Dear Madam/Sir:
Based on the information you have submitted, the New York State Department of Environmental
Conservation has determined that the property landward of the functional paved road (Cox Neck Road),
greater than I00 ft. in length and constructed prior to 8/20/77, as shown on tidal wetland map 704-540,
is beyond Article 25 jurisdiction.
Therefore, in accordance with the current Tidal Wetlands Land Use Regulations (6NYCRR Part 661)
no permit is required under the Tidal Wetlands Act. Please be advised, however, that no construction,
sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional
boundary, as indicated above, without a permit. It is your responsibility to ensure that all necessary
precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground
surface or vegetation within Tidal Wetlands jurisdiction which may result from your project. Such
precautions may include maintaining adequate work area between the tidal wetland jurisdictional
boundary and your project (i.e. a 15' to 20' wide construction area) or erecting a temporary fence,
barrier, or hay bale berm.
Further, the parcel is greater than 100 ft. from regulated freshwater wetlands. Therefore, no permit is
required under the Freshwater Wetlands Act (Article 24 of the Environmental Conservation Law).
Please be further advised that this letter does not relieve you of the responsibility of obtaining any
necessary permits or approvals from other agencies.

Dear Mr. Sherlock:
With many regrets, we will not be able to complete your project until payment is secured for the sub-
contractors. I am not able to schedule contractors without sufficient funds prior to work performed.
And since you have not kept with the payment schedule, refused to sign additional work orders,
refused to pay sub.contractors, ingulted professionals, and delayed the project, I am very concerned
about your fulfillment of the contract.
There an: many rea~sons for me to be cautious of your intentions. You p~sistently haggled the sub-
contractor's contracts, after services were provided. Your unwillingness to pay for work orders or
exltas; whereby you requested the sub-eonaaetors provide material and/or additional labor. The sub-
contractors are unsure of final payment being made and will not return until payment is secured or they
are paid in full before work will commence and completion fulfilled.
The project became delayed by your lack of communication, when you personally hired and/or
scheduled sub-contractors; and/or performed some of the construction yourself: thereby deferring the
anticipated completion date. This in effect caused other sub-contractors an inability to perform and
keep with the schedule.
You have also eritized the perfoi-mance of many of the sub-eontngtors comparing their work to that of
third graders. Mr. Sherlock, I assure you, I only him licensed & insured professional sUb-contractors
with outstanding reputations in their profess/on. You felt it necessary to bring in cheap un-insured and
un-licensed sub-contractors to perform the work on your home, paying them cash in hopes it would
save you a few dollars. This, I warned you is very dangerous and could be a risk of injury and/or
lawsuit. As stated in my contract, I will provide licensed & insured contractors. I hold NO
r~poaaib'flit~ for contractors YOU hired which are not licensed & insured.

their fights.
Addendum "A" is attached showing the funds allocated to the following Sub-Contractors for services rendered
and any outstanding balances due and payable upon completion of the project. The Sub-Contractors are no
longer assured of payment therefore; payment directly from the bank is required in order to complete project; or
paymeat by certified bank check in full before services rendered.
All possible actions were taken in order to prevent such occurrences on behalf of the Project Manager; but
homeowner insists on defaulting in payment to sub-contractors and Project Manager. If payment for services

Based on the information you have submitted, the New York State Department of Environmental
Conservation has determined that the property landward of the functional paved road (Cox Neck Road),
greater than 100 ft. in length and constructed prior to 8/20/77, as shown on tidal wetland map 704-540,
is beyond Article 25 jurisdiction.
Therefore, in accordance with the current Tidal Wetlands Land Use Regulations (6NYCRR Part 66 I)
no permit is required under the Tidal Wetlands Act. Please be advised, however, that no construction,
sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional
boundary, as indicated above, without a permit. It is your responsibility to ensure that all necessary
precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground
surface or vegetation within Tidal Wetlands jurisdiction which may result from your project. Such
precautions may include maintaining adequate work area between the tidal wetland jurisdictional
boundary and your project (i.e. a 15' to 20' wide construction area) or erecting a temporary fence,
barrier, or hay bale berm.
Further, the parcel is greater than 100 ft. from regulated freshwater wetlands. Therefore, no permit is
required under the Freshwater Wetlands Act (Article 24 of the Environmental Conservation Law).
Please be further advised that this letter does not relieve you of the responsibility of obtaining any
necessary permits or approvals from other agencies.
