This application must be filled in by typewriter or ink and submitted to the Building Department with the following:
A. For new building or new use:
1. Final survey of property with accurate location of all buildings, property lines, streets, and unusual natural or
topographic features.
2. Final Approval from Health Dept. of water supply and sewerage -disposal (S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains less than 2110 of 1% lead.
5. Commercial building, industrial building, multiple residences and similar buildings and installations, a certificate
of Code Compliance from architect or engineer responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
13. For existing buildings (prior to April 9, 1957) non -conforming uses, or buildings and "pre-existing" land uses:

William M. Beebe, being duly sworn, deposes and says:
1. That he resides at 1455 New Suffolk Road, Cutchogue, County of Suffolk and State of
New York and has resided there for 52 years. I am 75 years of age and have resided in this area for
all of my life.
2. That deponent is personally familiar with the subject premises located at 1540 Jackson
Street, New Suffolk, New York (SCTM: 1000-117.00-10.00-012.004) and presently owned by
Nancy Bruce Cummings Monson a/k/a Bruce Cummings. Bruce Cummings is the niece of William
LeMassena.
3. Deponent was the builder who performed renovations to the subject premises beginning
in 1973 and continuing into 1975. When William LeMassena purchased the premises in 1973 the
house was in disrepair and I was hired as a contractor. Beginning in the fall of 1973, 1 installed new
roof shingles on the entire roof area and installed plywood on areas of the roof where existing
boards were rotten. Tlereatter late in 1973 or early in 1974 1 replaced all the windows in the
dwelling with Anderson windows.
4. The balance of the work performed during the years 1973 through 1975 by me were the
building of a fireplace on the south side of the dwelling; removing existing concrete flooring and
replacing the same with new concrete which were reinforced with wire and steel rods; framed new
partitions for all rooms and repaired all existing framing that needed reinforcing; installed clear
Cypress on exterior of dwelling and painted pine boards on the exterior of the dwelling.
5. In addition to the aforementioned alterations, the existing well was replaced with a new
well; plumbing and electrical service as well as an electric pump were installed in 1974.
6. Also, some of the flooring including the second story flooring was repaired and/or
replaced.
7. 1 performed all work under my company name, Wm. M. Beebe Builders. I only
performed work on the exterior of the building and on the first floor.
8. The work aforementioned performed to the premises was as a result of normal upkeep
and maintenance of the dwelling. Except for the replacing of damaged windows and the re -siding
of the dwelling needed to protect the home, and except for the addition of a brick patio, no exterior
alterations were made.
9. Attached hereto and made a part hereof is a list of materials used for the aforementioned
alterations. All materials used and labor performed was to code for the Town of Southold Building
Codes then in effect during the years 1973 to 1975
10. Also provided herewith are plans detailing the renovations and alterations made on the
first floor area and the exterior of the home stamped by an engineer.
11. 1 can also st, to from my personal knowledge that the second floor of the structure had
been used for living quarters prior to 1973 . It consisted of several rooms, including a bathroom, I
did not do any of' the icnovation work, as 1 have stated, but 1 did discuss such work with Ray
KYIgman, who did perform such work and he is supplying an affidavit in regard to his work
separately.
12. In 1993 William LeMassena past away resulting in his niece, Bruce Cummings,
becoming the owner of the premises. Mr. LeMassena nor his niece Ms. Cummings has made any
changes to the premises since the work done in 1973 through 1975 except for ordinary maintenance
and upkeep.
13. 1 make this affidavit to induce the Town of Southold to issue a pre-existing Certificate of'
Occupancy for the "barn" which is actually a two story residence.

To the best of my recollection I completed the following work to Mr. Bill LeMassina,s
barn on Jackson St. in the winter months of 197yto the second floor.
Access stairs to the second floor were already in place and I suspect the upper floor
was used as living quarters in the early life of the barn. Walls were in place to support the
roof structure and the rooms were partitioned off with these walls partially covered with
wainscoting which I removed and later covered with !/2" sheetrock. There was a wood
floor which was used as a base for the new oak flooring. There was a hayloft room on the
north end and the access door was used to bring the sheetrock upto the second floor. 'This
room was to be a studio for his friends so skylites were installed for added light.
Partitions that were added in the bedroom areas were for small closets. The original
structure was not altered or changed in any way. The electrical was completed and walls
and overhead were insulated. I installed the trim, mouldings and hardwood floors. The
handrail and balusters were replaced with oak as what was there was not serviceable.
The electrican gave the Underwriters certificate to Bill who needed it for lloward Terry
of the building department to get his "CO". I believe his assistant at the timc was George
Fisher.

With reference to the above application for a pre-existing Certificate of Occupancy,
enclosed herewith please find affidavits from William M. Beebe who performed most of the
renovations at the subject premises and an affidavit of Ray Krogman who also did renovations
at the home.
I understand that plans have been drawn and delivered to the engineer, Larry Tuthill.
My office has spoken with Mr. Tuthill who will not sign the plans until after he meets and
discusses the same with the Building Department. I believe that the meeting was imminent.
My secretary has left a few messages for you to determine what else is necessary to be
submitted, however you have not returned her calls and we thought it best to send these
affidavits to you.
Please contact my office upon receipt of this letter to acknowledge receipt of the
affidavits and advise if any other documents are necessary.
