WORK SESSION
Present: Supervisor Jean W. Cochran, Justice Louisa P. Evans, Councilman
William D. Moore, Councilman John M. Romanelli, Councilman Brian G. Murphy,
Town Clerk Elizabeth A. Neville.
Absent: Councilwoman Alice J. Hussie, Town Attorney Gregory F. Yakaboski.
9:11 A.M. Appointment with Comptroller John Cushman re: Health Insurance
Provider. Mr. Cushman presented the board with a competitive chart showing the
break down of what H.H.S. is doing now, what they propose to do in 1999, and
figures for other health insurance administrators. One of these companies, Island
Group Administration, Inc., had competitive figures very close to our current
company H.H.S., the other one, Benefit Plan Administratorsdid not come close.
It h=s been said that Island Group Administration takes a more aggressive look
where they go in and negotiate with the doctors to try to get better services at
a lower cost. Our insurance consultant William F. Mullen, Jr. has recommended
that we centract with Island Group Administration. Supervisor Cochran asked
Mr. Cushman if they could give it to Island Group Administration, Inc. for a
year and then review their services and costs to be ~sure that they have
produced better services and costs for the Town. Mr. Cushman replied that this
could be done and added that he feels the service will be at least equal to
H.H.S., Island Group has a very good reputation locally and he is of the
opinion that they will do a good job for the Town. (Resolution No. 26 was placed
on the agenda to hire Island Group Administration for 1999.)
9:32 A.M. - IV. FOR DISCUSSION ITEMS. IV. 2. Mattituck Inlet Erosion
Study Councilman Murphy reported on his meeting with the Department of State
last week. The Corps of Engineers, the NYS Department of State and the Town
of Southold will be initiating a Section III study of the impact of the Mattituck
jetties and maintenance dredging on the shoreline and initiate an action to
mitigate the problem. To begin this study a letter is required from the Town of
Southold to the NYS DEC outlining the problem and asking for their help. New
York State will then send a letter to the Corps of Army Engineers requesting
their assistance to cost-share a solution. Supervisor Cochran questioned if it is
definite that this grant would cover work at MattJtuck Inlet. Councilman Murphy
answered yes, and explained that the money comes in at the time of the solution.
The Town will only be required to provide in-kind services such as studies,
maps, etc. A significant amount of shoreline data and study work has already
been done in our Mattituck Inlet to Horton's Point Shoreline Erosion Study and
should be considered our part of the funding. Councilman Murphy stated that he
expects Goldsmith's Inlet to be dredged this winter. Supervisor Cochran stated
that the Mattituck Park District owns on both sides of the Mattituck jetty and
questioned if they have been contacted, she said that she didn't think so.
Councilman Murphy said that he thought Jim McMahon had contacted them.

the necessary letter to the NYS DEC.] - IV. 3. Gasoline and Diesel Fuel Bids -
Request was received from .S. uperintendent R. aymond Jacobs recommending that
the Town Board accept the b.ds of Petro Heatln~ Services S Fuel, Inc., together
with his reasons for not accepting the bids of All American Fuel Co. (Resolution
Nos. 27 and 28 were placed on the agenda to accept the bids of Petro.) IV.1.
Tourist Information B~oth .Bids Exe~:utive Assistant James McMahon appe--~-~
before the BOard and .explained. that Jamie Richter is estimating that We are still
short about $~,000.00 ~n funding for this booth. Supervisor Cochran stated that
he will be asking for the additional $~r, 000.00 from park S playground funds
because she would I'ike t°. see it completed in the near future. The SUpervisor
questioned when the NYS DEC will start their work on the road and the lake?
Mr. McMahon stated that it is scheduled to begin in the early spring. (See
Resolution No. 29 accepting the bid of Construction Consultants of L.I. and
Resolution No. 30 authorizTng a $4,000.00 bid modification from park S
playground to chamber booth Tmprovements.) IV. 4. Complaint from Michael Z.
Herbert about a burglar alarm. The Board had no solution for this. Councilman
Moore stated that he feels it should be enforceable under "disturbance of the
peace" under State Law. He pointed out that other municipalities who have
enacted "Noise Ordinances", have them on the books just to pacify the people
but they don~t really work. IV. 5. Creation of a Southold Town Economic
Committee Supervisor Cochran presented her mission statement and goals for
this committee and advised that she also has a llst of names of persons who she
would like to serve on it. This will be a 5upervisor~s committee. In addition to
this committee, she would also like to put a committee in place to review the
entire code. This Economic Committee will be reviewing certain sections of the
code, but she also wants another committee to review the entire code. IV. 6.
Health Insurance for Retirees Age 50-55.
On motion by Councilman Moore, seconded by Councilman Murphy, it was
RESOLVED that the Town Board enter into executive session at 10:10 A.M. to
discuss contract negotiations relating to IV. 6. Health Insurance for Retirees
Age 50-55. Vote of of the Board: Councilman Moore, Councilman Romanelli,
Councilman Murphy, Justice Evans, Supervisor Cochran. Also present: Town
Clerk Elizabeth ~. Neville.
Executive Session ended at 10:20 A.M.
RE: IV. 6. Health Insurance for Retirees Age 50-55. The Board will allow them
'to Self pay to retain the insurance. The Town will not pay for it between the
ages of 50-55, but will pay at age 55, provided the retiree has maintained and
payed for it between 50-55. The Town Attorney will be asked to draft legislation
and present it at the. December 8th meeting; A policy will be developed on this.
IV', 7 East-West Fire District The'Town has asked the other fire departments in
town if they would be interested in providing this service. The current
contract will expire on December 31, a letter requesting an extension will be
sent to the Gr&~nport Village Board Trustees. Councilman Moore stated that he
Wouldr jUSt like to shop around, to date there has been no proposals for a new
contract with the Gi;eenport~ and he would just like to see if any other
depm~tments are inter&steal. IV. 8. Quit Claim Deed This will be held until the
afternoon appointment with Mr. Daniel Mooney, Esq. IV. 9.' Dredging of town
creeks by Co.u:nty of Suffolk. The list didn't appear to be complete, the Board
will ~heck with James McMahon on which creeks are to bp included. (See

