Albertson at Greenp0rt on Thursday, January 26, 1961 at 7:30 P.M., with the following present: Supervisor~Albertson, councilman Demarest, Justices Tuthill ardClark, Superintendent of Highways Price, Town Attorney Tasker and Town cler~ Richmond. At 7:30 P.M. the Supervisor opened the public hearing authorized pursuant to a r~solution of the Board adopted on ~e 15th~day of December 1960, on the change of zone from "A" Residential and Agri- cultura~ District to "B" Business District on certain property in Mattituck in the vicinity of the intersection of'Sound Avenue, Middle Road and Cox Neck Road. Also .by amending the Southold Town Building Ordinance. The minutes of this hearing were recorded by George T. Lederle. The following letters were read from the Southold Town Planning Board: January 13, 1961, Gentlemen: The Southold Town Planning Board wishes to make the following r~commendation to the ~outhold Town Board: It is suggested that all small islands, not show~ on the zon%ng map, either natural or man made, now or in the future,i be interpreted to take the highest zoning category, namely "A" Residential"and Agri- cultural District. ' Th~ following resolution was offered by Justice Ralph Tuthill, who moved its adoption, seconded by Justice Henry A. Clark; to wit: WHEREAS, the Town Board of the Town of Southold he~etof0re authorized the issuance of a deferred~payment note~in the amount of $20~000.00 pursuant to a resolution adopted o~ February 2, 1959, in connection with the purchase of' real estate for'use ~s public bathing beach and recre~ti0n areas which said~note was dated an'd issued on March 3, 1959; to the First National ~ahk of ~reenport~ New York (now The Valley National Bank of-Long Isl'and), 'and WHEREAS, by the terms 'of said-dsferred'pa~ent ~n0t~ resolution dated February 2, 1959, the deferred payment 'note authorized pur- suant thereto provided for'the payment or'not less"than-'20% of ~ the aggregate principal amount of said note, together w~th' interest at the rate of 2-1/2% per annu~, and 4 07 WHEREAS, pursuant thereto,-the sum of $4,000.00 was paid on account of said note on March 3, 1960, and a renewal of said note in the principal amount of $16,000.00 was.then,executed and delivered by the Supervisor to The Firs~ National Bank. of Greenport, New York (now .The~Valley National Bank of Long Island) and saidnote is due and paya~!e on March 3, 1961, and the Town Board desires t'O pay the sum of not less than 20% of th'e aggregate principal amount of said note, to wit, the sum of $4,000.00 and to issue a renewal deferred Payment note for the unpaid balance of.prin'c%paI due'thereo~, to wit, the sum of $12,000.00' NOW, THEREFORE, BE IT RESOLVED that the Town 'Board of the Town of Southold, Suffolk County, New York, does hereby authorize the issuance of a deferred payment note in'the prinqipal amount of $12,000.-00 for a term of one year with interest at the rate of 2-1/2%, payable aG maturity, and BE IT FURTHER RESOLVED, that the power to sell such deferred payment note is hereby delegated to ~he Supervisor,~ the chief fiscal officer. Such note shall be of such terms, form and contents, and shall be~ sold in Such~manner, as'may be'prescribed by:the'Supervisor, c'onsistent with the pr~6~i~'i0ns of the Local Finance Law. The question of the adoption of the foregoing resolution was duly put to a vote on roll call, which resulted as follows: Supervisor Lester Albertson voting yes; Councilman Louis Demarest voting yes; Justice Ralph W. Tuthill~voting yes; JustiCe Henry A. Clark voting yes. The resolution was thereupon declared duly adopted. 'The T~wn Clerk received the resignation of Corwin C. Grathwohl, Commissioner of~the Cutchogue-New SuffOlk Park District, effective January 26, 1961. Moved by Justice Clark~ seconded by-Justice Tuthill: WHEREAS, a vacancy exists in the office of Councilman of the Town of Southold, Suffolk County, New York, caused by the resign- a~ion-:of Lester M. Albertson who was elected to such office on the -~d-day of November 1959, NOW THEREFORE BE IT RESOLVED, that pursuant to the authority ~es~ed'in ths Town Board pursuant to the-Provisions'of Section 64 of the Town Law, that CorWin C. Grathwohl be and he hereby is appointed~to the offic~ of C~uncilmanl~of the Town'of Southold'~to fill the vacancy existing in said office, and that such appointment shall ta~e effect immediately and the said Corwin C Grathwohl shall hold such office until January~l, 1962. COUNTY OF SUFFOLK, NEW'YORK, as follows: This Bo~d favor~ and recommends the enactment 'Of the following legislation to permit institution of four year"terms for all elective town officers, on a local option ba,sis: An Act to amend the Town Law, in relation to empower- lng. Town in Suffolk County'to establish four ~ear terms of .office for elective town officers. The' people of the'State of New York, represented in Senate and~Assembty, do enact as follows: SECTION 1. The Town Law is hereby amended by adding thereto a new sect.ion-, to be section twentyrfour-B, to read as follows: S-24-B Notwithstanding the provisipns-of section twenty-four of this chapter or any other.general l~w, and at leas~ one hundred fifty days prior to any biennial town election, the Town Board of any-~to~n-of the first class or second class in Suffolk County, may -~adopt a resolution, to. provide that the term of,office of each elected town official thereafter elected shall be four years, and such.~esolution shall be submitted to the qualified electors of the town~ for their approval or d~sapproval at the. ne~t. biennial town' election. No such resolution shall become effective, until approved by the affirmative vote of the majority of the qualified electors of the town voting on such proposition. The submission of such proposition shall be as provided in Article Seven of this chapter _for a referendum thereunder in _like manner as if a petition therefor 'had been filed in accordance with the provisions of this chap~er~-except that ~_s~c~ proposition shall be submitted only at a biennial town election as hereinbefore p~ovided. If the Town Board shall have adopted such a resolution and if a majority of tt~e voters cast on any such proposition when submitted as herein provided shall be in the affirmative, the te~ms of office of all to_wn of, ficers thereafter elected shall be for a period of four years.
