A meeting of the Southold Town Conservation Advisory Council was held Wed.,
November 8, 2023 in the Town Hall Conference Room and via Zoom.

CALL TO ORDER
John Stein called the meeting to order at 4:30pm.
REPORTS
John Chandler attended the Board of Trustees meeting held on October 18th. He reported
the meeting was business as usual.
OLD BUSINESS
Carol Brown reported that the 2022 End of Year Report for Trustee Applications is
complete and she will continue to work on 2023. She shared some of the highlights of

NYSACC Conference on the Environment 2023 and looks forward to sharing some of the
educational presentations with the CAC members in the near future.
As a follow-up to previous discussions regarding the recruitment of Junior Members to the
CAC, Carol will draft a mission statement and e-mail to the other members for their
review.
CLIMATE SMART COMMUNITIES
Jim Bunchuck, ,Solid Waste Coordinator for the Town of Southold will be the guest
speaker at the CAC meeting on December 6th
Carol Brown and Shannon Wright created a spreadsheet for the CSC, which has been
shared with Andrew Manitt and the CAC members. John Stein will continue working with
department heads.
Carol Brown, Maggie Merrill and Inga Van Eysden attended a Transportation Commission
meeting to hear Mark Lowery of NYS DEC present information on Adaption to Sea Level
Rise. The following is a link to Climate Smart Resiliency Planning and Mark's presentation
slides. Mark is the Assistant Director of the Office of Climate Change for the
DEC. mark.lowery(aD-dec.ny.gov climate.change(cD-dec.ny.gov
Ella Nielsen, NYLCVEF Climate Smart Communities Outreach Project sent an e-mail
requesting to speak with the CSC Coordinator for Southold Town. John Stein said he
would contact her.
Anne Murray, NFEC requested an update on CSC. John Stein stated that he been busy
with the closing on his house, however he'll have something prepared for next month's
meeting.
Carol Brown attended a Peconic Estuary Policy Committee meeting. Bob DeLuca was the
guest speaker, with water quality as a one of the priorities.
Councilman Brian Mealy mentioned that the 2024 Budget includes $100,000 for a Coastal
Resiliency Action Plan.

RECOMMENDATIONS —WETLAND PERMIT & COASTAL EROSION PERMIT
APPLICATIONS
Moved by John Stein, seconded by Caroline Burghardt, it was
RESOLVED to SUPPORT the application of SUSAN MAGRINO DUNNING to enclose
286 sf. of existing covered deck along the seaward fagade of the existing southerly frame
dwelling and extending (connecting) to the northerly frame dwelling in order to combine
both dwellings into one dwelling, and install two (2) bay windows along the easterly facade
of the existing southerly frame dwelling. All proposed activities to be located a minimum of
135' from MHW/tidal wetlands.

The gate was closed and the CAC members could not access the property. Based on the

remove existing 1,108 sf. grade level masonry patio and 179 sf. area of landscape
retaining walls; construct 872 sf. of upper grade-level masonry patio, 18'X 46' swimming
pool with 60 sf. hot tub, 428 sf. of lower grade-level masonry patio, 18'X 31' roofed over
open-air accessory structure with closets, outdoor fireplace, and basement for storage
and pool equipment, and associated steps and planters; install pool drywell and 4' high
pool enclosure fencing; remove 34 If. of existing stone retaining wall and construct 24 If. of
new 2.7' high stone retaining wall; and establish a 50'.wide non-disturbance/non-
fertilization buffer adjacent to wetlands boundary, replacing approx. 3,850 sf. of existing
lawn with native plantings and maintaining a cleared 4' wide pathway to existing dock.

the existing single-family dwelling, reinforce floor joists, add insulation, footings, and storm
windows. Keep old framing and exposed ceiling beams. Relocate bathroom in area
previously occupied by tank. Upgrade to clean energy mechanicals and appliances.
Replace decking and add new deck.

extended. Construct a one-story 13'X 16' den extension, one-story 14'X 9' front entry
extension requiring the existing 130 sf. front deck to be extended. Install a 16'X 40' in-
ground pool associated with a 1,340 sf. paved patio and an 8'X 18' shed for pool
mechanicals and storage.

include the removal of the existing timber retaining wall and replacement with new 79 If. of

new vinyl retaining wall in new landward position; install a 10 If. return on north side of
property and a 6' return on the south side of the property. The new retaining wall to be
installed at a raised height of 30" above top cap of existing retaining wall. New proposed
4'X 5' long steps to water with thru-flow decking surface to be installed. Prior to removal of
the existing retaining wall there shall be 17 cy. excavated from the landward side from
between old wall and new wall, this material shall be used as fill along with 13 cy. from
upland sources behind the new retaining wall to create a wetland area. Plantings to
consist of salt hay (spartina patens), seaside lavender (limonium carolinianum) and
saltwort (salicornia spp.) Plants shall be planted in accordance with NYSDEC guidelines
based on availability at nursery. Provide a 10' wide non-turf buffer landward of proposed
bulkhead.

maximum depth of 4 MLW; and place up to approximately 240 cy. of resultant sand/silt
spoil in three adjacent on-site deposition areas.

RESOLVED to NOT SUPPORT the application of THOMAS BARNARD for the existing
3'X 16' steps to a 13.8'X 16.6' wood deck at top of the bulkhead and 3'X 6' steps to the
beach. Existing wood deck attached to the rear of the existing house 29.9'X 23.6' with
8.2'X 5,.5' steps set into the deck. Existing dwelling 2,500 sf. with an attached garage,
interior conversion of an existing enclosed covered porch on the east side of the house
10'X 10' made part of the living area of house in 2011 needs a building permit Existing
outdoor shower with fence enclosure of east side of the house. Drywells in the front yard,
if required for the existing structures. Alterations to 11.9'X 13' connection between garage
and house (in the front yard), and an existing egress with a 3'X 3' landing with stairs to

RESOLVED to NOT SUPPORT the application of HC NOFO, LLC to construct a two-story
single-family dwelling to replace existing single-story dwelling, to include an addition of a
new 440 sf. two-car accessory garage and proposed 2,465 sf. gravel driveway. The
existing building of 883 sf. will be demolished, and the newly proposed ground floor will be
800 sf. with a proposed second-floor that is 1,175 sf. Total square footage of the new two-
story dwelling will be 2,975 sf. Construct a wraparound ground floor terrace on the north,
west and east sides of the house totaling to 1,008 sf., as well as a new 250 sf. second-
floor I/A septic system. Creation of a non-turf barrier 15' upland of the wetlands composed
of native vegetation, install drywells with gutters and leaders for roof run-off, and retain
and establish new native vegetation to provide added soil stabilization and filtering
capacity.

Permit#9996 to authorize the construction of a 12'X 36' one-story den/dining addition with
Bilco door and basement below (instead of approved 12'X 20' on-story addition; and no
farther seaward than approved addition or existing covered porch to be removed);
construction of a 12'X 22.8' unroofed deck addition with 4'X 4' landing and steps;
relocation of proposed drywell; addition of a 15' vegetated non-turf buffer adjacent to
wetlands, inclusive of approx. 765 sf. of existing lawn to be replaced with native
vegetation.