10:38 The Town' Board reviewed the resolutions to be voted on at the regular
4:30 P.M. meeting.
10:55 A.M. - The Town BOard recessed for lunch at 10:55 A.M. to 1:30 P.M.
1:30 P'.M. Appointment. Community Preservation Fund. Richard Ryan, Chairman,
Southold Town Land Preservation Committee , Tim Caufield, Peconic Land Trust,
and :Melissa Spiro and Valerie Scopaz of the Planning Board were present.
Chairman Ryan voiced his concern that their committee cannot do it all. There
is too much on their plate to be responsible for the administration Of the 2%
Community Preservation Fund. SUpervisor Cochran agre~d and said that she
never Could see it being done all by one committee. The TOwn Board will have to
sit down and develop the work plan and designate wh° is responsible for what.

Supervisor Cochran ~informed the Board that she would like to set up a date for
a retreat for' this purpose. Justice Evans questioned if the money from the 2%
fund can be used for administrative purposes? Supervisor C~.chran and
C0un~ilman Moore both' answere, d yes, up to 10% of it. Counmlma. n Moore
remai~i~ed that there i~ ia recogmtion that 3;ou will have to keep good paid people
on bb~rd for this purpose. Supervisor C0chran informed Mr. Ryan and his
committee that as soon as the Board has the retreat, they wJl'l get back to them.
Unde~ ~Local Law !No~ 13 on the Community preservation Fund, ali of the members
of ther Southold Town Land Preservation Committee are to serve concurrently as
membef~ of the Community Preservation Fund Advisory Board. AS such, °aths

of office should be administered to all of them. Richard Ryan recommended that
an appraisal be done on the Cherepowicz property at East Marion. They have
two (2) estimates for appraisals: Stype in the amount of $1,500.00 and Patrick
Given in the amount of 92,500.00. It was recommended that Patrick Given be
hired to do this particular appraisal as a more in-depth evaluation is needed on
this property. Tim Caufield stated that he has worked with him and from his
experience, he does an excellent job. Civen Associates does all of the work for
Southampton Town and the Peconic Land Trust. (Resolution No. Itl was placed
on the agenda to hire Given Associates for this appraisal .)
2:00 P.M. Anna Cosimano, President of the North Fork Animal Welfare League
appeared before the Town Board to discuss the renewal of their 1999 contract.
She introduced Joseph W. Irwin, Accountant for the NFAWL who presented a
"Analysis of the Town Contract Fund Balance. The financial statements showed
an operating deficit of $63,573.00 which they claim started when the NFAWL
began operating in 1965:. because the Town has not been splitting the expenses
with the NFAWL, Mrs. Cosimano recalled that she appeared before the Board in
August with plans for a new building to replace the existing trailer and stated
then that she needed $10,000;00. She said that it was her understanding from
Mr. Romanelll that $5,000.00 had been put aside, and she also appeared at the
preliminary budget h~ar. in:g to state her case. The budget was adopted on
November 10, 1998 ~nd nothing was put in for the NFAWL. Ms.Cosimano
described the operations of both the Southampton and Brookhaven and the size
of their operating budgets and the fact that Southold is a "no kill" shelter, as
opposed to both both of them; and stated that Southold operates much more cost
effectively than they do. Ms. Cosimano advised thal~ they are asking for

