TRUST,dated September 10,2007 and any amendments thereto,as to Fifty Percent(50%)interest,having an address of 8
Hardwick Drive,South Huntington,NY 11746,as tenants in common with NO right of survivorship,
parry of the first part,and
BONNI BERGER,Trustee,or her successors in trust,under the MILDRED BERGER LIVING TRUST,dated September 10,
2007 and any amendments thereto,having an address of 80-02 Little Neck Parkway,Floral Park,NY 11004,
party of the second part,
WITNESSETH,that the party of the first part,in consideration of Ten Dollars and other valuable consideration paid by the
party of the second part,does hereby grant and release unto the patty of the second part,the heirs or successors and assigns of
the party of the second part forever,
ALL that certain plot,piece or parcel of land,situate,lying and being more particularly described in the Schedule A attached
hereto and made a part hereof.
Town of Southold,County of Suffolk and State-of New York, known and designated as Lot 24,as shown on a certain
map entitled"Map of Southold Shores at Arshomomaque Town of Southold,Suffolk County,New York"made by Otto W.
Van Tuyl and Son,Licensed Land Surveyors,Greenport,N.Y.,dated July-1,1963 and filed in the office of the Clerk of the
County of Suffolk 8/29/63 asMap.No.3853.
SAID premises being known as 285 Blue Marlin Drive,Southold,NY
BEING and intending to be the same premises conveyed to the party or the first part by deed dated September 10,
2007 and recorded on September 20,2007 in Book 12523 Page 280.
TOGETHER with all right,title and interest,if any,of the party of the first part in and to any streets and roads abutting the
above-described premises to the center lines thereof;TOGETHER with the appurtenances and all the estate and rights of the
party of the first part in and to said premises.TO HAVE AND TO HOLD the premises herein granted unto the party of the
second part,the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said
premises have been encumbered in any way whatever,except as aforesaid.
AND the party of the first part,in compliance with Section 13 of the Lien Law,covenants that the party of the first part will
receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied
first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
AND the party of the first part covenants as follows: that said parry of the first part is seized of the said
premises in fee simple,and has good right to convey the same,that the party of the second part shall quietly enjoy the said
premises;that the said premises are free from encumbrances,except as aforesaid;that the parry of the first part will execute
or procure any further necessary assurance of the title to said premises; and that said party of the first part will forever
warrant the title to said premises.
The word"party"shall be construed as if it read"parties"whenever the sense of this indenture so requires.
