The house foundation has been installed but due to an error on the part of the surveyor the westerly front yard was not outside the 50 foot setback line as shown on the filed map. Accordingly, the Building Department issued a Notice of Disapproval dated May 29, 2001, a copy of which is enclosed. I have made an application to the Zoning Board of Appeals but quite frankly, I do not think this is a Zoning issue. It would appear that the Planning Board pursuant to the Covenants and Restrictions has the right to hold a Public Hearing to give relief to the property owner for the situation. I have been attempting to get a hold of the Town Attorney and I understand that you have also written him a letter. Please accept this letter as a formal request for the Planning Board to hold a hearing permitting the house to stay in its present location.
