This application must be filled in by typewriter OR ink and submitted to the building
inspector with the following: for new building or new use:
1. Final survey of.property with accurate location of all buildings, property lines,
streets, and unusual natural or topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal(S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains
less than 2/10 of 1% lead.
5. Commercial building, industrial building, multiple residences and similar buildings
and installations, a certificate of Code Compliance from architect or engineer
responsible for the building. ~
6. Submit Planning Board Approval of completed site plan requirements.

PROPERTY FACTS/DESCRIPTION: The applicant's property is a 1.5+- acre parcel of land
situated along the west side of Orchard Street in Orient. Construction for a new single-family
dwelling has been commenced and inspected, based on a Building Permit issued March 3, 1999
under Permit No. 25575-Z.
BASIS OF APPEAL: Building Inspector's June 1, 2001 Notice of Disapproval denying building
permit #25575Z issued March 3, 1999 to construct a one-family house on the grounds that the
height of the as-built dwelling exceeds the Code's 2-1/2 story height limitation under Section 100-
32.
AREA VARIANCE RELIEF REQUESTED: Applicant asks the BOard to either reverse the Building
Inspector's determination that the single-family dwelling is three stories in height, or to grant an
area variance.
FINDINGS OF FACT/REASONS FOR BOARD ACTION, DESCRIBED BELOW: The Zoning
Board of Appeals held public hearings on the matter of September 20, 2001, at which time written
and oral evidence were presented. Based upon all testimony, documentation, personal
observation of members of the board and other evidence, the Zoning Board finds the following
facts to be true and relevant:
1. The subject of the vadance request concerns a 3,500 sq. ft. single family dwelling that contains
two full stodes above grade, and a non-habitable area beneath approximately one-half of the upper
area of the house set on grade level. 7',he lowest "first" story in question is a utility area that
contains three storage areas, and access doors to the utility area, and to the upper levels of the
house. There is no living space in the first floor utility area, and it has been determined "non-
habitable" by the State.
2. The height of the structure is 32 feet above grade, within the Town Code's 35 ft. maximum
height limit.
3. By way of background, the applicant applied for and was granted a building permit No. 25575,
dated March 3, 1999, to construct a single-family dwelling, all in accordance with the survey and
plot plan prepared by Gluckman Mayner Associates dated October 1998, and stamped "received
May 7, 1999" by the Southold Town Building Department.

4. Appli(~ant's attorney testified that based upon the building permit, construction commenced
during which pedod the Building Department conducted several inspections of the premises and
made no mention of a problem with the number of stories. Building Department records
substantiate that it was not until March 16, 2000 that an Inspector noted "state vadance required to
classify basement 'NOT' a story - non-habitable." The Board concurs with the State that the first
floor utility area is non-habitable and conditions its approval with this provision.
5. On July 27, 2000, the applicant applied to the State for a vadance to the New York State
Uniform Prevention & Building Code. The State granted a vadance dated April 24, 2001
conditioned upon the installation of fire and smoke detection devices and other fire safety
measures. The Board notes that in its decision the State described the first floor area in question
as a "basement with no habitable spaces within in." The Board further notes that in rendering its
determination, the State consulted with the local Town Code Enforcement Official, who had no
objection to the granting of a routine variance.
6. While the character of the neighborhood is pdmadly large lot zoning, the Board received
testimony from the adjacent property owner to the north that excavation work by the applicant to
raise the grade at the site has impeded the natural flow of runoff, creating flooding on the
neighbors' property. The neighbor, Mr. Martin Trent, also testified that because fill was used to
raise the grade of the applicant's property, the visual impact on his property resembles and three-
story structure.
7. The Board agrees with Mr. Trent that drainage problems have resulted from construction of the
applicant's house and that there is a need to mitigate the visual impacts of the house. The
applicant has submitted a landscaping and drainage plan dated 22 Sep. 01, and two letters dated
September 28, 2001 to the Board.
IN ACCORDANCE WITH THE REVIEW STANDARDS SET FORTH tN TOWN LAW 2167-B-3
'AREA VARIANCES,' THE BOARD HAS CONSIDERED THE BENEFIT TO THE APPLICANT IF
THE VARIANCE IS GRANTED, AS WEIGHED AGAINST THE DETRIMENT TO THE HEALTH,
SAFETY AND WELFARE OF THE NEIGHBORHOOD AND COMMUNITY BY SUCH GRANT,
AND DETERMINES THAT:
1. Grant of the area vadance will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. The height of the house is 32 feet, below the
maximum 35-foot height limit of the Town Code. The house is located on a large 1.44 acre lot and
well-screened from view of most neighbors, except for the adjacent property owners to the
northwest. The Board believes that with the landscaping and drainage plans set forth as condition
of this approval, the vadance will not negatively impact the neighborhood.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for the
applicant to pursuant, other than an area variance. The nature of the applicant's problem is
somewhat unusual because the house was constructed under a valid building permit and it was not
until the house was almost completed that the building department advised him that a state

