A. For new building or new use:
1. Final survey of property with accurate location of all buildings, property lines, streets, and unusual natural or
topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal (S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.

BASIS OF APPLICATION: Building Department's November 20, 2001 Notice of Disapproval
citing Section 100-33, for the reason that the accessory building in not located in the
required rear yard area,
AREA VARIANCE RELIEF REQUESTED: Applicant requests a Variance for the location of
the 14.6' x 11.6' accessory building located, in part, in the easterly front yard, north of the
dwelling, at 64+- feet from the north property line. Part of the shed is located in a yard
which may be designated a rear or a side yard on this corner lot.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on April 18, 2002, at
which time written and oral evidence was presented. Based upon all testimony,
documentation, personal inspection of the property and the area, and other evidence, the
Zoning Board finds the following facts to be true and relevant.
PROPERTY FACTS/DESCRIPTION: Applicant's property is a 34,063 sq. ft. parcel with
frontage on two streets: 211.35 feet along Holden Avenue and 159.53 feet along Dick's
Point Road. The property is improved with a 1-1/2 story frame dwelling and the "as built"
14.6' x 11.6' accessory building.
REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony and record
before the Board and personal inspection, the Board makes the following findings:
1. Grant of the area variance will produce an undesirable change in character of
neighborhood or a detriment to nearby properties. The as built shed was tastefully built to
match the existing house and will not be out of character in the neighborhood, since it
partly in a permitted yard area.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for
applicant to pursue, other than an area variance. Due to the challenging topical terrain of
this lot, the location is reasonable and meets or exceeds the setback requirements under
the bulk schedule.
3. The requested location is justifiably due to the topical layout of the lot, with two front
yards and a limited rear yard area.

The "as built' accessory shed, proposed on property in the R-40 District, is not permitted pursuant to
Article IIIA Section 100-33 which states;
"Accessory buildings shall be subject to the same requirements as 100-33 of the Agricultural
Conservation District,"which states;
"In the Agricultural-Conservation District and Low-Density Residential R-80, R-120, R-200,
and R-400 Districts, accessory buildings and structures or other accessory uses shall be located
in the required rear yard."
Although the Southold Town Building Department issued a permit (#27249) for construction of an
accessory shed in the required rear yard. The structure was later constructed partially in the front