2:37 P.M. Appointment with Daniel C. Mooney, P.C..appeared befo.re the Town
Board with regard to a CertifiCate of Abandonment whml~ was done in September
1998 on a roadway nearL Mattituck Creek. The owner of both parcels on either
side of side of the rozdway, Nancy Lee Wellin, is under contract to sell the
properties and the title! company will not insure the title unless the Town of
Southold delivers; .~a Quj~clmm Deed to Mrs. Wellin. The Town Board agreed to
authorize the Supervisor to execute this quit claim deed. (See Resolution No. ~3.)
3:05 P.M. - Appointment with Vince Rossi for a temporary trailer permit for the
General Wayne Inn (owner Christine Larsen, President Lambda Associates) to be
used as temporary ivlng quarters while the Inn is being renovated. The Board

RESOLVED that the Town Board enter into Executive Session at 3:10 P.M. for
the purpose of discu~sin~ litigation of the NYS DEC vs. Town of Southold
regarding the 1986 oil~: spdl at Ray's Service Station. Vote of the Town Board:
Ayes: Councilman Moore, Councilman Romanelli, Councilman Murphy, Justice
Evans, Supervisor Cochran. Also present: Town Clerk Elizabeth Neville and

A Regular Meeting of the Southold Town Board was held on
November 2ti, 1998, at the Southold Town Hall, Main Road, Southold, New
York. Supervisor Cochran opened the meeting at ti:30 P.M. with the Pledge
of Allegiance to the Flag.

SUPERVISOR COCHRAN: As you [(now there are agendas out in the hall if
you would like one, and as reported on the agenda the Town Board
receives different reports be it the Recreation Committee, the Town
Trustee, Police Department, so on and so forth. We get a report every
month from the different departments, and from different committees, and
they are placed on file in the Town Clerk's Office. They are available for

III. COMMUNICATIONS
SUPERVISOR COCHRAN: We have had congratulations in the way of
communications in relation to the Community Preservation Fund, and
greetings from Sandy Treadwell, Secretary of State.
IV. PUBLIC HEARINGS
1. 5:00 P.M., on the Acquisition of Development Rights in the
Agricultural Lands of Richard Reinhardt, SCTA #1000-102-04-po005.
2. 5:05 P.M., on the proposed "Local Law to Amend Chapter 45 (Fire

Southold".

V. RESOLUTIONS.
SUPERVISOR COCHRAN: As you know the Town Board has a policy that
sets aside time prior to the adoption of resolutions for anyone that would
like to address the Board in relation to any of the resolutions, that are on
the agenda for action. At the end of the adoption there is time where
anyone from the community may address the Town Board on any Town
Board business or matter. So, at this time, I will call for anyone that
would like to address the Town Board in relation to the resolutions. Mr.
Carlin?
FRANK CARLIN: Frank Carlin, Laurel. Ladies and gentlemen, Number 35
pUrchasing development rights in the agricultural lands of Richard
Reinhardt. When you purchase farmland, this is a purchase of farmland,
right?
SUPERVISOR COCHRAN: The development rights.
FRANK CARLIN: Do you you have a standard amount you pay for an acre
when you buy all this open space preservation, or you just go $9,000 for
this guy, and $6,000 for this guy, $11,000 for this guy per acre? Do you
have some kind of standard format that you use to standardize when you
buy all this property?
SUPERVISOR COCHRAN: I don't think you could say it was a standard.
What is standard is you have to have all of it appraised.
FRANK CARLIN: Because I will tell you why, I didn't say nothing about a
month ago, the Fitzgerald property that you bought in Fishers Island, an
acre and a half of property. I believe you paid $78,000 for it. That comes
to $17.30 per square foot for an acre and half of land. Three times $78,000
is a lot of money. Why?
COUNCILMAN MOORE: Waterfront property, that ~ is why~ they are
appraised, waterfront property for park purposes. It was also 'zoned
commercial. There was commerCial zoning on that preperty.
FRANK CARLIN: Didn't I hear somebody mention that night, that you can
use it as a business zone?
COUNCILMAN MOORE:

