All elements of the approved site plan, including the handicapped parking spaces and required Iogos, on a paved asphalt lot in the appropriate location, have been completed. The parking plan now shows 28 angled spaces in the main lot, and three additional overflow spaces on the easterly lot. Lighting and landscaping are complete. The Planning Board therefore recommends that the Certificate of Occupancy be issued. STATE OF NEW YORK DEPARTMENT OF STATE 4 I STATE STREET ALBANY, NY I 2~23 I -000 I SOUTHERN REGION BOARD OF REVIEW In the Matter of the Petition of: The Shady Lady For a Variance to the New York State Uniform Fire Prevention & Building Code DECISION PETITION NO. 1999-0918 Upon the application of The Shady Lady, filed pursuant to 19 NYCRR 450 on September' 29, 1999, and upon taking testimony and hearing argument thereon at a duly noticed headng before the Southern Region Board of Review held in the Town of Brookhaven Office Complex, 3233 Route 112, Medford, New York, on November 3, 1999, and upon all other papers in this matter, the Board makes the following determination: NATURE OF GRIEVANCE AND RELIEF SOUGHT The petition pertains to additions and alterations to an existing building of C5.1/B2 (mixed assembly/transient) occupancy, two stories in height, of type 5b (wood frame) construction, approximately 9,420 square feet in gross area known as "The Shady Lady", located at 305 North Road, Greenport, Town of Southold, County of Suffolk, State of New York. The petitioner is seeking relief from: 9 NYCRR 77t.4(a)(6), which stipulates that not more than one occupancy group ~s permitted in a building of type 5 construction. 9 NYCRR 705.4(a)~Table V11-705, which does not permit a C5 occupancy in a 2 story type 5 building. [The petitioner requests relief to allow an approximate 9,420 square foot, 2 story, type 5 building with a C5 (restaurant) occupancy on the first floor and 8 lodging rooms of B2 occupancy on the second floor.] FINDINGS OF FACT 1. The building that is the subject of this petition is properly classified as a mixed C5/B2 occupancy, of type 5b construction, and is located outside of fire limits. 2. The proposed additions and alterations will exceed 50 percent of the replacement cost of the building and therefore will cause the entire building to be in conformance with the requirements of 9 NYCRR 1232, as per 9 NYCRR 1231 4(6) Petition No. 1999-0918 Page 2 3. The building has been gutted with the exterior wood frame walls standing. 4. The plans call for the existing exterior walls to remain, but to be extended to create an increased ceiling height. 5. The building is required to be a minimum of type 4 construction. The petitioner states in documentation submitted that the existing building would have to be demolished down to the foundation in order to provide the required masonry exterior walls of type 4 construction, and that the existing foundation would need modification to support exterior masonry walls. The cost would be prohibitive. 6. The petitioner purposes to install an approved smoke-and fire-detecting system and approved automatic sprinkler system with central station monitoring, in compliance with the latest edition of NFPA-13. 7. 9 NYCRR Table 11-705 footnote 4, allows a fire area of 6,000 square feet for a two story building of B2 occupancy, with the installation of an automatic sprinkler system. 8. The petitioner is proposing to provide a limited use/limited applicability elevator for vertical accessibility. 9. The petitioner proposes to provide quick response sprinkler heads on both sides of all double door openings in the lobby area, rated Walls of the lobby enclosure, and provide enclosures for the stairs at the second story. 10. The petitioner has provided 9 alternatives to strict compliance with the New York State Uniform Fire Prevention and Building Code. CONCLUSIONS OF LAW Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would entail practical difficulties or unnecessary hardship, would create an excessive and unreasonable economic burden, and would be unnecessary in light of alternatives which ensure the achievement of the Code's intended objective or in light of alternatives which, without a loss in the level of safety, achieve the Code's intended objective more efficiently, effectively or economically. DETERMINATION WHEREFORE IT IS DETERMINED that the application for variance from 9 NYCRR 771.4(a)(6) and 705.4(a)-Table Vii-705, be and is hereby GRANTED with the following conditions: 1. That the existing structure shall be elevated to type 5a construction. ~ 2. That a two-hour fire separation between the first floor C5.1 occupancy and the second floor B2 occupancy shall be provided. ? 3. That the second floor corridor shall be enclosed in a two-hour fire resistant construction on the walls and Petition No. 1999-0918 Page 3 ceiling. All corridor doors shall be self-closing, with a 1%-hour fire resistance rating. 4. That there shall be two remote exits from the second floor leading directly to the exterior of the building. 5. That an approved fire-and smoke-detecting system shall be installed throughout the entire building. The fire and smoke detectors shall be interconnected, audible throughout and tied to a central station. 6. That a fire sprinkler system conforming to NFPA 13 shall be installed throughout the entire structure. Quick response sprinkler heads shall be located on both sides of the double doors located in the first floor lobby. 7. That battery backup emergency lighting shall be installed in stair towers, the second floor corridor and throughout the first floor as required. 8. Exit and directional exit lights shall be installed in all exits over all exit doors. 9. In lieu of a code-compliant elevator, a limited use/limited application elevator for interior access for the physically handicapped shall be provided, and that LULA elevator shall meet the requirements of Part 25 of ASME A-17.1. 10. That the construction documents provided for building permit purposes and construction purposes contain substantial architectural detailing that shall indicate code compliant fire separations and building component assemblies that are in accordance with approved listings and the New York State Uniform Fire Prevention and Building Code. Furthermore, it should be noted that the decision of this Board is limited to the specific building and application before it, as contained within the petition, and should not be interpreted to give implied approval of any general plans or specifications presented in support of this application.