vadance WOuld be required to either classify the lower level as a basement or grant a vadance for
a three-st~)ry structure, the existing drainage problems for the neighbor to the northwest would be
exacerbated.
3. The requested variance is not substantial. The height Of the structure is 32 feet, three feet
below the Town Code's 35-ft. height limit. The variance granted herein, is for a non-habitable utility
and storage area only, as further noted below.
4. The difficulty has been in part created by the applicant, who is an architect and shown have
known that the lower storage area may not be conforming to the local code, and' in part by the
building inspector who initially approved the permit and plans. ~
5. The proposed variance will not have an adverse effect or impact on the physical or
environmental conditions in the neighborhood because of the condition set forth below.
RESOLUTION/ACTION: On motion by Member Tortora, seconded by Member Collins, it was
RESOLVED, to GRANT a variance for the existing grade level non-habitable storage and
utility area, also referred to as the first floor, subject to the following-CONDITIONS:
1. The utility/storage area shall not be habitable, and shall not contain a kitchen or sleeping
quarters.
2. No further additions in height to the house shall be permitted without the review and approval of
the Zoning Board of Appeals.
3. All stormwater run-off emanating from the applicant's property must be contained on the
applicant's property.
4. By May 15, 2002, the applicant shall install and complete the landscaping and drainage areas
as shown on applicant's September 22, 2001 plans and two letters dated September 28, 2001, and
made a part of thi<J record.
This action does not authorize or condone any current or future use, setback or other feature of the
subject property that may violate the Zoning Code, other than such uses, setbacks and other
features as are expressly addressed in this action.

PETITION NO. 2000-0856
Upon the application of Richard Gluckman R.A., filed pursuant to 19 NYCRR 450 on August 25, 2000, and
upon all other papers in this matter, the Department makes the following determination:
NATURE OF GRIEVANCE AND RELIEF SOUGHT
The petition pertains to the construction of a new building of A1 (single family) occupancy, three stories in
height, of type 5 (wood frame) construction, approximately 3,600 square feet in area, located at 4630 Orchard
Street, Orient Town of Southold, County of Suffolk, State of New York.
The petitioner is seeking relief from:
9 NYCRR 705.2(b), which requires that buildings of type 5 construction are permitted to have a maximum
height of two stories above a basement or cellar or above finished grade where there is no basement or
cellar. [The petitioner requests relief to allow a single family dwelling of type 5 construction to be three
stories in height.]
FINDINGS OF FACT
1. The building that is the subject of this petition is being constructed in a flood zone area and has two wood
framed stories above a basement.
2. The basement which is of masonry construction was intended to be set below grade Iow enough so as not to
be deemed a story as per section 705.1(g)(1) of the Uniform Code. However, FEMA regulations required that
the basement be set on grade which has caused the building to be regulated as three stories.
3. The base .ment in question has no habitable spaces within it and has openings in areas that would allow water
to pass through in the event of flooding.
4. The petitioner has proposed to install as permanent equipment in all habitable spaces within the third story,
a portable escape ladder which attaches securely to at least one window sill in each room. Such ladder will