It is a business zoned piece of property. That
SUPERVISOR COCHRAN: It has a dock on it.
FRANK CARLIN: I am mixed up here. I thought farmland preservation was
to preserve the land.
SUPERVISOR COCHRAN: This is open space.
COUNCILMAN MOORE: This is an open space acquisition. It is different
funds.
FRANK CARLIN: I know that. It is tax money, but anyway that is a lot of
money.
SUPERVISOR COCHRAN: It is, Frank. We looked at the appraisal, and it
was on line. It wasn't out of whack. You have such a limited amount of
property that can be purchased on Fishers Island. It is adjacent to a public
beach, which the residents, year-round residents, and many of the
residents of Fishers Island feel that is their swimming beach, which it is.
It is where the kids have swimming lessons, the whole bit. It is zoned
commercial. That entered into it. It has a lovely dock on it, that we are
hopeful that it will..as far as I am concerned it is available to all
residents of Southold Town. If you are going over to Connecticut with
limited..being able to dock overnight perhaps, so it does have certain
things that have a value, and the money was attached.
FRANK CARLIN: Yeah, if it has all that on it, docks, and swimming, and
all that, would you consider that open space or farmland then?
SUPERVISOR COCHRAN: It was open space, parkland.
FRANK CARLIN: Parkland, and it has all that other stuff on it, right?
SUPERVISOR COCHRAN: The beach isn't ours. We didn't buy the beach.
We bought a piece behind the beach, and we bought the piece adjacent to
the beach. Frank, we felt it was a lot of money, too, but we had to weight
the importance and the availabillty of land in planning for the future.
FRANK CARLIN: I would never spend $378,000 if the land was made out of
gold.
SUPERVISOR COCHRAN: I know. I can't argue with you, but it was the
decision we made. Mr. Gold?
JOE GOLD: Joe Gold, Southold. Number 15, is Paul Foley a resident of
the Town of Southold?
JUSTICE EVANS: He is not a resident, as far as I know, of Fishers
Island, but he works for the Ferry District, which goes to New London
from Fishers Island. I don't think many of 'the people that work for the
Ferry District are residents of the town, just because of logistics.
JOE GOLD: Resolution 17, is Michael Wilson a resident of the Town?
SUPERVISOR COCHRAN: I have to say, I don't know. I didn't check.
These were put on by department heads, and I am assuming that was
checked out. If it wasn't I can hold them, and we will pass on them next
meeting, or look at them.
JOE GOLD: Is MiChael Wall a resident of the Town?
SUPERVISOR COCHRAN: I just got finished answering you.
JOE GOLD: Okay. ~.The problem is, when I see appointments I also check
the registered voter list, to make sure the Board didn't slip up, and
appoint a Democrat by mistake, and I find that these people are not
registered voters.
COUNCILMAN MOORE: They fill out a job application, where they put their
name, address, and where they profess their residence. To what extent
that is checked, I know it is not checked against the voter list to confirm
as b~sls of residency.
JOE GOLD: It just works out that way, but that is for another time. The
problem I see is that we have a significant number of non-Southold
residents employed in various functions in the town, and I think that since
there have been comments made that there aren't enough jobs here to keep
our young people, that is something that ought to be preference item,
checking the town of residents for Town jobs.
SUPERVISOR COCHRAN: Anyone that has come in for a job, or through
Civil Service that I have interviewed that is noted whether they are a
resident of the town. So, one comes from the landfill. We can hold them
both and check them, if you would like, if you feel that strongly about it.
Otherwise, we will just check in the future every single time against voter
registration lists.
JOE GOLD: That's not a guarantee.
SUPERVISOR COCHRAN: That is how you reached your decision.
JOE GOLD: That is the only list I have. They still could be residents.
COUNCILMAN MOORE: They still may answer their application truthfully,
though.
SUPERVISOR COCHRAN: Anyone else like to address the Town Board?
(No response.) If not, we will begin the resolutions.
.-Moved by Justice Evans, seconded by Councilman Romanelli, it was
RESOLVED that the Town Board of the Town of Southold hereby
authorizes and directs Supervisor Jean W. Cochran to execute a lease
agreement between the East Marion Fire District and the Town of Southold
for the black top driveway to the west of the East Marion Fire House and
the black top parking area to the north of the East Marion Fire House, for
a term of five (5) years, September 1, 1998 through August 31, 2003, at a
total rent of ten ($10.00), to be paid in full upon the execution of the
lease.

Romanelli, Councilman Moore, Justice Evans, Supervisor Cochran.
This resolution was duly ADOPTED.
2.-Moved by Councilman Romanelli, seconded by Councilman Murphy, it was
RESOLVED that the Town Board of the ToWn of Southold hereby accepts
the bid of Franza~s Universal Scrap Metal, Inc. to pay the Town of
Southold $25.03 per ton for the Removal or Acceptance of all Scrap Metal
from the Southold Town Disposal Area for the period December 1, 1998
through November 30, 1999, all in accordance with bid specifications.

Romanelli, Councilman Moore, JuStice Evans, Supervisor Cochran.
This resolution was duly ADOPTED.
3.-Moved by Councilman Romanelli, seconded by Councilman Moore, it was
RESOLVED that the Town Board of the Town of Southoid hereby accepts
the bid of JBH Tire Recycling, Inc. to remove or receive scrap tires from
the Southold Town Collection center for the Calendar Year 1999, all in
accordance with the bid specifications.

