SOUTHOLD TOWN BOARD
SPECIAL MEETING
MARCH 18, 1998
A Special Meeting of the Southo. ld Town Board was held at 3:45 P.M.,
Wednesday, March 18, 1998, at the Southold Town Hall, 53095 Maln Road,
Southold, New York. Supervisor Jean W. Cochran opened the meeting at
3:52 P.M.
Present: Supervisor Jean W. Cochran

SUPERVISOR COCHRAN: Since there are not the required number of
Town Board members present to conduct business, I am recessing this
Special Meeting of the Town Board until 2:00 P.~M., Thursday, March 19,
1998.
. MEETING RECONVENED
A Special Meeting of the Southold TOwn Board was held on March 19,
1998, at the Southold Town Hall, Main Road, Southold, New York.
Supervisor Cochran opened the meeting at 2:00 P.M.

SUPERVISOR COCHRAN: I wish to reconvene the meeting that was called
on March 18, 1998 to take care of the business of bid on scavenger waste
removal transport and bids on sand. Shall we deal with sand first?
· -Moved' by Councilwoman Hussie, seconded by Councilman Murphy, it was
RESOLVED that the Town Board of the Town of Southold hereby accepts
the bid of Terry Contracting & Materials, inc. for supplying 30,000 cubic
yard~ :' (more or less as may be needed) of Bankrun Sand for Landfill
Capping Purposes, at a cost of $3.9~ per cubic yard delivered.
COUNCILMAN HUSSIE: Along with that line i handed out everybody a little
sheet-about us picking up the sand, or not picking up, and having it
delivered. At one point, we thought, my goodness, if we could get a trailer
and .dd it all ourselves we would be better off, because if you look at the
price you can see that you can pick it for $2.00 a yard from one company.
But, then we did all the math-on it, and it turns out it would be a matter
of $3,000," when all was said and donee, and we would have to dedicate' one
whole person presently at the landfill just to do this job~ which didn't
make sense.
COUNCILMAN MURPHY: Plus we would have to add the cost of a trailer.
COUNCILWOMAN HUSSIE: Yes, we would have a trailer, but still I think
that Jim doesn't think he could devote one person just to do that. It would
take more than a year.
COUNCILMAN MOORE: Thirteen hundred trips. So, Terry Contracting has
the resources?
COUNCILMAN ROMANELLI: Yes, they are an excavator that are located in
Riverhead, right on West Main Street in Riverhead. That is what he does
for a living.
SUPERVISOR COCHRAN: A gentleman just called from AJV, and he .said
the Iow bid was $3.94, and his was $3.95, but that he combines and the
breakoff is 17 and a half loads?
COUNCILWOMAN HUSSIE: If we could pick up the 17 and a half loads, but
we don~t have the truck to pick it up. I don~t think we can mix bids like
that, either having it delivered.
SUPERVISOR COCHRAN: Did he speak to you?
COUNCILWOMAN HUSSIE: No, but Jim did about the same time that you.
SUPERVISOR COCHRAN: He said he spoke to Jim. You were listening to
Jim, when he was calling me. As long as it has been considered.
COUNCILWOMAN HUSSIE: I don't think we can take one from column A and
one from column B. That is the problem.
SUPERVISOR COCHRAN: What is the pleasure of the Board?

Romanelli, Councilman Moore, Councilwoman Hussie, Supervisor Cochran.

Now the bid on the scavenger waste removal and
COUNCILMAN ROMANELLi: We accept the Patanjo~s bid at $.0u,? We have
been using him.
SUPERVISOR COCHRAN:

Laury, is everything he has to supply with us
TOWN ATTORNEY DOWD: No, I believe his bid was missing a bid bond.
COUNCILMAN ROMANELLI: A certified check.
TOWN ATTORNEY DOWD: Right, but we did include in the specs that we
could waive those requirements, defects in the bid, if we thought it was
appropriate.
COUNCILWOMAN HUSSIE:
COUNCILMAN ROMANELLI:
COUNCILWOMAN HUSSIE:
It is a matter of a penny difference.
Three quarters of a cent, almost a penny.
It's a penny this year.
TOWN CLERK NEVILLE: He also felt that since that he is dealing with the
Town, and the Town currently has some of his money, that is why he
didn't submit the certified check, but he said he would submit it if we had
called after the bid. It wasn't submitted with it.
SUPERVISOR COCHRAN: I just want to make sure it is all in order, and
Laury has checked it. This will have to make us make the increase today.
COUNCILMAN ROMANELLI: This will bring us between Patanjo's fee, and
the $.03 tipping at Bergen Point to $.07, so I move we at least move to
$.07.
SUPERVISOR COCHRAN: We have one motion on the floor, so let's do that
one first, and then we can go to the increase that will have to happen.
Are you people ready for the vote? Any more discussion?
TOWN ATTORNEY DOWD: We will amend the vote just to say we will word
and waive the $500.00 fee.