be constructed with rigid non-combustible rungs designed to standoff from the building wall, will be capable
of sustaining a minimum load of 1,000 pounds, will extend to level ground, and provide unobstructed egress
to legal open space.
5. The petitioner has proposed to install interconnected fire-and smoke-detecting devices throughout the entire
building and connected into a central station.
6. The petitioner has proposed that the building will meet all other applicable sections of the Uniform Code.
7. The local Code enforcement official has been consulted in this matter and does not object to the granting of
a routine variance under the provisions of 19 NYCRR 450.6.
CONCLUSIONS OF LAW
Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would produce a
negligible additional health, safety and security benefit to the occupants of the building.
DETERMINATION
WHEREFORE IT IS DETERMINED that the application for a variance from 9 NYCRR 705.2(b), to allow a
single family dwelling of type 5 construction to be three stories in height; be and is hereby PROPOSED TO BE
GRANTED with the following conditions:
1. That the petitioner installs interconnected fire- and smoke-detecting devices throughout the entire building
and connected into a central station.
2. That the petitioner install as permanent equipment in all habitable spaces within the third story, a portable
escape ladder which attaches securely to at least one window sill in each room. Such ladder shall be
constructed with rigid non-combustible rungs designed to standoff from the building wall, shall be capable of
sustaining a minimum load of 1,000 pounds, shall extend to level ground, and provide unobstructed egress
to legal open space.
3.That the building meet all other applicable sections of the Uniform Code.
This DECISION is issued under 19 NYCRR 450.6. Unless obiected to by the petitioner in a writing received
by the Department, the decision shall become FINAL after fifteen days of receipt of the decision by the parties.
This decision is limited to the specific building and application before it, as contained within the petition, and
should not be interpreted to give implied approval of any general plans or specifications presented in support of
this application.

floor that are usable solely for parking of vehicles, building access, or storage in an area other than a
basement and which are subject to flooding shall be designed to automatically equalize hydrostatic flood
forces on exterior walls by allowing for the entry and exit of flood waters. Designs for meeting this
requirement must either be certified by a registered professional engineer or architect or meet or exceed the
following minimum criteria: A minimum of two openings having a total net area of not less than one
square inch for every square foot of enclosed area subject to flooding is provided. The bottom of all
openings shall be no higher than one foot above grade. Openings may be equipped with screens, louvers,
valves, or other coverings or devices provided that they permit the automatic entry and exit of flood
waters."
APPLICABILITY

INSTRUCTIONS FOR FINAL APPROVAL OF CONSTRUCTED SYSTEMS
It is the applicant's respo~ibility to call the Department to' arrange inspections Of the sewage disposal system and water
supply facilities prior to backfilling. These include inspections of the soil excavation for the sewage disposal systetn
and inspections of the wate? supply well,'well lateral, public water supply line, disposal system, piping and final
grading. Other inspections may be required.
Following satisfactory construction and inspections:
1. The applicant must submit 4 prints of an as-built plan (up to and including 1 l"x17"), by a licensed design
professional, of the subject property showing the following:
a. the lot location and dimensions;
b. the lot number(s) and the nmne of the subdivision, if applicable; ' '
c. pe, manent structures (i.e., buildings, driveways, w,lkways, swimming pools, decks, etc.);
d. the exact location of the private well, ff applicable (give at least 2 dimensions measured from the comers of the
building); .
e. the exact location of the public water line, if applicable;
f. the exact location of the septic tank and leaching pool(s), if applicable. Give 2 dimensions from the building
comers to the covers of the septic tank and each leaching pool;
g. the exact location of the sewer line from the dwelling to the street;'if applicable; and .' -. .
h. have a clear area at least 3"x5" for the Department's approval stamP.
2. The applicant must submit a certificate from the sewage disposal installer.attes~fiag that the system has been '
installed according to the criteria of the Suffolk County Department of Health Service?, When.applicable.
3. If a well has been installed as the potable water supply, the applicant must submit a current well water analysis
(within one year) and a well driller's certificate. If the well or water quality does not conform to standards, proof
of eorrecfive measures will be required. Refer to "Standards and Procedures for Private Water Systems."
4. In those cases where public sewers are utilized for the dwel.ling, the applicant'is also tO submit o. ne (1) copy of the
sewer line inspection approval from the public sewer district. In districts operated by Suffolk County, two (2)
copies of Form S-9, duly executed by the Suffolk County Department of Public Works, are required.
5. In those cases in which the installation and connection of the public water service line bas not been inspected by
the Department of Health Services, a tap letter from the appropriate water company ~s required.

