and a certified abstract of title issued by a title company which shall

3. Date of any housing code or safety inspection of buildings or premises, or other

C. For Vacant Land Certificlate of Occupancy:
1, An application for vacant land Certificate of Occupancy shall be submitted,
and a certified abstract of title issued by a title company showing single and
separate ownership ofi the entire lot prior to April 9, 1957 shall also accompany

shall state the reasons therefor in writing to the applicant.

Dear Mr. & Mrs. Lappe:
We have received a complaint concerning the above noted
property regarding unsafe conditions and junk on the site.
I inspected the property on this date and found the following
1). A junk refrigerator with the door on.
~). A hole next to the house covered by plywood and not
enclosed by a fence.
3). Other junk items and debris in the yard.
The above conditions are a violation of the code of the
Town of Southold and are considered an unsafe condition which
must be taken care of immediately to prevent any legal action.

Dear Mr. Lappe:
Pursuant to your request for an inspection to determine if the Trustees
have jurisdiction regarding the work to be done on the property above
referenced, please be advised that President John M. Bredemeyer has reviewed
this matter on February 4, 1988.
It has been determined that this work is an ordinary and usual maintenance
or. repair of a presently existing building. In accordance with 97-12 [5] this
work does not require a permit from the Trustees.
However, no fill is to be placed within 75' of the ~vaters edge. A row of
hay bales are to be placed at the seaward side of any excavation or stock piles
on the site to prevent any run-off into the creek.
Please return to the Building Dept. for a determination on tko need of any
other permits that may be required for this project.

Ba~ ~'information you have submitted, the New York State Department
of ~nvironmental Conservation has determined that the __ parcel
~ project is:
Greater than 300' from inventoried tidal wetlands.
~ Landward of a substantial man-made structure ~~ ~~
greater than 100' in length which was constructed prior to 9/20/77.~q~
Landward of the 10' above mean sea level elevation contour on a
gradual, natural slope.
Landward of the topographic crest of a bluff, cliff or dune which is
greater than 10' in elevation above mean sea level.
Listed in Part 661.5 of 6NYCRR (Tidal Wetlands Land Use Regulations)
as a use not requiring a permit or notification letter of approval.
Therefore, no permit is required under the Tidal Wetlands Act (Article 25
of the Environmental Conservation Law). Please be advised, however, that
no construction, sedimentation or disturbance of any kind may take place
seaward of the 10' contour or topographic crest without a permit. It is
your responsibility to ensure that all necessary precautions are taken to
prevent any sedimentation or other alteration or disturbance to the
ground surface or vegetation in this area as a result of your project.
Such precautions may include providing adequate work area between the
10' contour or topographic crest and the project (i.e. a 15' to 20' wide
construction area) or erection of a temporary fence, barrier, or hay
bale berm.
Please note that any additional work, or modification to the project as
described, may require authorization by this Department. Please contact
this office if such are contemplated.
Please be further advised that this letter does not relieve you of the
responsibility of obtaining any necessary permits or approvals from other
agencies.

in order to minimize damage from erosion, turbidity or
siltation, saltwater intrusion, loss of fish, shellfish or other
beneficial marine organisms, aquatic wildlife and
vegetation and the destruction of the natural habitat
thereof, to minimize danger of flood and storm-tide damage
and pollution, and to otherwise protect the quality of
wetlands, tidal waters, marshes, shore lines, beaches and
natural drainage systems for their conservation, economic,
aesthetic, recreational and other public uses and values,
and, further, to protect the potable fresh water suppties of
the town from the dangers of drought, overdraft, pollution
from saltwater intrusion and misuse or mismanagement.
Therefore, the Town Board declares that the regulation of
the wetlands of the Town of Southold is essential to the
health, safety and welfare of the people of the Town of
Southold.
§ 97-12. Exceptions.
A. The provisions of this chapter shall not affect or prohibit
nor require a permit for the following:
The ordinary and usual mosquito control operations
conducted by any public authority.
(2) The ordinary and usual operations incidental to the
cultivation and/or harvesting of fish and shellfish.~
:~]3) The ordinary and usual operations relative to conser-
vation of soil, vegetation, fish, shellfish and wildlife.
(4) The ordinary and usual operations relative to agri-
culture, aquaculture or horticulture.
(5) The ordinary and usual maintenance or repair of a
presently existing building, dock, pier, wharf, bulk-
head, jetty, groin, dike, dam or other water control
device or structure.~
B. Nothing contained in this chapter shall be deemed to affect
any areas in the town within the jurisdiction of the
Southoid Town Board of Trustees.