RESOLVED that the Town Board of the Town of Southold hereby
RESCINDS RESOLUTION NO. 23 OF THE NOVEMBER 110, 1998 Southold
Town Board Meeting,which resolution reads as follows:
RESOLVED that the Town Board of the Town of Southold hereby accepts
the resignation of Catherine Steadman as a Clerk-Typist at the Human

COUNCILMAN MOORE: There is going to be a public hearing, but those
two local laws that we are working on are to redefine buildings, try and
make life simpler around here. We are going to try, if it is adopted, to go
back to the State Uniform Building Code definition of building structures,
and the second one is to create certain exemption, also, from the State
Building Code where you wouldn't need a building permit in certain
instances, all in accordance with the State Fire and Building Code. Trying

behind you, Madam Supervisor, and I have just recently returned from
Southwold, and I would be 'remiss not to tell you, that they extend their
greetings to you, and we hope to have former Mayor of Southwold over
celebrating the 350th Anniversary of the Old House with us in August.
You will hear more about that later. I, also, am wearing a hat, because as
you know I am on the Fort Corchaug Management Committee. I want to
give you a brief update that we have just received an outline from Peconic
Land Trust. Today we will be getting back to them the next week, and
they and we will making a presentation hopefully to you on December 8th
with a little more detail of the long range plan, that we have told you we
would get back to you. The other item that I would like to mention, I would
like to talk about, is the Whltaker House. As you know I think there has
been a groundswell of support for preservation of the Whitaker House.
First of all, I commend you for buying it. I think that was a very wise
move. i would recommend, and I am not speaking wearing my hat as
Chairman of the Old House Committee or Society in Cutchogue. I am
talking about as an individual citizen, and representing our Board of
Directors, but rather than demolish the house as has been quoted in the
Landmark Preservation Commission, and with the assistance of architect Tom
and we strong y urge you, to maintain the facade, the exterior walls, and

SUPERVISOR COCHRAN: So it is okay that you come to support. Although
you live in Cutchogue it is nice that you come to support this. Frank
Carlin.
FRANK CARLIN: Good evening, ladies and gentlemen of the Board. Just
two items tonight. I would like to applaud Bill Moore and the Town Board
for putting into the Zoning Code, trying to get a viable limit here, and a
sensible way of operating this town. It shouldn't be too difficult, because
I want to tell you why. I say it the way it is. That is the way I have
been for years. I remember back in 199u~ when the Boards before this which
2/3rds of you wasn't on, come up with this four page format here on
formula food restaurants. It was in the McDonalds issue. You wrote this all
up, all kinds of stuff, no drive-through, sign, nothing on the windows,
everything they put here. That didn't take long. That went through this
Board like it was Federal Express mail on Chapter 100, so you shouldn't
have much of a problem with what you do, Bill. I want to giYe you two
examples of how this operates, and how some of our Zoning Codes are. You
restrict a man from having a drive-through window, yet all the banks have
them, gas stations have them, now we have a lumber yard in Greenport
that was recently approved, which I have nothing against the lumberyard.
You restrict a man. with golden arches that would have been only a little
higher than th!s ceiling~ h~re., lite up, but I d.efy anybodYiin this room, or
anybody in th~s toWn to drove fr~)m Laurel brld. ge e~st i~h~ough Mattituck,
and dote how many signs are much ta let than his, and ar~ lit up with neon
signs with lights. Yet~ this man was denied his proper standard golden
arch. To me, that is a double standard, and that is the ~hings we have to
work on. You ought to get that 18it page Zoning Code down to a reasonable
amount. I can never understand that. One pass through restaurant, and we
restrict a man for all kinds of ways of doing the business. I got number
two.. I want to applaud the Town Board once more for reviewing the
Architectural Reviev~' Board. I t~ld this Board six months ago, in my
opinion don't need it. I am going, te give you the r. eaS°ns for it, on~
reason, at least one. JuSt re~:er~tly the winery over her~i' in Peconic is a
good example. It started out to ~00 feet back from the road. The Planning
Board comes well, maybe we will give thf~=guy a break, or
the people a br have 200 feet. Architect Review Board jumped
in there, and _n:o, we want 600. feet. So, they ~tart negol~iating~
Now, you can't that way. They finally settled for ;225 fe~t. I am
not against all committees, but sometimes they
get to have too much power. My opinion is the Planning Board should have
the final say. They should make the final decision, and they should live
with what they make out of the deCision. John, are you still waiting over
there for your building to be completed?
COUNCILMAN ROMANELLI: No, I have all my permits in place.
FRANK CARLIN: Nine months.
COUNCILMAN ROMANELLI: Eight months.
FRANK CARLIN: Eight months, beautiful isn't it? It took me nine days to
get a non-property line fence. You know sometimes you take longer to get a
site plan here, or a permit than it took them to build the Empire State
Building.

