DANIELS SECRETARY OF STATE GOVERNOR -------------------------------------------------------- In the Matter of the Petition of: DECISION Robert Gaska For a Variance to the New York State PETITION NO. 2002-0158 Uniform Fire Prevention & Building Code ------------------------------------------------------- Upon the application of Robert Gaska, filed pursuant to 19 NYCRR 450 on February 8, 2002 and upon all other papers in this matter, the Department makes the following determination: NATURE OF GRIEVANCE AND RELIEF SOUGHT The petition pertains to a new building of Al(one family) occupancy, two stories in height, of type 5 (wood frame)construction, approximately 4,200 square feet in gross maximum floor area, located at 560 Grandview Drive, Town of Southold, County of Suffolk, State of New York. The petitioner is seeking relief from: 9 NYCRR 713.1(c)(2),which does not permit a variation in riser heights of more than one-eight inch. [The petitioner wishes that a variation of more than one-eighth inch be permitted in consecutive risers.] FINDINGS OF FACT 1. The steps which are the subject of this petition provide access to the kitchen from an attached garage and is one of at least three paths of entry to the house. 2. There is a difference in elevation of approximately 19 inches between the floor of the garage and the floor of the kitchen. Poured concrete steps with three risers permit transition between these floor levels. 3. The lower two risers are 7'/z inches each with a 11'/2 inch deep tread in between. The top rise is 5 inches with a 17'/ inch deep tread at its base. 4. The 171/2 inch deep tread serves as a type of landing which interrupts the strides used for traversing a typical set of stairs. The reduced vertical rise is compensated by the increased horizontal stretch required for a stride at the top riser. This gives a sense of consistency if three strides are employed to travers the steps. 5. In that the steps are to be used by persons familiar with their surroundings, the variation in riser heights of these three steps do not appear to pose a significant hazard. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 9 NYCRR 713.1(c)(2), to permit a variation of more than one-eighth inch in consecutive risers as described; be and is hereby PROPOSED TO BE GRANTED with the following condition: 1. That a handrail shall be placed at the open side of the steps which shall parallel the profile of the steps. This DECISION is issued under 19 NYCRR 450.6. Unless objected to by the petitioner in a writing received by the Department, the decision shall become FINAL after fifteen days of receipt of the decision by the parties. This decision is limited to the specific building and application before it, as contained within the petition, and should not be interpreted to give implied approval of any general plans or specifications presented in support of this application.
