HomeMy WebLinkAboutLP-11/28/2023 LAND PRESERVATION COMMITTEE MEETING Minutes & Discussion Notes from Meeting held Tuesday, November 28, 2023 at 7:00 p.m. This Regular Meeting was held in the Annex Executive Board Room, located on the 2nd floor at Southold Town Hall Annex, 54375 Route 25 (Main Road), Southold, New York. The public had access to view and listen to the meeting as it was happening via Zoom. If an attendee did not have access to a computer or smartphone, there was an option to listen in via telephone. Comments from the public may not be solicited nor received without an appointment. It is expected that the Committee will enter into Executive Session* at some point after opening the Regular Meeting for the purpose of discussing applications regarding proposed acquisitions of real property where publicity would substantially affect the value thereof. The public is not allowed to attend, view, or listen to Executive Session. Committee Minutes and Administration • Acceptance of LPC meeting minutes from November 14, 2023 MOTION made by Sam McCullough, seconded by Anne Murray, to accept the November 14, 2023 LPC meeting minutes. Motion carried: 5/0 • Next LPC Meeting Date: December 12, 2023 • Land Preservation Committee Chair and Deputy Chair recommendations 2024 MOTION made by Eric Keil, seconded by Kim Krupski, that the Committee recommends that the Town Board designate Sam McCullough as Chairperson and Anne Murray as Deputy Chairperson of the Land Preservation Committee for the 2024 calendar year. Motion carried: 5/0 General Preservation • None Inquiries/Applications for Uses or Structures on Preserved Property • None Stewardship and Management • Treiber Farms LLC SCTM# 1000-69.-1-9.1 —Artist Residency and Proposed Art Walk The Committee reviewed photos posted by Cooler Gallery on their Instagram (@waycoolergallery) and website related to "Cooler Ranch,"an artist residency created in partnership with Treiber Farms on one of their DRS farms. The photos depicted several art installations dating back to 2019, a chicken coop converted into an artists' space, public receptions related to the art installations, and plans for a public- facing native wildflower art walk on the easement area. The Committee also reviewed the applicable development rights easement, which limits use of the property to agricultural production. The Committee explained that, public mazes and walks through crops are only consistent with the easement if they are harvested, such as corn or sunflowers. The Committee determined that the uses depicted in Cooler Gallery's photos—including public-facing art installations and a planned art walk—do not constitute agricultural production and are therefore inconsistent with the easement. The Committee directed Lilly to draft and send a letter informing the owner that these uses violate the terms of their development rights easement. The Committee also agreed that the property should be monitored. Motion carried: 5/0 The LPC members entered into EXECUTIVE SESSION at 7:30 p.m. Meeting locked. o Lillian McCullough, Land Preservation Executive Assistant, gave updates on inquiries, new applications, appraisals and current applications.