FRANK CARLIN: They did it in a year and a half in 1930. they built 103
story Empire State~ Building. Sometime we wait longer to get something, like
that' woman I believe in Southold here, awhile back, a log cabin. What was
wrong with'having a nice, beautiful log cabin? It went so far back. Man,
you have to buy two or three ac.res of land to :be able to, :where they want
it, to put a log c~binlot a building on too far back the road. Anyway, I
want to give you ~red|t for reviewing that Architect Review Board. The old
sayip~ is, too many hands in the ste. w spoil it. I say it the way it is, and
thatl i~ tl~e way I~m. Alice Hussie ~sn't here tonight, so ~1 have to change

SUPERVISOR COCHRAN: Is there anyone else like to address the Town
Board on any Town Board business.
OLIVE EVANS: Olive Evans. As a property owner, and someone who has
lived for twenty years here, and someone who is very fond of the area, !
would like to recommend that the Architectural Review Board Committee be
strengthened, not weakened.
SUPERVISOR COCHRAN: Thank you. Please, state your name.
HERBERT ERNST: I am Herbert Ernst.
SUPERVISOR COCHRAN: We ask for your name. Some people think it is
rude, only because when they transcribe this verbatim they pick it up on
the tapes.
HERBERT ERNST: ! would just like to remind the Board that the
Architectural Review Committee does not have any power. It is merely a
recommendation board, and the Planning Board has the power, and I have
sat at all but one meeting that it has had since it was formed. I think I
had something to do with seeing that it was put in, but I think it is a
wonderful thing to make sure that the North Fork stays the way it is, and
I certainly take exception to our last speakers' remarks.
SUPERVISOR COCHRAN: Anyone else like to address?
JOE GOLD: Joe gold, Southold. I have a couple of points. Perhaps
repetitious, but there is an easy way around it. Once again we generalized
Executive Sessions in agenda. Perhaps there is a more specific reason. I
wasn't at the work session, but executive session/litigation is not good
enough, and you all know that.
SUPERVISOR COCHRAN: I believe when the motion was made it was
specified that it was litigation, a law suit between New York State and the
Town; of Southold in relation to a oil spill up on the Peconic Lane, which
used to be know as Ray's service station. That was all spelled out and
recorded.

JOE COLD: The second thing I noticed the Town is advertising for an
AsSistant Town Attorney, and I also noticed that sometimes we have an
Assistant Town AttOrney, sometimes we don't have an Assistant Town
Attorney. So, I looked back over the record to see what is the
correlation? The only correlation that I have been able to find so far is
that we get an Assistant Town Attorney when you have a Republican
Supervisor, and majority on the Board.
SUPERVISOR COCHRAN: My response to that, as your Republican
Supervisor, is that it does not enter into the political arena. I am in this
office, and serving in this position full-time, as is the Town Attorney here
full-time, and the amount of work that we are putting throUgh this facility,
and town government, and town business, needs additional work in that
department, additional support, so that is our reason.
JOE COLD: My last comment is one that I really had hoped I wouldn't have
to make, and that is there has been another meeting of the Anti-Bias Task
Force, and as far as I know there is still nothing is going to happen in
this town to memorialize the terrible death of Matthew Sherman. If I am
wrong, Bill, then straighten me out.
COUNCILMAN MOORE: Actually, Joe, you are right, and it is very
unfortunate, because the comment that was made there was that the Anti
Bias Task Force dropped the ball on that, and there were apologies around
the table that day. It perceived that any formal action at this stage of the
game would be perceived as being too little too late. There was also a
concern that to draw attention to that particular incident now it could
hinder further efforts to get hate crimes legislation adopted in Albany,
that at this point they are trying to get language and statue in place, and
they do no want it to become solely an issue of gay rights, and things like
that. There are hate crimes, but there are a variety of categories spelled
out in legislation. Dismay was raised at that Board meeting, saying what
happened here? This thing came up. The Board didn't do anything.
Nothing happened. At the next committee meeting, and it was fully
discussed, and with a great degree of disappointment, that nothing formal
happened at that committee.
JOE GOLD: I have to. tell you I think that is shameful.
COUNCILMAN MOORE: I urge you to come to the next Anti Bias Task
Force meeting, and say that, and that is fine. I will relay it back.
JOE COLD: I want something to happen.
COUNCILMAN MOORE: I understand that. The Town Board does not direct
or control that Task Force, as you know.
SUPERVISOR COCHRAN: Maybe I have a suggestion. I was just last week
up in Albany to the Association of Towns, and we are working on the
resolutions for New York City for the conference, and our next meeting is
January 29th, but between now and then if any town has any legislation,
or any issue that they would like to see supported by the entire Association
of members throughout all of New York State, that please, send it in, so
we could as a Town Board and a community send a resolution up to the
Association of Towns. I know they will discuss it, and take a position on
it, and then it could be presented to the whole body, 'which is the entire
Officials from New York State, and see what can be done as far as
promoting some kind of legislation, so, yes, we can use this avenue to
bring our support to the forefront.
JOE COLD: Well, I know I am hammering the same nail, but this would
have been a simple thing to do, and it still is a simple thing to do. This
Board can decide. You don't need the Board. The Supervisor can decide
tomorrow that the town will have a gathering of the public in Silversmith
Park on Friday at 6:00 o'clock at night. Bring your own candles. It will
be a candlelight vigil. These things have happened in the Towns of
Bayshore, in Southampton, in Huntington, and the fact that the Anti-Bias
Task Force has debated this for two meetings, and produced nothing, I say
shame on them. But, that doesn't mean that everybody else can stand by,
and say, whoops.

