APPLICATION FOR CERTIFICATE OF OCCI/PANCY INSTRUCTIONS
This application must be filed in typewriter OR ink and submitted to the Build~g
Inspector with the following; for new buildings or new use:
I. Final survey of property with accurate location of all buildings, property lines,
streets, and unusual natural or topographic features.
Fimal approval of ~ealth Dept. of water supply and sewerage-disposal(S-9
Approval of electrical installation from Board of Fire Underwriters.
Swor~ statement from plumber certifying that solder used in system contain~ less
than 2/10 of l: lead.
Commercial buildings, industrial buildings, multiple residences and similar.
buildings and installations, a certificate of code compliance from the Architect
or Engineer responszble for the building.
Submit Planning Board Approval of completed site plan requirements.
For existing buildings (Prior to April 9, 1957~ non-conforming uses, or buildings
and "pre-existing" land uses:
I. Accurate survey of property showing all property lines, streets, buildings amd
unusual natural or topographic features.
2. A properly completed application, a consent to inspect signed by the applicant
and a certified abstract of title issued by a title company which shall
show single and separate ownership of the entire lot prior to April 9, 19S7.
If a Certificate of Occupancy is denied, the Building Inspector shall state the
reasons therefor iu writing to the applicant.
3. Date of any housing code or safety inspection of buildings or premises, or other
pertinent info~tion required to prepare a certificate.
For Vacant Land Certificate of Occupancy:
1. An application for vacant lmnd Certificate of Occupancy shall be submitted,
and a certified abstract of title issued by a title company showing single and
separate ownership of the eotire lot prior to April 9, 1957 shall also accompany
the application. If a Certificate of Occupancy is denied, the Building Im~pector
shall state the reasons therefor in ~rriting to the applicant.

You have asked my opinion with regards to the above
mentioned matter. Based upon a review of the files in the
Planning Board, the Board of Appeals and the Building Department,
I submit the following:
(a) There is a filed map subdivision for an area called
Willow Terrace Section One. Although there is no signed copy of
the map, there is a report from the County Clerk that the map was
filed. This subdivision is also listed as an exception under our
Code 100-112 last amended 10/30/73.
(b) There lsa sketch plan called Willow Terrace
Section Two, dated 11/25/77, which includes the area in
question. It appears that this proposed subdlvzslon application
was never completed.
(c) On September 14, 1981 there was an approval by the
Planning board for a set off of part of "Willow Terrace Two"
wherein one parcel of 44,000+ square feet was created, leaving a
parcel two of 9.1+ acres, lit is noted that the sketch plan map
of 1977 and the set off map of 1981 do not appear to contain the
same total area]
(d~ It would appear that a one acre lot from parcel 2~o,~'F~c
[Wlllow Terrace Two] was conveyed to James Douglas.
(e) James Douglas obtained a buildzng permit for part
of lot 39. According to the sketch plan of 1977, the entire area
of parcel two is lot 39.
Consequently, unless James Douglas now owns the entire 9.1+
acres of parcel two, and he is building thereon, the conveyance
to him would be an improper subdivision, and his permit to build
on his own one acre is also improper.
