Sa~ck~ Southold Town Board o£Appeals MAIN ROAD- STATE ROAD 2S SOUTHOLD, L.h.N.Y. 11971 TELEPHONE (516) 765-1809 MINUTES SPECIAL MEETING HELD OCTOBER 3, 1980 A Special Meeting of the Southold Town Board of Appeals was held on Friday, October 3, 1980 ~t 4:30 o'clock p.m. at the Southold Town Hall, Main Road, Southold, New York 11971. Present were: Charles Grigonis, Jr., Chairman; Robert J. Douglass; Gerard P. Goehringer; Joseph H. Sawicki. Absent was Serge J. Doyen, Jr. The ChairMan called this Special Meeting in order that consideration may be given for the Fanny Behlen Community Health Center to be scheduled for public hearing at the next regular meeting, to wit, October 16, 1980. An additional appeal for the center's site was filed Monday, September 29th, in addition to the previous appeal filed August 14, 1980. On motion by Mr. Grigon. is, seconded by Mr. Goehringer, WHEREAS, applicant has submitted an environmental assess- ment in the short form which indicates that no adverse effects were likely to occur to the environment; and WHEREAS, the subject property does not appear to be located within 300 feet of tidal wetlands; IT IS RESOLVED, that in Appeal No. 2736, application of Fanny Behlen Community Health Center, Inc. ~or a special exception to the Zoning Ordinance for permission to erect an ambulatory care clinic on residentially-zoned property located at the south side of North Road, Greenport, NY, this Board determines that this project if implemented as planned herein is classified as a Type II Action, not having a significant effect upon the environment; and pursuant to So~thold Town Board of Appeals -2- Special Meeting October 3, 1980 the New York State Environmental Quality Review Act, Sections 617.13 and 617.5(a) [SEQRA], and the Southold Town Code, Sec- tion 44-4, no further determination or procedure is required in the SEQRA standards of process by this department. (This declaration should not be considered a determination made for any other department or agency which may be involved.) Vote of the Board: Ayes: Messrs. Grigonis, Douglass, Goehringer and Sawicki. On motion by Mr. Grigonis, seconded by Mr. Goehringer, WHEREAS, applicant has submitted an environmental assess- ment in the short form which indicates that no adverse effects were likely to occur to the environment; WHEREAS, the subject property does not appear to be located within 300 feet of tidal wetlands; IT IS RESOLVED, that in Appeal No. 2752 , application of Fanny Behlen Community Health Center, Inc. for a variance to the Zoning Ordinance for permission to erect an ambulatory care clinic on residentially-zoned property located at the south side of North Road (C.R. 27/C..R. 28), Greenport, NY, this Board determines that this project if implemented as planned herein is classified as a Type II Action, not having a significant effect upon the environment; and pursuant to the New York State Environmental Quality Review Act, Sections 617.13 and 617.5(a) [SEQRA], and the Southold Town Code, Sec- tion 44-4, no further determination or procedure is required in the SEQRA standards of process by this department. (This declaration should not be considered a determination made for any other department or agency which may be involved.) Vote of the Board: Ayes: Messrs. Grigonis, Doug- lass, Goehringer and Sawicki. On motion by Mr. Grigonis, seconded by Mr. Goehringer, WHEREAS, applicant has submitted an environmental assess- ment in the short form which indicates that no adverse effects were likely to occur to the environment; WHEREAS, the subject property does not appear to be located within 300 feet of tidal wetlands; IT IS RESOLVED, that in Appeal No. 2751 , application of Harry Baglivi, by Skinny Dip Pools, Inc. for a variance to the S6uthold Town Board of Appeals -3- Special Meeting October 3, 1980 Zoning Ordinance for permission to construct swimmingpool in frontyard area at 3440 Nassau Point Road, Cutchogue, New York, this Board determines that this project if implemented as planned herein is classified as a Type II Action~ not having a significant effect upon the environment; and pursuant to the New York State Environmental Quality Review Act, Sections 617.13 and 617.5(a) [SEQRA], and the Southold Town Code, Sec- tion 44-4, no further determination or procedure is required in the SEQRA standards of process by this department. (This declaration should not be considered a determination made for any other department or agency which may be involved.) Vote of the Board: Ayes: Messrs. Grigonis, Doug- lass, Goehringer and Sawicki. On motion by Mr. Grigonis, seconded by Mr. Goehringer, WHEREAS, applicant has submitted an environmental assess- ment in the short form which indicates that no adverse effects were likely to occur to the environment; IT IS RESOLVED, that in Appeal No. 2753 , application of Charles Sidorowicz for a Variance to the Zoning Ordinance for permission to construct garage in sideyard area at 125A Cox Neck Road, Mattituck, New York (Tax Map Item 1000-113-8-4), this Board determines that this project if implemented as planned herein is classified as a Type II Action, not having a significant effect upon the environment; and pursuant to the New York State Environmental Quality Review Act, Sections 617.13 and 617.5(a) [SEQRA], and the Southold Town Code, Sec- tion 44-4, no further determination or procedure is required in the SEQRA standards of process by this department. (This declaration should not be considered a determination made for any other department or agency which may be involved.) Vote of the Board: Ayes: Messrs. Grigonis, Doug- lass, Goehringer and Sawicki. On motion by Mr. Grigonis, seconded by Mr. Goehringer, WHEREAS, applicant has submitted an environmental assess- ment in the short form which indicates that no adverse effects were likely to occur to the environment; IT IS RESOLVED, that in Appeal No. 2754 , application of ' S6uthold Town Board of Appeals -4- Special Meeting October 3, 1980 Thomas Yasso for a Variance to the Zoning Ordinance for permission to construct addition with an insufficient sideyard setback at 1055 Soundview Avenue, Mattituck, New York (Tax Map #1000-94-1-9), this Board determines that this project if implemented as planned herein is classified as a Type II Action, not having a significant effect upon the environment; and pursuant to the New York State Environmental Quality Review Act, Sections 617.13 and 617.5(a) [SEQRA], and the Southold Town Code, Sec- tion 44-4, no further determination or procedure is required in the SEQRA standards of process by this department. (This declaration should not be considered a determination made for any other department or agency which may be involved.) Vote of the Board: Ayes: Messrs. Grigonis, Doug- lass, Goehringer and Sawicki. On motion by Mr. Grigonis, seconded by Mr. Goehringer, it was RESOLVED, that the following appeals be scheduled and adver- tised for public hearings to be held October 16, 1980 in addition to those previously scheduled, at the Southold Town Hall, Main Road, Southold, New York: 9:00 p.m. 9:10 p.m. 9:20 p.m. 9:35 p.m. 10:00 p.m. Harry Baglivi.