Dear Mr. Pysh:
As we discussed this moming~ I am writing to summarize my findings regarding the Gluckman
property on Orchard Street, Orient.
The Gluckman lot was created in 1974 as Lot 2 of the Minor Subdivision of Robert Casola-Laurie
Properties, Incorporated. Because this subdivision was in fact approved by the Southold Town
Planning Board, the lot is recognized by the Town pursuant to Southold Town Local Law No.
22-1997, as contained in Section 100-24(A)(2) of the Town Code (copy enclosed). Specifically,
it is recognized as a legally pre-existing, nonconforming lot because its area does not meet the
minimum acreage required by an R-200 zone, which had not yet been created in 1974. Therefore,
the building setbacks must conform not to those designed for an R-200 zone but to those
specifically designed for legally pre-existing, nonconforming lots, as outlined in Section 100-
244(B) of the Town Code (copy enclosed). ,
For your reference, I have enclosed copies of 1) the approved subdivision map, signed by then
Chairman of the Planning Board, John Wickham; 2) the subdivision map stamped approved by the
Suffolk County Health Department; 3) the Declaration of Protective Covenants filed as part of the
subdivision approval; and 4) an environmental assessment of the properties prepared by the
Suffolk County Soil Conservation Service.
Finally, it may useful for you to know that I met with Melissa Spiro of the Southold Planning

This review is made at the request of the Suffolk County Soil and Water
Conservation District for the town of Southold. It is based on maps submit-
ted by Roderick Van Tuyl, dated October 12, 1973 and July 9, 1973.
There are two principal soils which we have mapped~on the property including
the lower area mapped as Tidal Marsh Soils and the higher elevation portion
of the property mapped as Haven Loam. However both soil areas are influenc-
ed by tide level shallow water table.
There is a low earthen dike running along King Street which apparently ex-
cludes normal high tide from the low parts of this property. Our soil maps
indicate, and existing vegetation bares out that at one time the south west-
erly section of this property was subject to regular tidal flooding.
We advise against building on land lower than five feet in elevation. On this
property the land lower than five feet comprises almost 80% of the area.
We also recommend that in areas such as this where storm tide flooding can
occur, that the main floor of afl residential buildings be constructed at
at least eight feet of elevation above mean high tide. We would also recom-
mend that utilities for any houses in such an area be located at least eight
feet above mean high tide.
There have been instances where land owners have excavated ponds inside of
dikes that exclude tide waters, so that the excavated material can be used to
raise the general level of adjoining land. We do not recommend this proce-
edure. We understand that the New York State Department of Environmental
Conservation may consider such action inproper or illegal where land that was
formally marine wetlands is involved.
We strongly recommend that the Town consider the adoption of a regulation or
an ordinance that would control the indiscriminent construction of ponds with-
in it's boundries. In some other towns in New York State local governments
have required that land owners have adequately prepared pond designs reviewed
and approved by the County Soil and Water Conservation District before pond
building permits can be issued. There is no charge for such District service.
We note that much of the lowest land in the proposed subdivision has been re-
presented on Mr. Van Tuyl's survey as having a general elevation of 1.5 to

