In the Matter of the Petition of: DECISION Joseph Sawicki For a Variance to the New York State PETITION NO. 2002-0498 Uniform Fire Prevention & Building Code ----------------------------------------------------------- Upon the application of Joseph Sawicki,filed pursuant to 19 NYCRR 450 on May 6, 2002, and upon all other papers in this matter,the Department makes the following determination: NATURE OF GRIEVANCE AND RELIEF SOUGHT The petition pertains to construction of a new building of Al (single family) occupancy,two stories in height, of type 5 (a wood frame) construction, approximately 1900 square feet in area, located at 1055 Light House Road,Southold,Town of Southold, Suffolk County, State of New York. The petitioner is seeking relief from: 9 NYCRR 711.2(b),which requires that bathrooms, toilet rooms, kitchenettes, corridors and recreation rooms shall have a minimum height of seven feet. [The petitioner requests relief to allow a bathroom built into the roof area of the second story with a cathedral ceiling height of approximately 11 feet 0 inches sloping down to 6 feet 4 inches.] FINDINGS OF FACT 1. As part of the new construction a bathroom is to be constructed into the roof area of the second floor of the building that is the subject of this petition. 2. The cathedral ceiling height in the bathroom is approximately 11 feet 0 inches, sloping down to 6 feet 4 inches. 3. with the placement of the fixtures, the 11 foot ceiling height is more than adequate for normal usage. 4 . The petitioner has proposed to install fire and smoke detecting device in the in the second floor as required by Section 721 of the Uniform Code. Pet.itkon No. 2002-0498 'Page 2 5. The local Code enforcement official has been consulted in this matter and does not object to the granting of a routine variance under the provisions of 19 NYCRR 450.6. CONCLUSIONS OF LAW Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would produce a negligible additional health, safety and security benefit to the occupants of the building. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 9 NYCRR 711.2(b),to allow a bathroom built into the roof area of the second story with a ceiling height of approximately 8 feet 0 inches sloping down to 5 feet 5 inches, be and is hereby PROPOSED TO BE GRANTED with the following conditions: 1. That the petitioner installs a fire and smoke detecting devices in the second story in conformance with the Uniform Code. 2. That the building meets all other applicable sections of the Uniform code. This DECISION is issued under 19 NYCRR 450.6. Unless objected to by the petitioner in a writing received by the Department the decision shall become FINAL after fifteen days of receipt of the decision by the parties. This decision is limited to the specific building and application before it,as contained within the petition, and should not be interpreted to give implied approval of any general plans or specifications presented in support of this application.
