First, I would like to state that I am not the architect-of-record for the approved plans. I have been retained by the owner ~o help resolve these outstanding items. The original designer who prepared the'plans is located on the west cea.st and is not available. I am, therelore~ assuming the responslbility for these items, The queszions you raised are as follows: 1. The use of the rooms~.,on. Jh, e.!ower level as possible bedroom,s. These spaces will not b.e used as bedrooms. The approved plans clearly i.ndicate that ~his space is "not habitable". Also, there are no windows for ventilation. Ii you wish~ the owner Will submit an affidavit stating that thls space will not be used as bedrooms. 2. _M~e_th_~_d.of fastening si the flitch p.l..ai.~s. The flitch plates are lastened by 10~i" x 5" bolts. Even if the lower level is counted as a floor, the total hei§ht of the buildin~ will still only be 2~ stories high. In addition, my preliminary calculations indicate that the lower level is not deemed to be a story) according to the New York State Code, because the average grade elevation arouad the house is less than seven feet. I believe that the ~bove information ~hould be adequate to re~olve the outstanding items prior to the town i~sulng a final certificate o~ occupancy.
