southold that the following amendments be adopted, now, therefore, belt
RESOLVED AND ORDAINED by the Town Board of the Town of Southold ~that
Southold Town ordinance entitled "Boat Ordinance of the Town of Southold'~
be amended as follows:
I. By amending Section 7 subdivision (a) to read as follows:
(a) No person shall operate a vessel for towing a person on ~ater skiis,
a surfboard or similar device unless there is in such boat~or Yes,et a
person, other than the operator, Of at least ten years of age, in a~p~-
ition to observe the progress of the person being towed.
II.By amending Section 7 subdivision (b) to read as follows:
(b) No person shall rid~ on water skiis, a surf-board or similar device
or use or operate a boat to tow a person t~zeon between the ~ed'of one
hour after sunset to one hour after sunrise.
BE IT FURTHER RESOLVED: That the Town Clerk of the Town of Southold cause.
the foregoing amendments ~o be ~ntered in the minutes of the Town Board,
and cause a copy specifying the date'of adoption thereof to be entered ~in
the ordinance book of the Town of Somthold, and that the Town Clerk f~rther
cause a copy of said ordinance to be published once in the The Suffokk Times,
a newspaper published in the Town of Southold, and a copy thereof to
posted on the signboard maintained by the Town Clerk, and thataffidavits
of such publication and posting be filed with the Town Clerk, and
BE IT FURTHER RESOLVED: That the Town Clerk cause a copy of the fore-
going amendments to be submitted to ~and approved in writing by the
Conservation .Com~issioner of the State of New York, pursuant to the
provisions of Section 130 of the Town Law.

appropriation in the amount of $7,115.46 for the East West Greenport
Fire Protection - Fire, and

unexpended to date, and
WHEREAS, after due allowance for outstanding claims and for further
expenditures chargable against such appropriation or account, there is
an unexpended balance in said appropriation or account in the amount
