BaSed on the information you have submitted, the New York State Department of Environmental
Conservation has determined that:
The property landWard of the 14 foot elevation contour interval as shown on the survey prepared
by Joseph A. Ingegno on 11/3/99, s beyond the jurisdiction of Article 25 (Tidal Wetlands).
Therefore, in accordance with the current Tidal Wetlands Land Use Regulations (6NYCRR Part
661) no permit is required under the Tidal Wetlands Act. Please be advised, however, that no
construction, sedimentation, or disturbance of any kind may take place seaward of the tidal
wetlands jurisdictional boundary, as indicated above, without a permit: It is your responsibi i~ to
ensure that all necessary precautions are taken to prevent any sedimentation or other alterabon
or disturbance to the ground surface or vegetation within Tida/Wetlands jurisdiction which may
result from your project. Such precautions may include maintaining adequate work area between
the tidal wetland jurisdictional boundary and your project (i.e. a 15' to 20' wide construction area)
or erecting a temporary fence, barrier, or hay bale berm.
Please be further advised that this letter does not relieve you of the res~~~ng any

Dear Glenn:
As per our recent conversations and as per my field observations on Tuesday August
28, 2001, the use of 8 inch thick concrete masonry units for the foundation walls for
both the House on the Bay and The Cottage is hereby approved in lieu of the 8 inch
thick concrete walls shown on the contract documents. Please use galvanized ladder
type reinforcing at every other horizontal joint and #4 rebar 32 inches on center
vertically.
The top courses of the foundation at the House on the Bay shall be 4 inch thick CMU.
The sill plate for the floor joists shall be bolted to the 8 inch thick CMU wall and the sill
plate for the 2x6 exterior walls shall be bolted to to 4 inch thick CMU walls.
Please install the required foundation vents.
Please install the required rigid foundation insulation to the exterior of the foundation
walls, keeping the top of insulation 2 inches below finish grade.
It definitely appears that the rat slab for each building will be well above el. 15'-0".
Please have Ingegno verify.
I will prepare a detail s.k_etch of the foundation top showing a change in the skirt trim
from 5/4x5-1/2 to :5/4x3,1/2.
