SOUTHOLD TOWN BOARD MINUTES Mee~ting o~ October 26, 1971 The Southo~d Town Board met at the office of Superv~s0r Albert M. MartocchiD, 16 South Street, Greenport, New York, on Tuesday, October 26, 1971 at 3:00 P.M., with the following ~present~: Supervisor Albert M. Martoccbia, Councilman James H.~ Rich, .Jr., Councilman Howard C. Valentine, Justice Martin Surer_, Custice Louis M. Demar~st, Town Attorney Robert W~ Tasker, Supt. of Highways Raymond C. Dean, and Town Clerk Albert W. Richmond. Absent: Justice E. Perry Edwards. Moved by Justice Demarest, seconded by Justice Suter, it was RESOLVED: That the minutes of the Southold Town Board meeting of October 12, 1971 be and they hereby are approved. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman V~entine, Justiee Suter, Justice Demarest. Mo~ed by Councilman Valentine, seconded by Councilman Rich, it was RESOLVED: That Supervisor Albert M. Martocchia be and he hereby is authorized to enter into a contract for quarters for the Narcotic Council with Mr. Thomas Jernick, at a sum of $150.00 per ~nth. Vote of the Town Board: Ayes: Supervisor Martocchia,- Councilman Rich, Councilman Valentine, Justice Suter, Justice Demarest. Moved by Justice Demarest, seconded by Justice Suter, it was RESOLVED: That Supervisor Martocchia be authorized to notify the Morgan Guaranty Trust Company to release from Southold To~rn Escrow Accounn E29554, to the free control of the Security National Bank, the following: $100,000, Oyster Bay CSD ~3, BOND 3.60, dd 12-1-61, due 12-1-77, and accept in substitution: $100,000, Babylon UFSD ~6, RAN 4.12, dd 8~17-71, due 6-30-72. Vote of the Town Board: Ayes: Supervmsor Martocchia, Councilman Rich, Councilman Valentine, Justice Suter, Justice Demarest. Moved by Justice Surer, seconded by Councilman Rich, WHEREAS,U~ion Free School District ~9, Town o~ Southold, Suffolk County, New York, has made application to the Town Board to dedicate a certain highway at Mattituck, New York to be known as School House Lane, more fully described in said petitmon, together with release executed by the owners thereof, and WHEREAS, the Highway Superintendent has mnspected the said high- way and has advised the Town Board that said proposed highway complies in all respects with the specifications for the dedica- tion of highways in the Town of Southold, NOW, THEREFORE, BE IT RESOLVED: That in accordance with Section 171 of the Highway Law of the State of New York, consent be, and the same is given, to the Superintendent of Highways to make an order laying out the aforesaid highway to consist of lands desc~ibe~ in said application as shown on certain ma~s attached to said application, and BE IT FURTHER RESOLVED: Tha~ the Town Clerk be and he hereby is authorized and directed to forthwith cause the dedication, release, and deed to be recorded in the office of the Clerk of the County of Suffolk, New Yor~. Moved by Councilman Valentine, seconded by Justice Demarest, WHEREAS, Theodore B. Howard has faithfully served the Town of Southold sln~e April 1st, 1948, starting as a police patrolman, and later as .sargeant and chief, and WHEREAS, such a record of service to the Town of Southold and its people deserves the sincere gratitude of those with whom and for whom he worked, NOW, THEREFORE,BE IT RESOLVED: That the Town Board of the Town of Southold e~presses its appreciation to Theodore B. Howard for his long record o~ fine service, and its best wishes for the years ahead, AND BE IT FURTHER RESOLVED: Tha~ this resolution be made a part of the permanent records of the Town, and that a copy be sent to TheodOre B. Howard. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Valentine, Justice Suter, Justice Demarest. Moved by Councilman Rich, ~seconded ~by Justice Demarest~ ~ WHEREAS, Leander Glover, Jr. has by written application applied to~thiS~board fo~ a permit to,excavate sand, grave~, ~stone or other materials from premises located north of Middle Road (Rouse 27), Cutchogue, New York, bounded generally northerly by lands of Glover; easterly by lands of Glover and McBride, southerly by lands of Pietrewicz aRd the Town of Southold; and westerly by lands of the Town of Southold, and WHEREAS, a public hearing was held on said application on July 13, 1971 at which all interested persons were given an opportunity to be heard, NOW, TI~REFORE, BE IT.RESOLVED~that this Board does in accordance with Section V of the Excavation Ordinance of the Town of Southold, find. that (~) ~he proposed operations will not interfere with the surface wa~er drainage plan of the area nor endanger any street, road or highway. _ (b) The circumstances of the location and terrain are reasonably adapted to rehabilitation to-the end that the premises will not become desert or waste land following completion of operations. (c) The circumstances of the location and ~he terrain, area such that conditions and safeguards may feasibly be imposed~to assure that the premises will not constitute an attractive nuisance or endanger the safety of children. (d) The use will not cause undue traffic hazards. (e) The use will not cause undue noise or wind-blown dust or sand~ (f) The use will not change the established character of the neighborhood or depress the value-of other lands in such neighborhood. (g) The proposed operations are set, back at least 300 feet f from any road, street, avenue or highway and~ that the excavation operations were in existence at the effective date of the afore- said excavation ordinance and that such proposed operations will not be ~xtended beyond the present front, side or rear setback lines, and it is further RESOLVED, that the Town Clerk b~ and he hereby is authorized and directed to issue a permit to the said Leander Glover, Jr. for the excavation-of sand, gravel, stone, or other materials from the above described premises for a term of one year, subject, however, to the following terms and conditions: - 1. The removal of materials shall be confined to the area shown on the map accompanying said application, a copy of which is to,be signed by the Supervisor and the applicant and filed with the Town Clerk. 2. The removal of materials from said area shall not extend below twenty-five (25) feet above sea level. 3. Ail removal operations shall be setback at least 25 feet from all property lines. 4. All slopes shall be maintained during and after opera- tions at one foot vertical on one foot horizontal. 5. After operations have been completed, the excavated area, as well as all other areas where pri~r excavation operations have been conducted on the premises, shall be leveled, top soil to a depth of 3 inches shall be deposited thereon and said area shall be seeded with grass. 6. That all areas where excavation operations have been conducted in the past and all. areas where actual excavation operations are to be conducted in the future shall be enclosed with wire fencing of the type known as chain link ore,cyclone fence or its equivalent to a height of 6 feet with four strands barbed wire at the top thereof which fencing shall contain ~ openings except.necessary gates for ingress and egress which gates shall ke closed and locke~ at all hours that operations are not.being conducted on the premises. That the permit authorized to be issued by this resolution shall not be issued by the Town Clerk until such fencing has been erected.
