First, I would like to state that I am not the architect-of-record for the approved plans. I have been retained by the owner to help resolve these outstanding items. The original designer who prepared the plans is located on the west coast and is not available. I am, therefore, assuming the responsibility for these items. The questions you raised are as follows; 1. The use of the rooms on the lower level as possible bedrooms These spaces will not be used as bedrooms. The approved plans clearly indicate that this space is "not habitable". Also, there are no windows for ventilation. If you wish, the owner will submit an affidavit stating that this space will not be used as bedrooms. 2. Height of building and its relationship to A,rade and the passibility of a 3-stogy building. The approved plans show a IY2 story building with a cellar space. The completed building, as-built, conforms to the approved plans, except for the modifications to the final grades along the sides and front of the house. Even if the lower level is counted as a floor, the total height of the building will still only be 2Y2 stories high. In addition, my preliminary calculations indicate that the lower level is not deemed to be a story, according to the New York State Code, because the average grade elevation around'the s house is less than seven feet. I believe that the above information should be adequate to resolve the outstanding items prior to the town issuing a final certificate of occupancy. If you require additional information or clarification, I will be happy to provide it.
