The following resolution was adopted: WHEREAS, Gordon and Madeleine Schlaefer are the owners of the property known and designated as The 1670 House, located at 47025 County Road 48 in Southold; and WHEREAS, a formal application for the approval of this site plan was submitted on December 15, 2000; and WHEREAS, this site plan is fora 5,540 square foot addition to an existing furniture store; and WHEREAS, a building width variance was granted by the Zoning Board of Appeals on March 15, 2001 and the variance required the waiver of two parking spaces; and WHEREAS, the Southold Town Planning Board, pursuant to the State Environmental Quality Review Act, (Article 8), Part 617, declared itself lead agency, made a determination of non-significance, and issued a Negative Declaration on May 14, 2001; and 1670 House -Page Two -November 6, 2001 WHEREAS, the Architectural Review Committee approved the elevation drawings, I dated June 6, 2001, on July 19, 2001; and WHEREAS, the Town Engineer has reviewed the drainage calculations and the Planning Board has accepted his recommendation for approval; and WHEREAS, this site plan, dated October 16, 2001, was certified by the Building Department on October 22, 2001; and WHEREAS, the Suffolk County Department of Health Services granted approval to construct on October 25, 2001; and WHEREAS, the final public hearing was closed on said site plan application at the Town Hall, Southold, New York on November 5, 2001; and WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of Public Hearing, has received affidavits that the applicant has complied with the notification provision; be it therefore RESOLVED, that the Southold Town Planning Board grant final approval on the site plan, dated October 16, 2001,. and authorize the Chairman to endorse the final surveys subject to a one year review from date of building permit and the following condition: 1. A continuous 4' high hedge must be planted along the northerly (rear) and easterly (side) property lines for their entire length in order to mitigate loss of required 25' landscape buffer. Enclosed please find two copies of the approved site plan; one for your records and one to be submitted to the Building Department when you apply for your building permit. To answer your question, the Board, in its review of Appeal #4876, did consider the overall building size with side yard openings of 20 feet on the west side and 25 feet on the east side, shown on your SP-1 map dated 8-14-00. You have confirmed that the side yard openings will now be 20 feet on the west, and 28 feet on the east. This letter will confirm that there is no objection to obtaining site plan approval for the same building, same size, and total side yards at 48.1 feet, increasing the easterly side yard from 25 feet to 28.1 and 28.4 feet respectively. Verity ~ ¢ , , I ~ 1 ~N~~ ~~~~4 Site Plan Applications Public Hearings Under the current site plan application procedure, the process for reviewing a site plan application is: a public hearing is not scheduled and held by the Planning Board until after, among other things, the site plan has received a stamped Health Department approval The applicant shall now have the following options: 1. To follow the established procedure, or 2. To have the Planning Board schedule and hold a public hearing on ' the site plan application and have the Planning Board vote on the proposed conditional site plan prior to the applicant receiving Health Department approval subject to the following conditions: A. The applicant hereby agrees and understands that if the site plan which receives stamped Health Department approval differs in any way from the proposed conditional site plan on which the Planning Board held a public hearing and voted on, then the Planning Board has the right and option, if the change is material to any of the issues properly before the Planning Board, to hold a public hearing on this "revised" site plan application and review its conditional approval. B. The applicant agrees not to object to a new public hearing and Planning Board review of the revised application. Applicant Agreement on Site Plans_ The applicant is aware of the terms of this approval and certifies to these terms by his/her signature below. Findings of Fact PROPERTY FACTS: The subject property is a parcel of 22,940 sq. ft. with about 160 feet of frontage on CR 48 in Southold, and a depth of 150 feet. It is improved with a frame building used as a furniture and home furnishings shop. BASIS OF APPEAL: Building Inspector's Notice of Disapproval, dated September 14, 2000, denying a permit to build an addition because the addition would increase the building frontage on CR 48 from 49 feet to 103 feet, in violation of Gode section 100-103C, which limits building frontage in the General Business zone to 60 feet on one street. AREA VARIANCE RELIEF REQUESTED: Applicants request a variance authorizing the addition as proposed, which would extend the building by 54 feet to the East, for a total width of 103 feet. REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: (1) Applicants, who own the furniture shop, stated that the current space is very crowded and that the future of the business requires expansion. They stated that the nature of their business mandates that operations be under one roof in order that customers may move easily among the merchandise displays, and that breaking the facility up into separate buildings would be not only impractical but also uneconomical in terms of staffing requirements. (2) The shape of the property is such that an addition to the East is the only feasible way to expand. (3) The subject property is located on a busy segment of CR 4$, with several large business structures nearby. Applicants' proposed addition constitutes the expansion of a single business under one roof and not the establishment of amulti-business facility, and grant of the requested variance will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. (4) The Board expressed concern about the flow of traffic, particularly emergency vehicles, onto and within the property. In response, applicants' attorney on March 5, 2001, submitted a site plan dated February 28 that shows an emergency vehicle access lane on the East side of the property from the rear of the property to CR 48. The Board is not in favor of a variance for this proposed 54' wide addition. This addition plus the existing 49' wide building will result in a proposed building with a total width of 103'. The maximum width of 60' was placed in the General Business Zone to reduce the mass of the frontage facing the street and to prevent strip development from expanding along major traffic arteries. The Board recommended that a second building be considered with architecture that is compatible with the historic 1670 house. The applicant has not shown that a second building that would not destroy the historical integrity of the 1670 house could not meet their needs. A previous plan approved in 1986 was never built and has expired. To date, the Planning Board does not have an application for this project.
