DANIEL5 GOVERNOR SECRETARY OF STATE ----------------------------------------------------- In the Matter of the Petition of: DECISION Theodore Laoudis For a Variance to the New York State PETITION NO. 2002-1000 Uniform Fire Prevention & Building Code -------------------------------------------------------- Upon the application of Theodore Laoudis, filed pursuant to 19 NYCRR 450 on August 16, 2002, and upon all other papers in this matter, the Department makes the following determination: NATURE OF GRIEVANCE AND RELIEF SOUGHT The petition pertains to a combustible walkway, accessory and adjacent to a two-story building of Al(one family) occupancy, of type 5 (wood frame) construction, located at 635 Kimberly Lane, Southold, Town of Southold, County of Suffolk, State of New York. The petitioner is seeking relief from: 9 NYCRR 716.4(b),which requires that porches, verandas and balconies of combustible construction shall be not less than three feet distant at any point from a lot line. [The petitioner requests that the walkway be maintained less than 3 feet from a lot line.] FINDINGS OF FACT 1. The portion of the walkway which is the subject of this petition is an unenclosed structure consisting of a slate roof on top of 1'/: inches tongue and groove decking supported by 18 inch diameter heavy timber logs, fastened to 3 feet x 3 feet x 5 feet high concrete and stone veneer piers. 2. The walkway is located to the north of the property and is nearest to the north interior property line. The authority having local jurisdiction considers that the walkway is subject to the provisions of 9 NYCRR 716.4(b). 3. A plot plan dated March 14, 2002 shows the north portion of the walkway as being on the north interior lot line, for a distance of approximately 14 feet. 4. If the walkway were not to be used as a platform for activity that would allow an open Flame to be brought on or near to it, the threat of exterior fire spread would be reduced. 5. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 9 NYCRR 716.4(b), to permit a combustible walkway to have no minimum distance separation as described herein, be and is hereby PROPOSED TO BE GRANTED with the following conditions: 1. That the walkway shall not be used as a platform for any activity that would allow an open flame to be brought on or near to it. 2. That the Board of Appeals decision be adhered to, should the parcels be sold. 3. That the structure meets all other applicable sections of the Uniform Code. The petitioner is seeking relief from: 9 NYCRR 711.2(b),which requires that bathrooms, toilet rooms, kitchenettes, corridors and recreation rooms shall have a minimum height of seven feet. [The petitioner requests relief to allow an existing bathroom, built on the second floor, with a horizontal ceiling height of 8 feet 3 inches for approximately 1 foot, sloping down to 6 feet 9 inches.] FINDINGS OF FACT 1. The existing bathroom was constructed on the second floor of the building that is the subject of this petition. 2. The horizontal ceiling height in the bathroom is 8 feet 3 inches for approximately 1 foot, sloping down to 6 feet 9 inches. 3 . With the placement of the fixtures, the 6 foot 9 inch ceiling height is adequate for normal usage. 4. The petitioner has proposed to install a fire and smoke detecting devices in the second floor as required by the Uniform Code. Petition No. 2002-0826 Page 2 5 . The local Code enforcement official has been consulted in this matter and does not object to the granting of a routine variance under the provisions of 19 NYCRR 450.6.
