Romanelli, Councilman Brian G. Murphy, Town Clerk Elizabeth A. Neville, Town Attorney Gregory F. Yakaboski. 1:00 P;M. - 1:25 P.M. The Board reviewed the bid pro'posals received on Bankrun Sand and rental of D8 Bulldozer for~ Landfill Capping purposes. Resolution Numbers 1 and 2 were adopted as a result. The Board also discussed participating in retaining a law firm to represent them in Cablevision franchise contract negotiations, Resolution Number 3 ,was adopted as a result. SOUTHOLD TOWN BOARD SPECIAL MEETING SEPTEMBER 30, 1998 A Special Meeting of the Southold Town Board was held on September 30, 1998, at the Southold Town Hall, Main Road, Southold, New York. Supervisor Cochran opened the meeting with the Pledge of Allegiance to the Flag at 1:00 P.M, Present: Absent: Supervisor Jean W. Cochran Councilwoman Alice J. Hussie Councilman William D. Moore Councilman John M. Romanelli Councilman Brian G. Murphy Town Clerk Elizabeth A. Neville Town Attorney Gregory F. Yakaboski Justice Louisa P. Evans SUPERVISOR COCHRAN: This a Special Town Board meeting for the purpose of reviewing bids on sand purchase, and bulldozer rental, and cablevision franchise negotiation expense. Our first order of business is the bids for the sand. The cheapest bid received was for Terry Contracting for $5.59 delivered, Is there any discussion? Anyone have any objection to awarding the bid to Terry Contracting at that price? (No response.) If not, I will have the reading of the first resolution. Moved by Councilwoman Hussie, seconded by Councilman Romanelli, it was RESOLVED that the Town Board of the Town of Southold hereby awards the bid of 75,000 cubic yards (more or less as may be needed) of Bankrun Sand for Landfill Capping Purposes to Terry Contracting and Materials, Inc. at a cost of $5.59 a cubic yard delivered to the Cutchogue Transfer Station, County Road /~8, Cutchogue, New York. Vote of the Town Board: Ayes: Councilman Murphy, Councilman Romanelli, Councilman Moore, Councilwoman Hussie, Supervisor Cochran. This resolution was duly ADOPTED. SEPTEMBER 30, 1998 SUPERVISOR COCHRAN: The second bid is on rental of a DB bulldozer for landfill capping purposes, and actually for use right now. The least expensive bid that we received was again from Terry, $8,900. Is there any discussion or comment on accepting the lowest price? COUNCILWOMAN HUSSIE: I do have a question. SUPERVISOR COCHRAN: What is your question? COUNCILWOMAN HUSSIE: this include an operator? My question is who is going operate it? Does COUNCILMAN ROMANELLI; It does not include an operator. We operate it ourselves. SUPERVISOR COCHRAN: Who has the responsibility of a part breaking down? Is it ours or is it from who we are renting it from? TOWN CLERK NEVILLE; I don't think it makes any reference. COUNCILWOMAN HUSSIE: Maybe we should hold off on this, because that could be a mess. COUNCILMAN ROMANELLI: It could be a big expense. TOWN ATTORNEY YAKABOSKI: making repairs. You could make it subject to the owner COUNCILWOMAN HUSSIE: Maintenance we can do. SUPERVISOR COCHRAN: Major repair I expect them to pay. COUNCILMAN HUSSIE: We have the bid. We don~t actually have the contract with acceptance. Moved by Councilman Romanelli, seconded by Councilman Murphy, it was RESOLVED that the Town Board of the Town of Southold hereby awards the bid for the rental of a DS, or larger, Bulldozer for Landfill Capping Purposes to Terry Contracting and Materials, Inc. at a cost of $8,900.00 per month subject to the lease agreement, all in accordance with the approval of the Town Attorney. Vote of the Town Board: Ayes: Councilman Murphy, Councilman Romanelli, Councilman Moore, Councilwoman Hussie, Supervisor Cochran. This resolution was duly ADOPTED. COUNCILWOMAN HUSSIE: We are going to appropriate $4,000 for cable franchise contract negotiations. We have to put in that is our share of it. SUPERVISOR COCHRAN: It is based on the other towns coming at their assigned amount. It is void if this is the amount, and the other towns don't agree. COUNCILWOMAN HUSSIE: They were all in favor. Moved by Councilwoman Hussie, seconded by Councilman Romanelli, it was RESOLVED that the Town Board of the Town of Soul'hold hereby appropriates $4,000.00, the Town of Southold's share, to participate in retaining a law firm to represent the Five East End Towns of Riverhead, Southold, Southampton, East Hampton, and Shelter Island in Cablevision franchise contract negotiations; and be it FURTHER RESOLVED that the Town Board of the Town of Southold hereby authorizes engaging the services of Coudert Brother, Attorneys At Law to represent them; and be it FURTHER RESOLVED that the Town Board of the Town of Southold hereby authorizes engaging the services of Coudert Brothers, Attorneys at Law to represent them; and be it FURTHER RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs Supervisor Jean W. Cochran to execute any and all necessary documents, subject to the review and approval of the Town Attorney. Vote of the Town Board: Ayes: Councilman Murphy, Councilman Romanelli, Councilman Moore, Councilwoman Hussie, Supervisor Cochran. This resolution was duly ADOPTED. SUPERVISOR COCHRAN: Can I have a motion to adjourn? Moved by Councilman Moore, seconded by Councilman Murphy, it was RESOLVED that this Town Board meeting be and hereby is adjourned at 1 :~0 P.M.