3.1 feet above mean sea level. We recommend that in the future the developer
be required to show elevation in feet above mean high tide. This ~ill pre-
sent a much more accurate picture of the land surface relationship to tidal
flooding.
Finally, please note that there is a substantial wildli£e food shrub border
along King Street presently producing large amounts of berries and other food
for birds and small mammals. We would hope that if development does occur on
this property, this wildlife food border can be considered carefully for pre~
servation.

A. A lot created by deed or town approval shall be recognized by the town if any one (1) of the
foll6wing standards apply and if the lots have not merged:
(I)
The identical lot was created by deed recorded in the Su.ffol~County Clerk's office on or
before .rune 30, 1983, and the lot conformed to the mini~t/m lot requirement(s) set forth
in Bulk Schedule AAEN(l) as of the date of lot creation.
(2) The lot(s) in question is/are approved by the Southold Town Planning Board.
(3) The lot(s) in question is/are shown on a subdivision map approved by the Southold Town
Board prior to June 30, ] 983.
(4) The lot(s) in question is/are approved and/or recognized by formal action of the Board of
Appeals prior to .rune 30, 1983.
B. All lots which are not recognized by the town pursuant to the above section shall not receive
any building permits or other development entitlements.
C. All lots are subject to the merger provisions of§ 100-25.
§ 100-25. Merger. [Added 11-28-1995 by I~L. No. 23-1995]
A. Merger. A nonconforming lot shall mer~e with an adjacent conforming or nonconforming lot
which has been held in common ownership with the first lot at any time after July I, 1983. An
adjacent lot is one which abuts with the parcel for a common course of fit~y (50) feet or more
in distance. Nonconforming lots shall merge until the total lot size conforms to the current
bulk schedule requirements.
Definitions. "Common ownersh/p" shall mean that the parcel is held by the same person in the
same percentage of ownership as an adjoining pamel.
Exceptions. Lots which are recognized under § 100-24 and meet any of the following
categories shall be exempt from the merger provision set forth above and shall not be deemec[
merged by operation of this chapter:
<1) The nonconforming Jot?as a minimum size of forty thousand (40,000)square feet, or
(2) The nonconforming lot obtained a lot size variance fi-om the Zoning Board, or
(3) If the lot is not on the maps described in former § 100-12, EN(2) the nonconforming lot

A. This section is intended to provide minimum standards for granting ot'a building permit for
the principal buildings of lots which are recognized by the town under § 100-24, are
nonconforming and have not merged pursuant to § 100-25.

