DANIELS GOVERNOR SECRETARY OF STATE ----------------------------------------------------------- In __In the Matter of the Petition of: DECISION Robert Brown For a Variance to the New York State PETITION NO. 2003-0130 Uniform Fire Prevention & Building Code ----------------------------------------------------------- Upon the application of Robert Brown, filed pursuant to 19 NYCRR 1205 on October 25, 2002 and upon all other papers in this matter, the Department makes the following determination: NATURE OF GRIEVANCE AND RELIEF SOUGHT The petition pertains to an existing building of Al (single family) occupancy, two stories in height, of type 5 (wood frame) construction, located at 1540 Jackson Street, New Suffolk, Town of Southold, Suffolk County, State of New York. The petitioner is seeking relief from: 9 NYCRR 711.2(b), which requires that bathrooms, toilet rooms, kitchenettes, corridors and recreation rooms shall have a minimum height of seven feet. [The petitioner seeks relief to allow(1) an existing bathroom, built into the roof area of the second story with a horizontal ceiling height of 7 feet 3 inches for approximately 4 feet 6 inches above the water closet and sink, then sloping down to 6 feet 4 inches with a final height of 4 feet 0 inches at the knee wall, and (2) an existing 7 feet 3 inches corridor which drops down to 6 feet 4 inches for approximately 5 feet 6 inches in front of the bathroom entry.] FINDINGS OF FACT 1. The existing bathroom was constructed into the roof area of the second floor of the building. 2. The horizontal ceiling height in the bathroom is approximately 7 feet 3 inches for approximately 4 feet 6 inches above the fixtures and then sloping down to 6 feet 4 inches with a final height of 4 feet at the knee wall With the placement of the fixtures, ceiling height is adequate for normal usage. 3. The 6 feet 4 inches height in the center of the bathroom, the 4 feet 0 inches at the knee wall and the 6 feet 4 inches corridor are restricted, due to the location of the existing roof rafters. 4. The petitioner proposed to install a fire and smoke detecting devices in the second floor as required by the WWW.905.STATE.NY.US • E-MAIL: INFv@905.STATE.NY.US Petition No.2003-0130 Page 2 Uniform Code. 5. The local Code enforcement official has been consulted in this matter and does not object to the granting of a routine variance under the provisions of 19 NYCRR 1205.6. CONCLUSIONS OF LAW Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would produce a negligible additional health, safety and security benefit to the occupants of the building. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 9 NYCRR 711.2(b), to allow a bathroom built into the roof area of the second story with a ceiling height of 6 feet 4 inches in the center and 4 feet 0 inches ceiling height at the knee wall and a corridor with 6 feet 4 inches ceiling height be and is hereby PROPOSED TO BE GRANTED with the following conditions: 1. That the petitioner shall install fire and smoke detecting alarm devices in the second story in conformance with the Uniform Code. 6. That the building shall conform to all other applicable sections of the Uniform Code. This DECISION is issued under 19 NYCRR 1205.6. Unless objected to by the petitioner in writing received by the Department, the decision shall become FINAL after fifteen days of receipt of the decision by the parties. The plan does not show the hallway leading into the bathroom. We are not in agreement with this application and would like to speak before a petition is authorized. The petitioner is seeking relief from: 9 NYCRR 711.2(b),which requires that bathrooms,toilet rooms, kitchenettes, corridors and recreation rooms shall have a minimum height of seven feet. [The petitioner requests relief to allow(1) an existing bathroom, built into the roof area of the second story with a horizontal ceiling height of 7 feet 3 inches for approximately 4 feet 6 inches above the water closet and sink, then sloping down to 6 feet 4 inches with a final height of 4 feet 0 inches at the knee wall, and (2) an existing 7 feet 3 inches corridor which drops down to 6 feet 4 inches for approximately 5 feet 6 inches in front of the bathroom entry.] FINDINGS OF FACT 1.
