Dear Mr. & Mrs. Williams:
Based on the information you have submitted, the New York State
Department of Environmental Conservation has determined that:
The property landward of the timber bulkhead which was constructed
prior to Aug. 20, 1977, shown on the survey prepared by Roderick
Van Tuyl dated July 10, 1962 , is beyond Article 25 jurisdiction.
Therefore, in accordance with the current Tidal Wetlands Land Use
Regulations (6NYCRR Part 661) no permit is required under the Tidal
Wetlands Act . Please be advised, however, that no construction,
sedimentation, or disturbance of any kind may take place seaward of
the tidal wetlands jurisdictional boundary, as indicated above,
without a permit. It is your responsibility to ensure that all
necessary precautions are taken to prevent any sedimentation or
other alteration or disturbance to the ground surface or vegetation
within Tidal Wetlands jurisdiction which may result from your
project. Such precautions may include maintaining adequate work
area between the tidal wetland jurisdictional boundary and your
project (i.e. a 15' to 20' wide construction area) or erecting a
temporary fence, barrier, or hay bale berm.
Please be further advised that this letter does not relieve you of
the responsibility of obtaining any necessary permits or approvals
from other agencies.

FINDINGS OF FACT
PROPERTY FACTS/DESCRIPTION:
This property is located in an R-40 Low-Density Residential Zone
District. This lot contains a total area of 81,921.31 sq. ft.
The subject pvemi.qos ia improved with an existing one-story fr-~me
house (to be demolished and a new dwelling with attached garage will
be constructed in a new location currently occupied by the subject
accessory building as presented on the map dated August 29, 1997. )
The subject accessory building is proposed to be located in the rear
yard with a sideyard setback at 15 feet instead of 20 feet.
BASIS OF APPEAL: Building Inspector's Action of Disapproval dated
November 19, 1997 which reads as follows: "...Under Article III. A,
Section 100-30A.4 of the R-40 Zone which references Article III,
Section 100-33 of the A-C Zone, accessory buildings on lots
containing in excess of 79,999 SCl. ft. shnll be set back no less than
20 feet from any' lot line. Existing lot contains 81,921.23 sq.
ft ....
AREA VARIANCE RELIEF REQUESTED BY APPLICANT: To relocate
existing 24.3 ft. by 18.3 ft. accessory building in the rear yard
area with a side yard setback at 15 feet and proposed to comply with
height and all other yard setback ~.~tuirements.
REASONS FOR BOARD ACTION, DESCRIBED BELOW:
(1) The granting of the area variance will not produce an undesiv-
ablc change in character of neighborhood or a detriment to nearby
properties because the proposed relocation of the aomssory building
exceeds the req,,i~cl minim,,m front yard setbacks for pvSncipal
structures, and mature tl~es will provide screening from view of
nearby properties and South Drive.
(2) The benefit sought by the apptic-~nt marmot be achieved by some

method, feasible for applicant to pursue, other than an area
variance. The rear yard is wooded and slopes toward Mattituck
Creek. Placement of the accessory building at the 20-foot code
required minimum setback would necessitate the removal of mature

(3) The requested area variance is not substantial because the
proposed 14+- ft. setback represents a 5-foot reduction in the code
required 20 ft. minimum side yard setback.
(4) The proposed variance will not have an adverse effect or impact
on the physical or envirenmental conditions in the neighborhood or
district because the yard is wooded and relocation of the house and
accessory shed will help prevent runoff from entering Mattituck
Creek.
(5) The situation has not been self-created and relates to the
topography and contours of the property.
In considering this variance, the Board finds thi.~ action is the
minimum necessary and adequate and at the same time preserves and
protects the character of the neighborhood, and the health, safety,
welfare of the cemmunity.
RESOLUTION/ACTION: On motion by Member Tortora, seconded by
Chairman Goehringer, it was
RESOLVED, to GRANT the relief requested SUBJECT TO THE
FOLLOWING CONDITIONS:
1. No heat shall be permitted.
2. No hot water shall be permitted.
3. Electricity is ~llowed, ff proposed in the future.
4. The subject accessory building shall be used in accordance with
the Code as an accessory use (for storage purposes accessory and
incidental to the main building).