COUNCILMAN MOORE: But, the recommendation that comes back at this
point, having not done it at what they perceive an appropriate time, was
not to..thelr focus is an inkind legislation. They are trying to push a bill
for the Senate and the Assembly, and their opinion..it~s a wide diverse
group of who sit there and bang this thing around, because at this time it
would be perceived as too little, too late. At the same time they say it is
unfortunate that we do that. Having said that they do not want to draw
this proportionate attention to one facet of the hate crimes legislation,
and that was the consensus that came out of the Anti-Bias Task Force
meeting last Thursday. You disagree with that, and that is good.
JOE COLD: I don't disagree with it, but it seems to me when they say it
is too little, too late, Matthew Shepard is still dead, so it is not too
late. The people who are charged with beating him to death, their trial has
been underway. They will be convicted and sentenced before anything
happens in the town, and to me it make our resolution that this a bias-free
town just a bunch of words. It makes our resolution that this is a bias-free
year just a bunch of words. We are not willing to stand up and at counted,
when something terrible happens, and we have examples throughout our
recent past, that when good people do nothing evil triumphs, and that is
what is happening here. Good people are doing nothing, and if we have to
play some games with legislators, so we don't offend them, pox on them,
because that is even worse.
COUNCILMAN ROMANELLI: I think when something terrible is happening in
this town, the good people stand up and be counted. I mean, you bring
the town into a national issue, it is a great opinion that you have. Co
forward with it, but I have to firmly believe that if a sensitive issue
happened within this Town Board is that you would see a lot of good people
stand up, and be up in arms to show you that the anti-bias town ~s not
just a play on words. It is a group of people who are very concerned about
community living, and a community that we can control, what to stand up
and prove something in our town, so you can stand there, and try to make
a national issue out of this in our town, but when something happens in
this town I think you will see hundreds, and hundreds, and hundreds of
people stand up.
JOE COLD: John, that is my point. My point is we can't wait until
something happens in this town, because of course, if something happens in
this town everybody will decry it. We have got to point out to people that
this kind of behavior is intolerable, that there is no level of toleration
for bias. It doesn't make any difference who the bias is directed against,
and the way that will make sure that nothing happens in this town is
preventative, not reaction, not when something happens in this town we will
have a monster outcry. Of course we will, but that is too late.
COUNCILMAN ROMANELLI: I have a que. stion while you are up there. The
other comment you made about the Town Attorney, and me, Republican
Board. Did you make that comment, as a concerned citizen, or head of the
Democratic Party?
JOE COLD: I have difficulty shifting shapes. I make it as both, John. I
am a concerned citizen, because I see another job on the payroll, and we
go for many years without that job, and then all of a sudden we have that
job. I also make it as head of the Democratic Party, because I can almost
guarantee you without even knowing who the candidates will be I know what
the political registration of the winning candidate.
SUPERVISOR COCHRAN: I will take it to the Association of Towns. It is
important that that entire New York State is behind this legislation. Is
there anyone else that would like to address the Town Board?
OLIVE EVANS: This is a related issue to the woman that someone was
speaking about. The ICA in Southold almost constantly has signs that
they need help, so I spoke to the manager at some point, and said, are you
an equal employment opportunity employer? I don=t think he quite knew
what I meant by that, but I explained. I said, there are a lot of African
American people, I am sure, who would like the job as a cashier in the
store, and I have never have seen a black face at any of those machines in
all of the years that I have lived here, and I just brought that out for
youi' consideration.
SUPERVISOR COCHRAN: Thank you. Sir?
HANK KUHN: Good evening. Hank Kuhn from Laurel. I just wondered
if the Board could tell me where we stand concerning the Huntington
lawsuit against LILCO?
SUPERVISOR COCHRAN: Our Town Attorney, you were going to
communicate with him?
HANK KUHN: He .was going to call me. It never happened.
SUPERVISOI~i COCHRAN: Then I will make a note. He has been out sick.
He is supposed to be calling you? We haven t gotten anything, no. He won't
be in tomorrow, I know, because he was going to the doctOr tonight.
HANK KUHN: Can I look forward to seeing some information at the next
Board meeting? ~
SUPERVISOR COCHRAN: Yes, but I would expect him to call you prior, or

to have ~co negotiat& between the Planning Board, and the Architectural
Review Board, then it comes it becomes more than recommendations, is what
I am saying. It becomes more. Thi.s is what you don't need. You need the

