We are in the process of receiving a letter of No Jurisdiction from DEC because the proposed work is a good distance away from the 10' elevation and the slope is minimal. The proposed scope of work is to build a new two-story single-family dwelling(1s`floor- 2,677sf, 2nd floor- 2,283 sf) with an attached garage (550 sf) and pool(900 s.f.). The closest edge of the proposed patio is 108.7'from the Tidal Wetland Boundary,Flagged Sept 30,2021. We are requesting a letter of No Jurisdiction from the Board of Trustees for the following reasons: 1. The proposed work is not within the 100'setback of the wetlands Boundary. 2. A possible concern was how the proposed work is 8.7' (at the closest point) away from the 100' wetland setback This new work is going to be a retaining wall structure built above the natural grade,so minimal excavation is required at this location(3' min depth required Per RCNYS). It is my belief that the proposed work is not going to be over cut when digging because the minimal digging required. 3.
