I meassured the openings to be 26 3/4 wide x 20 3/4 high including an allowance for the sill. This gives me a total square footage of 3.85 of clear opening. In order to meet code the window opening would have to have an additional 3/4"of height. This is very close. In addition there are two such openings in the master bedroom. In total there is 7.7 square feet of openings usable for egress in the master bedroom when to two windows are considered. Although I would not specifiy this size window again I am asking that it be accepted due to the fact that they are so close to meeting code, are already installed, and there asre multiple openings. No. 5096 - GUS-MAR REALTY. Property Location: 380 Marina Lane and Chios Lane, East Marion Parcel 35.-8-5.14 BASIS OF APPEAL: Building Inspector's Notice of Disapproval dated February 7, 2002, denying a permit to construct a single-family dwelling because the foundation survey indicates that the property has two front yards with setbacks of 39.63 ft. and 39.75 ft. instead of the code-required 40 ft. minimum, pursuant to Article XXIV, Section 100-244. AREA VARIANCE REQUESTED: Applicant requests 2+ inch front setback variances for the "as built foundation" of the new dwelling under construction. (Ref. BP #27793) FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on April 18, 2002 at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: PROPERTY FACTS: The subject property has frontage on Marina Lane and Chios Lane and contains 30,000 sq. ft. The property is known as Lot 10 of the filed Map of Summit Estate, Section 1, all as shown on the January 29, 1999 survey prepared by Young & Young, last amended February 6, 2002. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted, the board make the following findings: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The variances are for 2+ inches and will have no effect on the neighborhood. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because the foundation has been poured and to cut back 2+ inches of the foundation would hardly seem reasonable. 3. The variance granted herein is not substantial and represents 2+ inch reductions in the 40 ft. minimum front yard setback. 4. The variance granted will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. Grant of the requested variances are the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new dwelling while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Tortora seconded by Member Oliva, and duly carried, to: GRANT the Variance as applied for. This action does not authorize or condone any current or future use, setback or other feature of the subject property that violates the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action.
