GOEHRINGER South Id Town Board of Appeals TE _EPHONE (516) 765-1809 MINUTES SPEC IAL .MEET ING SEPTEMBER 12, 1980 A Special Meeting of the Southold Town Board of Appeals was held on Friday, September 12, 1980 at 4:15 o'clock p.m. at the Southold Town Hall, Main Road, Southold, New York 11971. Present were: Charles Grigonis, Jr., Chairman; Robert J. Douglass and Gerard P. Goehringer. Absent were: Terry R. Tut- hill and Serge J. Doyen, Jr. On motion by Mr. Douglass, seconded by Mr. Goehringer, WHEREAS, upon filing of the appeal application of Edgar J. Smith, Jr., for a Variance to construct addition to dwelling with insufficient front and/or rear yard setbacks at property located on a private right-of-way (West Bay Avenue) off Village Lane, Orient, New York, County Tax Map Item No. 1000-24-2-9, applicant(s) has submitted a short Environmental Assessment form which indicates that no significant adverse effects were likely to occur to the environment; IT IS RESOLVED, that in the subject Appeal (No. 2738), this Board hereby determines that this project if implemented as planned herein is classified as a Type II Action, not having significant adverse effects upon the environment; and pursuant to the N.Y.S. Environmental Quality Review Act, Sections 617.13 and 617.5(a), and the Southold Town Code Section 44-4, no further determination or procedure is required in the SEQRA standards of process by this department. (This declaration should not be considered a determination made for any other department or agency which may be invol~ed.) Vote of the Board: Ayes: Messrs. Grigonis, Douglass and Goehringer. Absent: Messrs. Doyen and Tuthill. Sullivan, for a Variance to the Zoning Ordinance for permission to erect ground sign (advertising off-premises business) on B-1 zoned property at the south side of Main Road, Mattituck, New York, applicant(s) has submitted a short Environmental Assessment form which indicates that no significant adverse effects were likely to occur to the environment; IT IS RESOLVED, that in the subject Appeal (No. 2744), this Board hereby determines that this project if implemented as planned herein is classified as a Type II Action, not having significant adverse effects upon the environment; and pursuant to the N.Y.S. Environmental Quality Review Act, Sections 617.13 and 617.5(a) , and the Southold Town Code Section 44-4, no further determination or procedure is required in the SEQRA standards of process by this department. On motion by Mr. Grigonis, seconded by Mr. Goehringer, it was RESOLVED, that the following appeals be scheduled for public hearings to be held September 25, 1980 in addition to those previously scheduled: 8:25 p.m. 8:45 p.m. Application of Edgar J. Smith, Jr. for a Variance for permission to construct addition to dwelling with insufficient front and rear yard setbacks. R-O-W off Village Lane, Orient. Application of George Sullivan for a Variance for permission to erect ground sound (off-premises directional) on B-1 zoned property at Main Road, Mattituck. Vote of the Board: and Goehringer. Absent: Ayes: Messrs. Grigonis, Douglass Messrs. Doyen and Tuthill. Application of Ernest G. Radford. Appeal No. 2731. Mr. Ben Telsey appeared before the Board requesting that the Board reconsider their decision of August 28, 1980 Southold Town Board of Appeals -3- September 12, 1980 wherein the Board denied an area variance but granted conditional approval of access. Mr. Telsey stated if applicant were forced to apply 40,000 square feet to proposed Lot No. 1, same would not be practical and is not the best use of land, creates two undesirable plots with finger of land not usuable or buildable, and to move cement block building would cause financial hardship. The Board advised Mr. Telsey that they would consider his request and advise him of their decision accordingly. Application of Annette Golden Carnes. Appeal No. 2740. The secretary was instructed to forward a letter to the N.Y.S. Department of Environmental Conservation referring this matter for their review and opinion.