NOTIFICATION OF OTHER PERMITTEE OBLIGATIONS
Item A: Permittee Accepts Legal Responsibility and Agrees to Indemnification
The permittee expressly agrees to indemnify and hold harmless the Department of Environmental Conservation
of the State of New York, its representatives, employees, agents, and assigns for all claims, suits, actions, damages,
and costs of every name and description, arising out of or resulting from the permittee's undertaking of activities or
operation and maintenance of the facility or facilities authorized by the permit in compliance or non-compliance with the
terms and conditions of the permit.
Item B: Permittee to Require its Contractors to Comply with Permit
The permittee shall require its independent contractors, employees, agents and assigns comply with this permit,
including all special conditions, and such persons shall be subject to the same sanctions for violations of the
Environmental Conservation Law as those prescribed for the permittee.
Item C: Perrnittee Responsible for Obtaining Other Required Permits
The permittee is responsible for obtaining any other permits, approvals, lands, easements and rights-of-way that
may be required to carry out the activities that are authorized by this permit.
Item D: No Right to Trespass or Interfere with Riparian Rights
This permit does not convey to the permittee any dght to trespass upon the lands or interfere with the ripadan dghts
of others in order to perform the permitted work nor does it authorize the impairment of any dghts, title, or interest in real
or personal property held or vested in a person not a party to the permit.
GENERAL CONDITIONS
General Condition '1: Facility Inspection by the Department
The permitted site or facility, including relevant records, is subject to inspection at reasonable hours and intervals
by an authorized representative of the Department of Environmental Conservation (the Department) to determine
whether the permittee is complying with this permit and the ECL. Such representative may order the work suspended
pursuant to ECL 71-0301 and SAPA 401(3).
The permittee shall provide a person to accompany the Department's representative during an inspection to the
permit area when written or verbal notification is provided by the Department at least 24 hours prior to such inspection.
A copy of this permit, including all referenced maps, drawings and special conditions, must be available for
inspection by the Department at all times at the project site. Failure to produce a copy of the permit upon request by a
Department representative is a violation of this permit.
General Condition 2: Relationship of this Permit to Other Department Orders and Determinations
Unless e?(pressly provided for by the Department, issuance of this permit does not modify, supersede or rescind
any order or determination previously issued by the Department or any of the terms, conditions or requirements
contained in such order or determination.
General Condition 3: Applications for Permit Renewals or Modifications
The permittee must submit a separate written application to the Department for renewal, modification or transfer
of this permit. Such application must include any forms or supplemental information the Department requires. Any
renewal, modification or transfer granted by the Department must be in writing.
The permittee must submit a renewal application at least:
a) 180 days before expiration of permits for State Pollutant Discharge Elimination System (SPDES),
Hazardous Waste Management Facilities (HWMF), major Air Pollution Control (APC) and Solid Waste
Management Facilities (SWMF); and
'b) 30 days before expiration of all other permit types.
Submission of applications for permit renewal or modification are to be submitted to:

General Condition 4: Permit Modifications, Suspensions and Revocations by the Department
The Department reserves the right to modify, suspend or revoke this permit when:
a) the scope of the permitted activity is exceeded or a violation of any condition of the permit or provisions
of the ECL and pertinent regulations is found;
b) the permit was obtained by misrepresentation or failure to disclose relevant facts;
c) new material information is discovered; or
d) environmental conditions, relevant technology, or applicable law or regulation have materially
changed since the permit was issued.

If future operations by the State of New York require an alteration in the position of the structure or work herein
authorized, or if, in the opinion of the Department of Environmental Conservation it shall cause unreasonable
obstruction to the free navigation of said waters or flood flows or endanger the health, safety or welfare of the people
of the State, or cause loss or destruction of the natural resources of the State, the owner may be ordered by the
Department to remove or alter the structural work, obstructions, or hazards caused thereby without expense to the
State, and if, upon the expiration or revocation of this permit, the structure, fill, excavation, or other modification of
the watercourse hereby authorized shall not be completed, the owners, shall, without expense to the State, and to
such extent and in such time and manner as the Department of Environmental Conservation may require, remove
all or any portion of the uncompleted structure or fill and restore to its former condition the navigable and flood
capacity of the watercourse. No claim shall be made against the State of New York on account of any such removal
or alteration.
The State of New York shall in no case be liable for any damage or injury to the structure or work herein authorized
which may be caused by or result from future operations undertaken by the State for the conservation or
improvement of navigation, or for other purposes, and no claim or right to compensation shall accrue from any such
damage.
Granting of this permit does not relieve the applicant of the responsibility of obtaining any other permission, consent
or approval from the U.S. Army Corps of Engineers, U.S. Coast Guard, New York State Office of General Services
or local government which may be required.
All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended solids,
sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally
deleterious materials associated with the project.
Any matedal dredged in the prosecution of the work herein permitted shall be removed evenly, without leaving large
refuse piles, ridges across the bed of a waterway or floodplain or deep holes that may have a tendency to cause
damage to navigable channels or to the banks of a waterway.
6. There shall be no unreasonable interference with navigation by the work her~!n authorized.
If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the
applicant shall, without expense to the State, and to such extent and in such time and manner as the Department
of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore
the site to its former condition. No claim shall be made against the State of New York on account of any such
removal or alteration.
If granted under 6NYCRR Part 608, the NYS Department of Environmental Conservation hereby certifies that the
subject project will not contravene effluent limitations or other limitations or standards under Sections 301,302, 303,
306 and 307 of the Clean Water Act of 1977 (PL 95-217) provided that all of the conditions listed herein are met.
At least 48 hours pdor to commencement of the project, the permittee and contractor shall sign and return the top
portion of the enclosed notification form certifying that they are fully aware of and understand all terms and
conditions of this permit. W'~thin 30 days of completion of project, the bottom portion of the form must also be
signed and returned, along with photographs of the completed work and, if required, a survey.
10. All activities authorized by this permit must be in strict conformance with the approved plans submitted by the

