No. 4947 – DANIEL and MARY ALICE KOHS. STREET & LOCATION: 900 Minnehaha Boulevard , Southold; Parcel 1000-87-2-6. DATE OF PUBLIC HEARING: May 3, 2001 FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: Applicants' property consists of 12,739 sq. ft. in area with 115.15 ft. frontage along the west side of Minnehaha Boulevard in Southold. The property is improved with a one- story frame dwelling, accessory garage building, and accessory shed. BASIS OF APPLICATION: Building Inspector's March 5, 2001 Notice of Disapproval for the reason that under Article XXIV, Section 100-2448, a principal building must be at least ten (10) feet from the side property line, and the addition connecting the accessory building to the principal building does not meet this requirement. AREA VARIANCE RELIEF REQUESTED: Applicants are proposing an addition to the dwelling to connect an existing accessory building to the principal building (rather than two separate buildings, a principal building and an accessory building). The side yard setback required for a principal building is a minimum of ten (10) feet from the side property line, and the existing accessory building is 7'3" +-from the side property line at its closest point. REASONS FOR BOARD ACTION: Based on the testimony and record before the Board and personal inspection, the Board makes the following findings: 1. Grant of an area variance will not produce an undesirable change in character of neighborhood or a detriment to nearby properties because the garage structure exists. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance because the garage structure would have to be moved from its existing legal location which would be costly. 3. The requested area variance is not substantial, representing a reduction in the side yard of only 2.8+- feet. 4. There is no evidence that the grant of the variance will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. 5. The alleged difficulty has been self-created, in part, and relates to the applicant's desire to enjoy their residence with an addition, and is in part due to the physical constraints of the lot. The house is separated from direct access to the water by a public thoroughfare constructed prior to 1975. The septic system for the property is noted on page one of the attached submission. The public hearing concerning this application was held on July 28 , 1983. The board made the following findings and determination: By this appeal, appellant seeks to construct a 24 ' by 16 ' bedroom- bathroom addition at the rear of the existing one-family dwelling, which will leave a setback of 34 .1 ' from the rear (westerly) property line. The premises in question is improved with an one-family dwelling struc- ture and two accessory buildings. The subject premises contains an area of 12, 738 square feet, and site plan dated June 13, 1983 - depicts a total area covered by structures at 16 . 90% , which does not exceed the maximum permitted. It is the opinion of the board that the location of the new addition is most feasible and reasonable under the circumstances. This is why it is very difficult for me to make this decision. I truly regret,I will no longer be able to continue your home improvement. 1.The fact of which you never wanted to commit to a signed contract for an "out of the norm"or custom design and a labor-intensive amount of intricate details,has left all the sub-contractors and I very skeptical of receiving full payment. 2. When presented with an extras' invoice for Time&Material you then wanted to re-negotiate for work already agreed upon. 3. Items on the original plans have been omitted,changed and/or re-introduced an unusual amount of times by you.This caused time spent on certain areas of construction to increase far above the norm. Since the inception of this project,you have made an unusual amount of changes to the plans. There has also been a lack of consideration on your part for added labor costs and re-negotiations on issues for which I have more than accommodated you on.I feel that we have reached a level,considering the stresses, continuing your project would be time and cost prohibitive for the both of us. I believe in the old fashion way of doing business on a hand shake,but I also believe it should be mutually beneficial to both parties that payment for services rendered not be such a battle. I assume you being a licensed architect;you can understand the nature of the business and realize,I have reduced the amount of labor costs from what a custom job like yours dictated to below average labor costs,which have been a great savings to you. I have enclosed an accounting&itemization for your job of materials, labor and all services rendered. Currently an amount of$13J54.45 is still due and payable upon receipt. This amount does not include invoices yet to be received from vendors. The agreement on creating the tower was for Labor Only,you do not wish to pay for the additional materials involved in the installation, nevertheless I will fulfill the contract made on behalf of the mason.