SUPERVISOR COCHRAN: Thank you, Frank. Anyone like to address the

anything: to report?
COUNCILMAN ROMANELLI: .One nice thing I would like to report is I had
the: pleasure of ,the Village of G.reenport had their Music .F, estival on
Sunday. ~vhen they had a concert pianist there. ,It was very different for
Sou~hoid, !Town. The room was packed. The auditorium in Creenport was
packe,d.. .il~t ;was standing room only actually on the sides, and it. was
somethlngi that if they do it again along those lines I urge the publ,c to
come. It Was, very entertaining, It was a good job by Greenport School, and
the i Village.
SUPERVISOR COCHRAN: Thank you, John.
COUNCILbLAN MOORE: While we are passing out congratulations, I
congratulate the Mattituck PTA for a very successful event this- past
Friday ni,ght, and that was they invited the Harlem Wizards, which is a
team somewhat like the Harlem Globetrotters, to come and make fools of a
bunch of us. I was one of the players on the team. The man I guarded
was 6"11"~ and that makes him a foot taller than me, and when I stood next
him I~tell you it looked more like a yardstick taller than me. I tried to
engage h~m in conver~sation, and I don't think he heard me. At one point he
looked down and sai~l, yeah, and that was the extent of that, but it was
quite fun. They packed that house with over 700 people in there. A
really good time. The soccer team arrived back from Poughkeepsie just in
time for half time, and as you know they had gone quite a ways in the
Stat3 Tournaments, and were defeated, and they came home rather
disappointed, but the 700 and something people in the auditorium gave them
a standing ovation, and had some seniors with tears in their eyes. It was
very nice to see some great school spirit up in Mattituck 'on Friday, and to
have a really good time playing with some fun basketball players. I also had
the pleasure of attending the Save the Peconic Bays award ceremony
Saturday night. I will take a little bit of your paper, or report, Jean.
Jean was honored by the organization for her commitment and work with the
environment in land use preservation, and farmland preservation, and open
space along with other community people as well. That was held over in
Duck Walk Vineyard in Water Mill. It was very nice to see Jean's work
being honored in that regard. Finally, I am glad to see the Town Board
pushing through the process of getting local laws. Frank, you think it is
easy. It is not so easy with all the work to get a thing amended, and
adopted, and the whole process. You got to keep pushing, and pushing,
and pushing, because there ~s so many different agencies that get to have
their two bits on your work. You really have got to keep leaning on it. We
are still working on it, and we will have the public hearings.
SUPERVISOR COCHRAN: You didn't say who won the basketball game.
COUNCILMAN MOORE: Let me put it this way. At half time we were down
by ten or eight points, and over the course of half time, they spotted us a
fifteen point lead, and they took the first two minutes of the second half
very seriously. They ran the ball past us several times, and before we
knew it they were up ahead again, so they won by ten or fifteen pOints.
That would be earth shattering if we were to pull up a victory.
SUPERVISOR COCHRAN: Look at all the fun you had. Brian?
COUNCILMAN MURPHY: I had the pleasure on Sunday afternoon, I don't
know if I will be taking more of the Supervisor~s report, of attending North
Fork Environmental Council's cocktail party at Pellegrini Vineyards, and
the Supervisor was awarded their Woman of the Year for her work for the
environment, and for land preservation, and the whole gamut of things that
she has brought forth in town. So, It was an extreme: pleasure to attend
that cocktail party~
JUSTICE EVANS: CongratulatiOn, Jean.
SUPERVISOR COCHRAN: I would like to thank both the Save the Bays and
the North Fo~k Environmental Council. It certainly was an honor to be
recognized for my work with the environment. I would like to just share
with you one thing before I finish reports, and this is something I
presented to Town Board this morning in relation to business and the
economic stability of Southold Town, and we are looking at the formation of
Economics of Business Task Force, and the mission statement and goals.
The Economics of Business Task Force will act as a advisory group to
support the Southold Town Board's goal of keeping our tax base healthy,
and will investigate methods of development compatible with needs and
resources. Goals, balance open space preservation with a strong economic
base. Target industry or business in need of incentives to expand,
upgrade, diversify. Identify light industry that supports the present
economic base. DeVelop incentives that encourage light industry, and
retain, and/or create local permanent jobs. This is one. for you, Frank.
Review Code changes to determine the positive or negative effect on
business. Recommend methods to preserve the vitality of the downtown, and
I just learned today that there is a possibility of some pretty good. grant
funds to do this. So, we will be trying to get information on that
immediately, and promote courses at Suffolk Community College that prepare
residents use for employment within the area. So, this is the mission
statement, and the goals. At our next meeting we will be approving this
concept in addition to members of this committee, which will:be people from
many different areas, and different political affiliation. That's all I have
