Application having been duly made for the laying out of town highways in the Town of Southold, Suffolk County, New York, known as Tabor Road and Rachael's Road, and a dedication and release from the owner of the land through which the highways are proposed to be opened having been given; NOW, THEREFORE, I, the Town Superintendent of Highways of the Town of Southold, Suffolk County, New York, do hereby determine and order that all those certain streets and roads known as Tabor Road and Rachael's Road, situate, lying and being at Mattituck, Town of Southold, Suffolk County, New York, bounded and described as set forth in Schedule A annexed hereto, shall be and the same hereby are laid out in said Town as town highways. After examining the documents, I have the follow- ing comments: 1. The documents grant as to the westerly termini of Rebeka's Road and Tabor Road, an "easement". I believe that the conveyance of these strips should be of the same character as the dedication of the streets in question. 2. With respect to Rafihael's Road, the documents contain no easement for a turn-around at the westerly terminus of this road. 3. The deed conveys the "park and ' " recreation area to the Town of South- old. It has not been the practice for the Town of Southold to take title to park and recreation areas. 4.