During construction, concrete or leachate shall not escape or be discharged, nor shall washings from transit mix
trucks, mixers, or other devices enter tidal wetlands and or pretected buffer areas.
Any debris or excess material from construction of this project shall be completely removed from the adjacent area
(upland) and removed to an approved upland area for disposal. No debris is permitted in tidal wetlands and or
pretected buffer areas.
There shall be no disturbance to vegetated tidal wetlands or protected buffer areas as a result of the permitted
activity.
The storage of construction equipment and materials shall be confined to within the project work site and or upland
areas greater than 100 linear feet from the tidal wetland boundary.
All disturbed areas where soil will be temporarily exposed or stockpiled for longer than one (1) week shall be
contained by a continuous line of staked hay bales/silt curtain (or other NYSDEC approved method) placed on the
seaward side between the fill and wetland or protected buffer area. Tarps are authorized to supplement these
approved methods.
All fill shall consist of "clean" sand, gravel, or soil (not asphalt, flyash, broken concrete or demolition debris).
To protect the values of the tidal wetlands, a permanent vegetated buffer zone shall be established. There shall
be no disturbance to the natural vegetation or topography within an area extending 100 Inear feet landward of the
tidal wetland boundary.
Roof runoff shall be directed to drywells a minimum of 100 feet landward of the tidal wetland boundary for immediate
on-site recharge.
There shall be no draining of swimming pool water directly or indirectly into tidal wetlands or protected buffer areas.
Driveways and parking areas shall be constructed of pervious material.
Roads, driveways, and/or parking areas shall be graded to direct runoff away from tidal wetlands and protected
buffer areas.
Sanitary system (bottom of tank and leaching pools) shall be located a minimum of 2' above seasonal high
groundwater.
13. The permittee shall incorporate the following language as a notice covenant to the deed:
"Regulated tidal wetlands associated with Orient Harbor are located at Orchard Street, Orient, County Tax Map
Number: Distdct 1000, Section 27, Block 03, Lot 7.8, otherwise known as the properties of Richard Gluckman and
his heirs, assigns, or successors. This property is subject to the provisions of New York State Environmental
Conservation Law (ECL) Article 25 or its successor, and the conduct of regulated activities may occur only pursuant
to ECL Article 25 if prior approval is given by the New York State Department of Environmental Conservation
(NYSDEC) or its successor. Regulated activities include, but are not limited to the erection of any structure(s);
excavation; dredging grading and filling; clearing of vegetation; and application of chemicals."
This deed covenant shall be recorded with the Clerk of Suffolk County within 90 days of the issuance of this permit.
A copy of the covenanted deed or other acceptable proof of record, along with the number assigned to this permit,
shall be sent within one calendar year of the issuance of this permit to: NYSDEC, Regional Manager, Bureau of
Habitat, SUNY Building 40, Stony Brook, New York t1790-2356.
