The required minimum is 35 feet. In addition the enclosed second survey shows the addition to the house to the South of mine extending into the rear yard a greater distance than my deck. No measurement is shown to indicate how close the addition is to the rear line. In other words you have requested of me a measurement, not required of a next door neighbor. In addition you have found my Building Permit %16889 that allegedly was not on file. In addition you have on file since July 7th, the revised drawing of exact deck dimensions. The drawing shows the deck to be well within lot coverage allowed, in fact a larger deck could be built in the rear yard. In addition Section 100-I3 "Building Area" paragraph 2b, that you cited, would not apply in this case. In addition you have my request for a Certificate of Occupancy, since May ~th. We checked the Buzlding Permits and could not f~nd any record of one issued to you for the work done. Accordzng to Art. XIV Chap. 100-141 of the Southold Town Zoning Code, "no buzlding zn any dis- trxct shall be erected, reconstructed, restored or structurally altered without a buildzng permzt duly zssued upon application to the Buildxng Inspector". Present were: Gerard P. Goehringer, Chairman; Charles Grigonis, Jr., Serge Doyen, Robert J. Douglass and Joseph H. Sawicki, constituting all five members of the Board of Appeals. Also present were: V~ctor Lessard, Building-Department Administrator, L~nda Kowalski, Board Clerk, and approximately 30 persons at the beginning of the meeting. The Chairman opened the meeting at 7:30 p.m. and proceeded with the following deliberations and dec~sion pending in the Matter of PAUL LEARY under Appeal No. 2489 concerning premises of FRANK E. AND MARY BROPHY, 75 Second Street, New Suffolk, NY: Application of PAUL LEARY for a reversal of decision of the building ~nspector for a nullification of actions by the Building Department to ~ssue a modified Permit and Demolition Permit, and that the property owners be left to regular procedures of law, to be allowed only after review by the Board of Appeals and in accordance with all other provisions of law. It is the posit~on of the Appellant that this condition must be construed to mean that any improvement requires the approval of this Board. The Attorney for Brophy maintains that such condition should be construed to mean that the approval of th~s Board is required only in cases in which such an ~mprovement results in the building area exceeding 20% of the lot area. Th~s Board con- strues c~t~on 2 ~n m~mn th~ th~_~-d~s..~-p~oval is only /rt~zErireo when improvements would result ~n the builO~n§ are aJ ~e~eeding 20% of the lot ar~_~_ ~ (b) W~th respect to the SEQRA questions raised by Appellant, this Board can find no provision of Article 8 of the Environmental Quality Review Act or the rules promulgated pursuant thereto, or Chapter 44 of the Town Code which confers upon this Board jurisdiction to pass upon determinations of an administrative officer with respect to SE~RA proceedings, nor does this Board believe that ~t has jurisdiction to pass upon determinations of an administrative officer with respect to SEQRA proceedings, nor does th~s Board believe that it has jurisdiction to review its own SEQRA determinations made in a previous appeal. It would seem that review of SEQRA deter- minations are reserved to the courts. (c) The Appellant's claim that the Building Inspector issued the Building Permit in violation of the Town's Flood Management Protection Law ~s without merit. The record contains Development Permit No. IOOF ~ssued on March ll, 1986, pursuant to the Town's Flood Management Protection Law. (d) The assertion that the building area exceeded 20% of the lot area is not borne out by the several maps introduced at the hearing. The only map indicating lot coverage in excess of 20% was the Sealand map dated May 13, 1986, which erroneously included the area of the patio at the rear entry to the dwelling, which, s~nce it was at ground level, should not have been included in the calculation of building area pursuant to the definition contained in Section 100-13 of the Zoning Code. In his petition, appellant dwelt heavily on the question of the demolition permit being issued during or after the fact and that the Building Permit f~rst permitted an alteration and was thereafter amended to permit the reconstruction of the subject dwelling.