2.- Moved by Councilman Romanelli, seconded by Councilwoman Nussie, it was
RESOLVED that the Town Board of the Town of Southold hereby accepts
the bid of Don Patanjo Cesspool Service Corporation, Brookhaven,
N.Y., at a price of $.04 per gallon to remove, transport and dispose of
2,020,000 gallons of' scavenger waste from the Southold Scavenger Waste
Treatment Facility to an approved disposal location between April 1, 1998 to
December 31, 1998 and $.04 per gallon between January 1, 1999 to
December 31, 1999; and be it
FURTHER RESOLVED that Supervisor Jean W. Cochran be and she
I.... hereby is authorized and directed to execute a contract between the Town
i and Don Patanjo Cesspool Service Corp. to accomplish the removal,
' transportation, and disposal of scavenger waste from the Scavenger Waste
Treatment Facility, all in accordance with the approval of the Town
Attorney.
2 .-Vote of the Town Board: Ayes: Councilman Murphy, Councilman
Romanelli, Councilman Moore, Councilwoman Hussie, Supervisor Cochran.
This resolution was duly ADOPTED.
COUNCILMAN ROMANELLI: It is a matter of just raising our price. Seven
cents is our cost without anything else without anything else added on. I
make a motion that we actually go to $.08 to cover a few hidden costs.
3.-Moved by Councilman Romanelli, seconded by Councilwoman Hussie, is was
RESOLVED that the Town of the Town of Southold hereby increase the
fee for transporting to and disposing of scavenger waste at the Southold
Scavenger Waste Pretreatment Facility from $.04 to $.08 per gallon,
effective March 23, 1998.
SUPERVISOR COCHRAN: Is there any discussion? I am not going to vote
for that motion. I will vote for $.07, but I won't go to the $.08.
COUNCILMAN MURPHY: I am of the same feeling in that we are presently
adsorbing about 1,7 cents on this,
COUNCILWOMAN HUSSIE: We are absorbing what?
COUNCILMAN MURPHY: At the present time we are charging the carters
$.04. The original bid was 2.7, and we are paying $.03 for the tipping fee,
which comes out to 6.7, so we are absorbing 1.7 cents at the present time.
To take this up to $.08 right now some of the contentions are right, that
the carters will find a cheaper place to dump this material. If we are going
to pass that cost on, they are going to figure their cost no matter what at
$.08, and I feel that the taxpayers are going to get hit right between the
eyes with this, not taxpayers, but residents are going to get hit too hard
with this, that $.08,

SUPERVISOR COCHRAN: When they get their cesspools cleaned, yes. I
.think we should only increase the $.07 at this .point until the committee,
and if John wants more people on the committee we can give him that
support system, that we look more deeply into the entire issue, and not
just the price increase at this time, that we still have not made a decision
do we belong in this business? Do you supplement the municipalities
responsible for certain things? We don't certainly have sewer lines. We do
provide garbage places. ! would like to see a total in-depth look at it,
before it is raised to $.08.
COUNCILMAN ROMANELLI: There is no doubt that more research needs to
be done on it, No one is disputing that. This is just a matter of covering
our costs at this point.
SUPERVISOR COCHRAN: You said $,07 would cover the cost,
COUNCILMAN ROMANELLI: Seven cents would cover the cost. As far as
other research as being the. business, and what we should ,do in the future,
no doubt that needs more, research.
SUPERVISOR COCHRAN: So, i am favor of going to $.07.
Moved by Councilman Moorer seconded.by Councilwoman Hussier
That Resolution #3 be amended to $.07 per gallon.
RESOLVED that the Town Board Of the Town of Southold hereby increases
the fee for transporting to and disposing of scavenger waste at the
Southold Scavenger Waste Pretreatment Facility from $.0z~ to $.07 per
gallon, effective March 23, 1998.
3.-Vote of the Town Board: Ayes: Councilman Murphy, Councilman Moore,
Councilwoman Hussle, Supervisor'Cochran. No: Councilman Romanelii.
This resolution was duly ADOPTED.
SUPERVISOR COCHRAN: We said we would allow the carters, and John,
would give them notification of the increase, so that they may pass it on,.
and tell them this is in relation to bid, we are not making a profit, but
operationally it was a necessity. Notify them. Let's make it Monday. i
think they agreed that Monday: would fine.

RESOLVED that the following bill be and hereby is. ordered paid: Alpine
Ocean Seismic Survey, Inc. in the amount of $73,571.85 for for professional
services in connection with the Geophysical Investigation Program for the
Duck Pond Point to Horton Point study.
COUNCILMAN MURPHY; Just as explanation, too, this is one of the first
the Sound Shore Study contracts last January, and it has been completed.
The reports are in to New York Department of State Office, and they are
being compiled, but the company has done what has been contracted for
completely at this point.

Moved by Councilwoman Hussie, seconded by Councilman Romanelli, it was
RESOLVED that this Town Board meeting be and hereby is adjourned at
2:19 P.M.
Vote of the Town Board: Ayes: Councilman Murphy, Councilman
Romanelli, Councilman Moore, Justice Evans, Councilwoman Hussie,
Supervisor Cochran.
