APPLICATION FOR CERTIFICATE OF OCCUPANCY
This application must be filled in by typewriter OR ink and submitted to the building
inspector with the following: for new building or new use:
1. Final survey of property with accurate location of all buildings, property lines,
streets, and unusual natural or topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal(S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains
less than 2/10 of 1% lead.
5. Commercial building, industrial building, multiple residences and similar buildings
and installations, a certificate of Code Compliance from architect or engineer
responsible for the building.
Submit Planning Board Approval of completed site plan requirements.
For existing buildings (prior to April 9, 1957) non-conforming uses, or buildings and
Vpre-existing" land uses:
i. Accurate survey of property showing all property lines, streets, building and
unusual natural or topographic features.
27 A properly completed application and a consent to inspect signed-by the applicant.
If a Certificate of Occupancy is denied, the Building Inspector shall state the
reasons therefor in writing to the applicant.

Dear Mr. Boufis:
I represent Barry and Gail Mallin who own property at
Nassau Point which includes Lot 222 and a portion of "Bayberry
Road" on the easterly boundary (SCTM #1000-111-12-7.1 and 7.2).
When the Mallins took title their deeds included all of the
original of Lot 222 and a portion of "Bayberry Road" which is on
their easterly boundary of Lot 222. It is my understanding this
portion of "Bayberry Road" was never opened and is a ~paper
street". Many years ago the developer deeded the title to this
portion of the ~road" to Mallins predecessors in title. When the
improvements were constructed on Lot 222 the southerly portions
of "Bayberry Road" were developed into the driveway for the
premises with an entry on Wunneweta Road. The other portions of
"Bayberry Road" were a dirt path which was used by the Mallins
predecessor in title as access for their boat.
Concerning Building Permit No. 25006 Z (Drake), Mr. & Mrs.
Mallin have very strong objections to you issuing same. In
particular the location of the proposed driveway on the westerly
side of the Drake property would come across their property onto
their driveway which is curbed and paved. In reviewing the Drake
building permit application I realize you treated the westerly
side of their property as fronting on "Bayberry Road" and
therefore classifying it as a front yard area. The survey you
were furnished is certainly misleading as this is not a road in
any sense of the word.
If you will go and view the premises in question you will
see the easterly portion of the Mallins' property which adjoins
the Drakes' property contains a curbed private driveway with a
fence which delineates the property line. Further, you will find
this portion of "Bayberry Road" is neither a public street nor
is it approved as a street giving access to the proposed building
pursuant to Town Law 280-a

To prevent any litigation concerning this matter I would
appreciate if you would review the situation and get back to me.
Keep in mind the Mallins objection is not mean spirited as the
topography of the Drake lot affords ample opportunity for a
driveway access off either Wunneweta Road or Nassau Point Road.
As to Building Permit No. 25007 Z (Koch), the Mallins have
no objection to the location of the house or garage on this
property. The proposed garage is in effect the rear yard because
the front yard is Nassau Point Road for the reasons I stated in
this letter.
